Minutes of May 29, 2002
The Environmental Quality Control Board (EQCB) meeting of May 29, 2002 was called
to order by Vice-Chairperson Hurley at 6:30 p.m. The meeting was held in City
Manager's Conference Room.

Mr. Cummins noted that Chairperson Porter had telephoned yesterday to ask that he be
excused as he would be unable to attend tonight's meeting.

11. City Response Letter Re: "Draft Action Memorandum/Removal Action Work
Plan - Non-time Critical Removal Action for Solid Waste Management Unit 24
- Stationary Demilitarization Furnace," Naval Weapons Station, Seal Beach.
Recommendation: Authorize the Chairman to sign the draft response letter,
with any additional comments determined appropriate, and instruct staff to
forward to the City Council for Information.
Mr. Cummins provided a brief overview of the Staff Report (Staff Report is on file for
inspection in the Planning Department.) and outlined the proposed action for removal
and replacement of contaminated soil at Unit 24. Vice-Chairperson Hurley inquired as
to why the City Mayor's signature was not included in this document. Mr. Cummins
explained that unless the area of contamination was affecting public property or was
large enough to impact other areas of the City, the response letters would only be
signed by the Chairperson for the Environmental Quality Control Board (EQCB). Vice-
Chairperson Hurley recommended omitting the last two sentences in the letter.

response letter, with any additional comments determined appropriate, and instruct staff
to forward to the City Council for Information.

Member Jones inquired about both Items 12 and 13 relating to Site 73. (Staff Reports
are on file for inspection in the Planning Department.) Mr. Cummins reported that the
Staff Reports essentially relate to the same Naval Weapons Station (NWS) document,
with one report being an Engineering Analysis and Cost Evaluation and the other being
the Work Plan. He noted that several months ago the Board had reviewed the draft
copy of these documents and had recommended an alternative that involved additional
diagnosis of the top 8-10 feet of soil, as compared to the NWS proposed approach. He
indicated that the City's main concern at this point is that the contamination under the
water tower manifests concentric rings of different types of contamination that may
extend beyond the NWS property line and onto the public right-of-way. Mr. Cummins
stated that the NWS report has since been revised to include some of the City's
recommendations, but the response letter does request that the Navy complete soil
analysis and decontamination beyond the NWS property line. Member Voce noted that
at the Restoration Advisory Board (RAB) meetings the suggestion was made that
background studies also include areas adjacent to the base and not just those areas
within the base boundary in order to provide data for comparison. Member Unrath
interjected that the City does have precedence on this issue as Site 70 at the northwest
corner of the base is outside the NWS property line and he noted that some of the
concentric rings of contamination extend as far as the Hellman Property.
Vice-Chairperson Hurley made recommendations for changes to the last paragraph of
the response letter, which were noted by Mr. Cummins.
MOTION by Voce; SECOND by Jones to authorize the Chairman to sign the draft
response letter for Item 12 with any additional comments determined appropriate, and
instruct staff to forward to the City Council for Information.

Member Unrath noted that there might have been a duplication of page one as the
information in the memorandum includes no section that provides the conclusions. He
asked if remediation was being completed at this location. Mr. Cummins stated that he
had not been involved with this particular project, but would provide information at the
EQCB meeting for June 2002.

Vice-Chairperson Hurley asked when the report was received, as there was no date on
the report itself. Mr. Cummins stated that the report had been received within the last
60 days. Vice-Chairperson Hurley commented on the extended time it took to circulate
the report, and the expense that appears to have gone into printing the document. He
then inquired regarding the section of the report on the mitigation at the tidal ponds.
Member Voce provided responses to those queries for which he had information. Vice-
Chairperson Hurley then commented on other items within the report.
