Roll Call Present: Absent: Also Present: Chairperson Porter, Members Hurley, and Unrath Members Jones and Voce Department of Development Services Mac Cummins, Assistant Planner Mr. Cummins reported that he had received an e-mail from Member Jones indicating that he would be absent from tonight's meeting and requested to be excused. He stated that Member Voce had also telephoned last week to report that he would not be in attendance tonight. II Approval of Agenda MOTION by Hurley; SECOND by Porter to approve the Agenda as presented. APPROVAL OF MINUTES - May 29,2002 Recommendation: Approve Minutes subject to any corrections determined appropriate. Vice-Chairperson Hurley noted a correction to Page 5, Line 37. City Response Letter Re: Approval of Comment Letter - Bellflower 011 Drill Site Draft EIR (Haynes Generating Station). Recommendation: Authorize the Chairman to sign the draft response letter, with any additional comments determined appropriate, and instruct Staff to forward to the City Council for Information. Staff Report Mr. Cummins explained that the proposal for this project is to set up oil drills on the site and begin an exploratory drilling program to determine whether any crude oil and gas resources exist. He stated that this would involve an approximate 86,400 square foot easement on the Los Angeles Department of Water and Power (DWP) Haynes Power Plant Property. He noted that vehicular access would be from Westminster Avenue with trucking and assembly of the drill rig taking approximately two weeks to complete. He indicated that the drilling structure would have a mast height of 120 feet. Mr. Cummins reported that the proposed methods for transport of the oil off site would be via truck, via an existing DWP pipeline, or a hybrid of both methods. Member Unrath asked if trucking were a viable means of transporting the oil. Mr. Cummins stated that in his opinion the most likely method of transport would be via pipeline. Member Unrath inquired whether the truck transport of the materials for the oil rig would arrive and exit from the east or west along Westminster Avenue. Mr. Cummins stated he could not recall. He then briefly reviewed the highlights of the comment letter noting that the City has proposed alternate sites that may make more sense and help reduce impacts to the City of Seal Beach. He stated that Staff had met with officials of DWP and DWP has agreed to meet with the Golden Rain Foundation to develop a noise mitigation and aesthetics program. Chairperson Porter noted a correction in his name on the signature page of the letter. Vice-Chairperson Hurley also noted several corrections, which were noted by Mr. Cummins. Vice-Chairperson Hurley also commented on the use of "must," shall," or "should" when referring to mitigation measures within an EIR document. He noted that he was bothered when any mitigation is phrased using the word "should," and referred to the California Environmental Quality Act (CEQA) guidelines regarding this question. Mr. Cummins explained that in accordance with CEQA many times the word "should" is used in an EIR to allow for more discretion in what an agency can demand and some flexibility with what may be feasible for an applicant to accommodate. MOTION by Hurley; SECOND by Unrath to authorize the Chairman to sign the draft response letter, with agreed to changes, and instruct Staff to forward to the City Council for Information. MOTION CARRIED: AYES: NOES: ABSENT: 3-0-2 Hurley, Porter, and Unrath None Jones and Voce VI Staff Concerns In response to Member Unrath's request at the last EQCB meeting, Mr. Cummins provided an update on the contamination cleanup at the corner of Seal Beach Boulevard and Pacific Coast Highway. He reported that testing continues on the one undeveloped lot between the liquor store and the existing new homes. Member Unrath requested an update on the proposed widening of the Garden Grove 22 Freeway. Mr. Cummins stated that no new information had been received. VII Board Concerns Chairperson Porter reported that he would not be in attendance for the July 2002 meeting and asked to be excused.
