Minutes of February 16, 2005
Chairperson Voce called the Environmental Quality Control Board (EQCB) meeting of
February 16, 2005 to order at 6:30 p.m. The meeting was held in City Council
Chambers and began with the Salute to the Flag.

Recommendation: Approve Minutes subject to any corrections as needed.
Member Hurley noted corrections to Page 3 of the meeting minutes of January 26,
2005, which were duly recorded by Ms. Teague to be provided to the Department
Secretary for revision of the minutes.

26,2005 as amended.

2. Approval of Comment Letter Re: Draft DEIS - Proposed Site Designation of
the LA-3 Ocean Dredged Material Disposal Site Off Newport Bay, Orange
County, California.
Recommendation: Authorize Chairperson to sign proposed Comment Letter
with any changes deemed appropriate and instruct Staff to forward to the City
Council for review and final approval. Receive and File Staff Report.
Ms. Teague noted that a memorandum providing revisions to the letter has been
provided to the Members tonight. She indicated that the letter includes Mr. Hurley's
comments requesting clarification on contaminant levels for arsenic, chromium,
selenium, as the DE IS document appears to be inconsistent in this regard.
Chairperson Voce stated that he was glad to see that Mr. Hurley had included this
comment, as these are heavy metals of concern. He noted that this entire area has
high levels of naturally occurring arsenic.
Member Hurley referred to Table 3.3-8, on Page 3-81 of the DEIS document and noted
that it clearly shows that Dover Sole is over the allowed limits for these contaminants,
yet the text reads that these levels in the edible portions of the fish tend to be below the
human health advisory limits.
Chairperson Voce noted that these discrepancies need to be addressed, and it is the
responsibility of the EQCB to insist on quality levels.
The Board agreed to Member Hurley's recommendation to change the last sentence of
the first paragraph on Page 2 of the Comment Letter to read:
"The existing site offshore of Newport Beach, known as 'LA-3, , has been
used as an interim ocean disposal site since 1976; the project proposes
the site as permanent. "

Member Hurley then referred to Page 2, Paragraph 3, last sentence, and requested that
the text "to be encountered" be changed to read, "to be met."
MOTION by Hurley; SECOND by Barton to authorize the Chairperson to sign the
Comment Letter as amended, and instruct Staff to forward to City Council for review
and final approval. Receive and File Staff Report.

VI Staff Concerns
Ms. Teague reported that as of today the San Gabriel River EIR is still not available.
She noted that it may become available between now and the next EQCB meeting, the
45-day comment period will allow for adequate time for the Board to review the
document.
Member Voce asked if the Board would be meeting again in February. Ms. Teague
noted that at its last meeting the Board had agreed to cancel the February 2005
meeting and reconvene at the next regularly scheduled meeting of March 30, 2005.
Member Barton reported that she would be absent for that meeting. Chairperson Voce
so ordered to excuse Member Barton from the March 30, 2005 meeting.
VII Board Concerns
Member Barton asked ifthere were a LA-1 disposal site. Ms. Teague stated that there
was no reference to an LA-1 site within the DEIS document. She said that Staff could
report back to the Board. Member Barton also asked whether the Los Angeles
coastline has a similar setup. She inquired about what the schedule is for the large
dumpsters taking dredged material out to the ocean sites. Member O'Malley stated that
he believed it is a year round process, depending upon the project.
VIII Adjournment
Chairperson Voce adjourned the meeting at 6:55 p.m. to the regularly scheduled
meeting of March 30, 2005.
