Minutes of September 29, 2004
Chairperson Voce called the Environmental Quality Control Board (EQCB) meeting of
September 29, 2004 to order at 6:30 p.m. The meeting was held in City Council
Chambers and began with the Salute to the Flag.

Chairperson Voce noted that Vice-Chairperson O'Malley is to be excused, as he had
reported at the meeting of September 15, 2004 that he would not be present tonight.
III Approval of Agenda
Member Hurley requested that Item No. 2 be removed from the agenda for further
discussion.

VI Scheduled Matters
2. RECEIVE AND FILE - Seal Beach Naval Weapons Station - Installation
Restoration Program Status Report Re: RAB Project Update, dated
September 22, 2004.
Member Hurley referred to the last item on the last page of the Staff Report entitled
"Risk Management Options." He asked Chairperson Voce if he had attended the
September 21, 2004 meeting of the Restoration Advisory Board (RAB). Chairperson
Voce stated that he had not attended. Mr. Whittenberg stated that he had attended the
meeting. Member Hurley asked if during the question and answer period had there
been any discussion regarding the recommendations under the "Risk Management
Options," specifically, the section on "During removal action evaluation." Mr.
Whittenberg stated that there had not been any particular discussion on this. He noted
that this section refers to a document that is to be presented for public review and
comment at a future date. Member Hurley asked if the removal action evaluation
occurs before, during, or after the removal action. Mr. Whittenberg stated that it
happens before the removal action. Chairperson Voce interjected that this evaluation is
done in advance of taking any removal action. Member Hurley then noted that the
statement that during the evaluation the indicated risk reduction is to be augmented and
the indicated habitat impact is to be minimized "sounds like slanting." Chairperson Voce
clarified that augmenting a risk reduction does not indicate that the risk is to be
increased but reduced. Member Hurley countered that this is an evaluation and not a
development of a work plan to do these things. Member Vineyard suggested that
maybe it should state "analysis" instead of "evaluation." Chairperson Voce stated that
as he reads the text it states that the evaluation is going to include looking at the risk
reduction even more closely and of a scope to minimize habitat impact even more. Mr.
Whittenberg stated that this is how he would generally interpret this statement, and he
noted that this presentation was put together to get a feel from the group for what the
future report should include. He said that the only way to know how this concern works
out in the final document is to read the document when it becomes available for review.

Chairperson Voce stated that if the Board feels the document is inadequate, the EQCB
would let the Navy know. Member Hurley stated that he has difficulty completely
understanding these documents, and he reminded the Board that he had provided
corrections to the report done by this same Navy contractor on the water tower, in which
the recommendations made by the archaeologists had been ignored. Mr. Whittenberg
stated that the Board would have to take care when reviewing the final document when
it is received to ensure that these points are addressed.

4. APPROVAL OF MINUTES - September 15, 2004
Recommendation: Approve Minutes subject to any corrections as needed.
Mr. Whittenberg reported that Member Hurley had provided a list of typographical
errors, which would be provided to the Department Secretary.
Member Hurley referred to Page 7, Line 24 and asked Member Barton what a
"specimen plant" is. Member Barton explained that it is a fully-grown plant. Mr.
Whittenberg added that this would be something that would be more than a 15-gallon
tree.
A member of the public asked if the Village at Rossmoor Center was to be discussed at
tonight's meeting. Chairperson Voce responded that this item was discussed two
weeks ago.

Recommendation: Approve Response Letter subject to any corrections
determined appropriate.
Member Hurley referred to Page 7, Line 2 and noted that the word "therefor" should
read "therefore."
MOTION by Hurley; SECOND by Barton to authorize the Chairman to sign the response
letter with any changes the Board deems appropriate and forward to the City Council for
information.

VII Staff Concerns
Mr. Whittenberg distributed a copy of the 2004 CEQA Guidelines to each of the
members.
The Director of Development Services then explained to the gentleman in the audience
that a meeting was conducted on September 15, 2004 and the Board had received
comments on what should be included in the Environmental Impact Report (EIR) for the
Village at Rossmoor Center. He noted that the comment period closed on September
23, 2004. He stated that once the Draft EIR is prepared it is to be distributed for 45
days of public review and comment, and all property owners within 300 feet of the
boundaries of that portion of the shopping center will be mailed notice of the availability
of this document. He noted that it will also be on the City website and at City Hall and
the libraries will each have a copy available for public review. The gentlemen in the
audience stated that everyone in the Rossmoor Townhomes complex would be
impacted by this project, so notice should be mailed to all occupants/owners. Mr.
Whittenberg stated that by law if the residence is not within 300 feet of the project, the
resident would not receive a notice. Chairperson Voce added that the law states that
only those residents within 300 feet will be noticed. He stated that the EQCB would be
reviewing the DEIR to make sure that the law is being followed to the extent possible.
He said that extensive testimony was received from the residents of the Rossmoor
Townhomes who have lots of concerns about the project. The gentlemen requested a
copy of the minutes of the September 15, 2004 EQCB minutes, which was provided to
him.
VIII Board Concerns
Member Barton stated that she would not be present for the October 2004 meeting, as
she will be out of town. Chairperson Voce stated for the record that Member Barton
would be excused from that meeting.
