TO: Honorable Mayor and City Council
THRU: David Carmany, City Manager
FROM: Terrence Belanger, Interim Director of Public Works
SUBJECT: APPROVAL OF CONTRACT WITH DUDEK &
ASSOCIATES
SUMMARY OF REQUEST:
The City Council is asked to adopt Resolution No.5962 ratifying attached contract
to Dudek and Associates for environmental consultant services.
BACKGROUND:
In 1986, the Arco Gas Station at 5 th Street and PCH fuel tanks leaked. The tanks
were replaced and the onsite area was cleaned up per Orange County Health
Care Agency Requirements.
In early 2009, Orange County Health Care Agency informed the City, Arco will be
installing a temporary soil vapor extraction system, additional groundwater and
vapor monitoring wells. The work was required due to high levels of benzenes
detected in the existing monitoring wells. Benzene is an organic chemical
compound that is an additive to gasoline and is a known carcinogenic.
Due to the nature of the project and scope of work outside city staff expertise,
staff selected an environmental consultant specializing in this field.
Staff selected Dudek and Associates of Irvine. Dudek is an engineering and
environmental consulting firm having knowledge and extensive experience in
investigating and remediating hydrocarbon and related chemical contamination of
soil, soil vapor, and groundwater associated with releases from Underground
Storage Tanks and petroleum processing facilities. The firm also has evaluated
potential health risks due to vapor intrusion into buildings using the DTSC-
modified Johnson - Ettinger model at numerous sites and have relationships with
independent toxicologists that can subcontract to Dudek.
Agenda Item P
Page 2
The following, but not limited to, is the scope of work Dudek and Associates will
perform:
1. Review and comment on monitoring reports and work plans prepared by
ARCO
2. Will independently evaluate vapor migration potential and exposure
potential
3. Subcontract to an independent toxicologist to review and independently
calculate potential human health risks
4. Evaluate the progress of remediation and propose additional actions to
expedite the remediation
5. Counsel the City and participate in meetings
FINANCIAL IMPACT:
There is no financial impact. Arco will reimburse the City 100% of its cost. The
consultant contract is not to exceed $100,000.
RECOMMENDATION:
It is recommend City Council adopt Resolution No. 5962 ratifying attached
contract to Dudek and Associates for environmental consultant services.
