HomeMy WebLinkAboutCC Res 5964 2010-01-25RESOLUTION NUMBER 5964 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH RATIFYING THE PROCLAMATION OF EXISTENCE OF A LOCAL EMERGENCY BY THE DIRECTOR OF EMERGENCY SERVICES AND PROCLAIMING THE CONTINUED EXISTENCE OF A LOCAL EMERGENCY THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: Section 1. The City Council finds the following facts to be true: A. Section 8630 of the Government Code authorizes the designation of a City official to proclaim a local emergency. B. Section 3.25.020 of the Seal Beach Municipal Code empowers the Director of Emergency Service to proclaim the existence of a local emergency when the City of Seal Beach is affected or likely to be affected by a public calamity and the City Council is not in session and further provides that any local emergency proclaimed by the Director of Emergency Services shall become null and void after seven days unless ratified by the City Council. C. Conditions of disaster or peril to the safety of persons and property have arisen within the City, caused by flood and storm commencing on or about 10 a.m. on the 19th day of January, 2010 at which time the City Council was not in session. D. The City Manager, acting as Director of Emergency Services, did proclaim the existence of a local emergency within the City on the 20th day of January, 2010. E. The above described conditions of storm and flooding did warrant and necessitate the proclamation of the existence of a local emergency in Seal Beach. F. The above described conditions of disaster or peril, which continue to exist, and forecasts for high tide, high surf, and more rain in the immediate future warrant the continuation of the existence of a local emergency in Seal Beach. Section 2. The City Council hereby ratifies the Proclamation of a Local Emergency by the Director of Emergency Services dated January 20, 2010 and proclaims that the local emergency shall continue to exist until its termination is proclaimed by the City Council. Section 3. During the existence of said local emergency, the powers, functions, and duties of the emergency organization of this City shall be those prescribed by state law, by ordinances and resolutions of this City, and by the City of Seal Beach Emergency Operations Plan. The City Manager shall furthermore continue to have all authority previously specified by the City Council to address and respond to conditions of high tide, high surf, and flooding. Section 4. The City Clerk shall certify to the adoption of this Resolution and shall cause this Resolution and her certification to be entered in the Book of Resolutions of the Council of this City. Resolution Number 5964 PASSED, APPROVED and ADOPTED by the City Council of the City of Seal Beach at a regular meeting held on the 25th day of January , 2010 by the following vote: AYES: NOES: ABSENT: ABSTAIN: Councilmember Councilmember Councilmember iu , LV Councilmember i zlh24 Mayor 1 ATTEST: �,JA 4 L ity Clerk STATE OF CALIFORNIA } COUNTY OF ORANGE } SS CITY OF SEAL BEACH } I, Linda Devine, City Clerk of the City of Seal Beach, California, do hereby certify that the foregoing resolution is the original copy of Resolution Number 5964 on file in the office of the City Clerk, passed, approved, and adopted by the City Council at a regular meeting thereof held on the 25th day of January 2010. 1 PROCLAMATION OF A LOCAL EMERGENCY BY THE DIRECTOR OF EMERGENCY SERVICES OF THE CITY OF SEAL BEACH WHEREAS, Section 8630 of the Government Code authorizes the designation of a City official to proclaim a local emergency; and WHEREAS, Section 3.25.020 of the Seal Beach Municipal Code empowers the Director of Emergency Services to proclaim the existence of a local emergency when the City of Seal Beach is affected or likely to be affected by a public calamity and the City Council is not in session; and WHEREAS, the Director of Emergency Services does hereby find: 1. That conditions of disaster or peril to the safety of persons and property have arisen within the City, caused by flood and storm commencing on or about 10 a.m. on the 19th day of January, 2010 at which time the City Council was not in session; and 2. That as of the time and date of this Proclamation, the City Council of the City of Seal Beach is not in session and cannot immediately be called into session. NOW, THEREFORE, IT IS HEREBY PROCLAIMED that a local emergency now exists throughout the City. IT IS FURTHER PROCLAIMED AND ORDERED that during the existence of said local emergency the powers, functions, and duties of the emergency organization of this City shall be those prescribed by state law, by ordinances and resolutions of this City, and by the City of Seal Beach Emergency Operations Plan. This Proclamation shall have no further force or effect seven days from the date of its adoption unless the City Council shall take action to ratify this Proclamation.
