Minutes of March 30, 2005
Chairperson Voce called the Environmental Quality Control Board (EQCB) meeting of
March 30, 2005 to order at 6:30 p.m. The meeting was held in City Council Chambers
and began with the Salute to the Flag.

Chairperson Voce stated that Member Barton had previously indicated she would not be
in attendance tonight and excused her absence.

Ms. Teague reported that Member Hurley had called in minor corrections to Page 2,
Line 45 to read:

6. Approval of Comment Letter Re: "Draft First Annual Groundwater Monitoring
Report -IR Sites 4,5,6 and 7 - Naval Weapons Station Seal Beach."
Recommendation: Authorize Chairman to sign draft comment letter with any
revisions determined appropriate. Receive and File Staff Report.
Mr. Whittenberg stated that Member Hurley had also provided changes to the second
bullet point on Page 1 of the letter to eliminate the word "that" and have the text read:

7. Public Meeting To Review Document and Provide Board Comments and
Receive Public Comments - Initial Study/Mitigated Negative Declaration 05-2,
Surfside Colony Maintenance Facility and Residential Development
Recommendation: Receive presentation from Staff regarding the proposed
project and the environmental review process. Receive comments from the
public and provide any Board comments regarding proposed Initial
Study/Mitigated Negative Declaration 05-2. Receive and File Staff Report.
Mr. Whittenberg stated that the comment period is still in effect and will run through April
11, 2005. He noted that as of this point in time Staff has received no comments from
any of the parties who received notice of this matter. He said that there have been no
changes to the project since the Mitigated Negative Declaration (MND) was distributed.
He stated that once the comment period is closed, Staff will prepare the response to
comments and this document along with the MND will go to the Planning Commission
and City Council for review as attachments to the General Plan Amendment (GPA),
Zone Change (ZC), and Tentative Tract Map (TTM) request that have generated the
MND. Ultimately a request will be made to City Council to adopt a Resolution approving
the MND and to authorize filing the document with the County Clerk. He noted that
once the MND gets through the City process, it must go to the California Coastal
Commission (CCC) for approval.
Member O'Malley asked what the relationship of the City is to Surfside. Mr.
Whittenberg stated that Surfside has been a part of the City of Seal Beach since the mid
1960's.
Member Hurley referred to Page 43 of the MND under "Construction Noise" and
expressed his concern that the text states that the increase in noise will be "temporary
in nature." He then referred to Page 4, Items c) and d), and noted that a temporary
increase in noise has been categorized as subject to the same significance criteria as a
permanent increase. He stated that both common sense and the data provided in the
MND (Pages 43 - 46) show that during construction there will be a substantial increase
in ambient noise levels in the vicinity, and the impact upon surrounding residents would
be significant. He cited the example of the water tower residents experiencing 85 dBs if

only one piece of equipment is working, and residents less than 100 feet away on the
other side of the project would experience 86 dBA estimated construction noise.
Member Hurley then noted that in earlier discussions of this kind (he referred to the
Boeing Integrated Defense Systems Environmental Impact Report, Page 5.5-5) the
Board had been told that 70 CNEL is the upper limit of noise that is considered
acceptable outside a single-family residence. He stated that this same Boeing
document had stated on Page 5.5-12 that if the existing ambient noise level is greater
than 65 CNEL, a significant impact is assumed to occur if the project increases the
ambient noise level by only 1.0 dBA. He indicated that the Surfside MND explains on
Page 45 that the existing noise environment exceeds 65 CNEL.
Member Hurley stated that noise impacts from construction are going to be significant,
and nothing the City can do will mitigate these noise levels to less than significant. He
recommended that the City tell the truth and withdraw the MND and complete an
Environmental Impact Report (EIR), and use the statement of overriding considerations
in the EIR to find the adverse environmental effects "acceptable." He stated that you
call Mitigation N-1 a mitigation measure, but it is not, as it only provides notice of and
not mitigation of significant noise impacts. He ended by noting that his comments are
designed to help deal with construction noise impacts in another, cleaner manner.
Mr. Whittenberg noted that all comments received from the Board would be responded
to in the response to comments document. He stated that a minimum of 10 days before
the public hearing before the Planning Commission for this project, the response to
comments document would be distributed to all parties that provided comments.
Member Hurley asked if Staff saw any flaws in the comments he had made. Mr.
Whittenberg stated that he would review the referenced pages in the BIDS EIR and
make adjustments to the MND, if necessary.
VI Staff Concerns
Mr. Whittenberg reminded the Board members of the adjourned meeting of April 13,
2005, and asked that they contact Staff should they have any questions on the San
Gabriel River Master Plan Environmental Impact Report (EIR) comment materials.
VII Board Concerns
