Roll Call Present: Chairperson Voce, Members Barton, Hurley, O'Malley, and Vineyard None Absent: Also Present: Department of Development Services Lee Whittenberg, Director II Approval of Agenda MOTION by Hurley; SECOND by O'Malley to approve the Agenda as presented. APPROVAL OF MINUTES - July 28, 2004 Recommendation: Approve Minutes subject to any corrections as needed. Member Hurley referred to Page 7, Line 45, which should read 3 - 1 - 0 - 1 to correctly reflect the vote MOTION by O'Malley; SECOND by Barton to approve the Meeting Minutes of July 28, 2004 as amended. Copy for review: "The Final Project Closeout Report, Non-Time Critical Removal Action for IR Site 7 and Site 4, Naval Weapons Station Seal Beach. 2. Copy for review of the Initial Study Notice of Preparation (NOP) for a Draft Environmental Impact Report (DEIR) on the Rossmoor Village Center. Member Hurley requested an update on the Rossmoor Village project. Mr. Whittenberg explained that the Board had previously reviewed a Draft Mitigated Negative Declaration (MND) for the Rossmoor Project and at that point the City's perspective was that all potential impacts of the project could be mitigated. He stated that when the issue of the potential historic nature of The Parasol Restaurant arose, Staff determined that a DEIR was necessary to evaluate the potential significance of The Parasol Restaurant as a historic structure. He indicated that this NOP indicates that the City will be completing this process. He noted that there is a 30-day comment period and the EQCB will conduct a meeting on September 15, 2004 to review the document, provide comments to Staff, and to receive comments from the public. He stated that once the comment period is over, the City will prepare a DEIR for circulation and public review and comment, and during this time the Board would actually review the environmental analysis. Member O'Malley interjected that when the Board had conducted the public review of the MND it had recommended to City Council that The Parasol Restaurant be preserved and that it serve as a centerpiece to the development. Mr. Whittenberg reported that the MND has never gone before City Council because the determination was based upon the large volume of comments received regarding the potential historical significance of The Parasol Restaurant. He said that an evaluation of the structure must be completed to see if it is a potentially significant structure and this must be evaluated under California Environmental Quality Act (CEQA) standards. Member Barton asked if the owners of The Parasol Restaurant were willing to reinforce the structure, would the project still have to go through all of these levels of government. Mr. Whittenberg stated that the owner of the Rossmoor Center property has indicated that he does not want to keep the building there. He said the Rossmoor Village Center project would probably not proceed if The Parasol structure remains, as it would be difficult to design the project to work around The Parasol, and the effect on traffic and circulation must be considered. The owner would also have to determine whether reinforcing the structure would be practical not knowing the current structural condition of the building. Mr. Whittenberg noted that a status update would be provided at the September 15, 2004 meeting. Member Hurley asked if that all of the issues addressed when reviewing the MND would be evaluated again in the DEIR. Mr. Whittenberg confirmed that this was correct. 08-25-04 EQCB Minutes.doc Page 3 of 5 .~ 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 .23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 .45 46 City of Seal Beach Environmental Quality Control Board Meeting Minutes of August 25, 2004 VII Board Concerns Member Barton referred to the Boeing Integrated Defense Systems (BIDS) Specific Plan and noted that she was not aware that Boeing had homeland security services. She asked if this were the only facility that provides this to the City. Mr. Whittenberg stated that Boeing's homeland security is staffed for the national government. Member Barton asked if there were any other services available to Seal Beach. Mr. Whittenberg stated that he is not aware of the Naval Weapons Station (NWS) having a homeland security division. Member Hurley noted that every police department has something to do with homeland security. Mr. Whittenberg countered that the police department is not separate from any agency that the City is aware of. He then noted that due to the classified nature of these offices, even the City Building Inspectors may be limited to the specific structures they can access for inspection at Boeing. Member Barton expressed her concern that beyond the Seal Beach Police Department (SBPD) the City itself has no specific homeland security agency. Mr. Whittenberg stated that because of the NWS in the City there are a number of agencies that are continually overseeing the area. Member Hurley referred to the Minutes of July 28, 2004 and asked if when an item is removed from the Consent Calendar for further discussion, it should be placed under "Scheduled Matters"? Mr. Whittenberg confirmed that it should. Member Hurley then asked if any other documents other than those for the Rossmoor Village EIR would be forthcoming. Mr. Whittenberg stated that Staff had received an application for development on the DWP property, which was deemed incomplete and the City is in the process of acquiring a cost proposal from the consultant that prepared the EIR. He said that it would probably be 4-5 months before this comes before the EQCB. He also noted that the Home Deport and Marina Shores projects in Long Beach would eventually return to EQCB for review. Member Hurley inquired about the Sunset Marina Harbor project. Mr. Whittenberg stated that comments were submitted and the City is awaiting recirculation of the DEIR or presentation of the Final EIR. Member Vineyard asked if a timeline for the major projects could be prepared. Mr. Whittenberg stated that this would be difficult to do, as the City does not have any control over the Long Beach and Sunset Marina projects, but he stated that Staff could provide this. Member Hurley asked if Staff sees any potential for other environmental problems within Seal Beach. He noted that it appears that the area has been pretty well covered. Mr. Whittenberg stated that within the next 20-25 years the 100-acre deed-restricted area on the Hellman property for wetlands would be coming up for review, and also the oil separation facilities on First Street and owned by ChevronlTexaco. He noted that ChevronlTexaco had started the process to change the General Plan (GP) zoning to Residential Medium Density (RMD), but had stopped the process approximately 3 years ago. Member Hurley asked if the property currently poses any environmental hazards. Mr. Whittenberg confirmed that ChevronlTexaco has cleaned up the area and it poses no hazard. He indicated that future items for review would primarily be the continued restoration projects on the Naval Weapons Station (NWS). City of Seal Beach Environmental Quality Control Board Meeting Minutes of August 25, 2004 sites have been cleaned up at this point with Site 70 being the one major site left to restore. Member O'Malley inquired about the Boeing Integrated Defense Systems (BIDS) public hearing before the California Coastal Commission (CCC). Mr. Whittenberg stated that the CCC approved this project on August 12, 2004. Member O'Malley then asked if the San Gabriel River Master Plan EIR is not available. Mr. Whittenberg stated that their website indicates that the EIR will be available in October 2004. VIII Adjournment Member Voce adjourned the meeting at 6:50 p.m. to the next scheduled meeting of September 15, 2004.
