EQCB Minutes of January 28, 1998 vn. Scheduled Matten 4. Minutes of August 19, 1997 Mr. Curtis indicated he had provided Boardmember McGuire with a transcribed verbatim excerpt of the portion of the August 19th Minutes dealing with the Board's next hearing date. He indicated he felt the verbatim excerpt was substantially the same as the paraphrased version originally presented. Boardmember McGuire indicated she still has concerns regarding the Minutes of August 19, 1997 and doesn't feel the verbatim text is similar to the paraphrased version. Mr. Curtis indicated he would bring this matter back at the Board's next meeting to allow the fun Board to review the verbatim portion. Boardmember Hurley indicated staff had indicated it would include the items on the consent calendar in the Minutes. Mr. Curtis indicated they would be added in the final version. The Board determined by consensus to continue this matter to its next meeting. s. Minutes of September 16, 1997 Boardmember Hurley, on Page 3 toward the bottom in his comment, he made an "objective" rather than "object" good faith.. .. He also asked that the page numbers be added and a number added at the bottom of page 2. On Page 12 second line from the top, change "that" to "than". Further down the page under "Mr. Hurley said..." change "the" to "that". Also, the final resolution needs to be attached. Finally, the end of the Minutes should reflect the meeting was continued to October 23n1, rather than the 29th. Mr. Curtis indicated that a major reason this has been continued was regarding concerns Boardmember McGuire had with some comments attributed to her. Mr. Curtis indicated the tape of this meeting appears to have been erased. The Department secretary frequently erases the tapes once she has finished transcribing them. Boardmember McGuire indicated she was going to amend the portion attributed to her as she recalls it. She indicated she would provide it to staffwithin the next week. Mr. Curtis indicated he would integrate her comments into the minutes in an underline/strikeout fashion. The Board determined by consensus to continue this matter to its next meeting to see a copy of the final resolution on the Hellman EIR. as well as Boardmember McGuire's revisions. 6. Minutes of December 10,1997 Boardmember Hurley had several typos he wanted corrected. On Page 2, at the bottom, second paragraph from the bottom, the sentence is not complete. It should be " . .. until the Commission completes it consideration." On Page 4, Roman numeral 9, "computer" is spelled wrong. A staffconcem regarding the discussion of the timetable of the Bixby EIR. should be included. Motion by Hurley; second by Voce to approve the Minutes of December 10, 1997 as amended. Consideration of a Letter from EQCB re: Bixby "For Sale" Signs . Boardmember McGuire discussed her concern with the "for sale" signs Bixby has placed on their properties. They are advertising land they do not have. It is causing confusion and hysteria among the residents. She would like the Board to draft a letter to the DRE (Department of Real Estate) expressing the City's concern with this false advertising. Mr. Curtis indicated this matter is not within the purview of the EQCB. He felt if the Board is to draft such a letter, it should be a memo to the City Council expressing the Board's concerns. Chainnan Rosenman felt the Council may not be particularly interested in fonowing this matter due to the ongoing project review and the MOU on the project. Boardmember McGuire indicated the bottom line is that Bixby is misrepresenting what they have and the DRE says that's illegal. The MOU doesn't discuss "for sale" signs, and even ifit did, DRE's rules supersede. The signs are not designed to sen the property, but rather to create confusion and hysteria, which they have. The fact the signs show the proposed zoning makes an average person think the zoning is already in place. Chainnan Rosenman asked what the upcoming meeting schedule looked like; will the DEIR. be on the February agenda? Mr. Curtis said no. Right now it looks like February 27th or maybe a week later is when the DEIR. win begin circulation. At this time staff is looking at the regular March meeting being the DEIR hearing. Mr. Curtis asked Boardmember McGuire why a letter from the City is needed if she has already filed a complaint. She indicated if a concern originated with the City it would carry more weight. Boardmember McGuire indicated she would draft a proposed letter for the Board to review at the next meeting. The crux of the letter will be impacts the signs have had on the hearing process. In the meantime the Boardmembers will discuss this matter with their councilmembers. Chainnan Rosenman indicated he had a concern with this letter giving the impression that the Board was prejudiced. vm. Staff Concerns - none. IX. Board Concerns Chainnan Rosenman spoke regarding potential means of advertising Bixby DEIR. hearings. Boardmember Voce discussed the problems with tree topping and indicated trees were recently topped at the Bay City Center. Chainnan Rosenman asked that the letter from the Airport Land Use Commission which was . provided to the City Council be provided to members Voce and Hurley.
