Roll Call Present: Chairperson Voce, Members Barton, Hurley, O'Malley, and Vineyard Absent: None Also Present: Department of Development Services Lee Whittenberg, Director Christy Teague, Senior Planner II Approval of Agenda MOTION by O'Malley; SECOND by Hurley to approve the Agenda as presented. Receive and File "Seal Beach Naval Weapons Station - Installation Restoration Program - Status Report Re: RAB Project Update," Dated February 23, 2005. 3. Receive and File "Leisure World Window Replacement Program RFP - Boeing Integrated Defense Systems Specific Plan - EIR Mitigation Measure Implementation," Dated March 16, 2005. 4. MOTION by O'Malley; SECOND by Barton to approve the Consent Calendar as presented. Approval of Comment Letter Re: "San Gabriel River Corridor Master Plan Draft Program EIR." Recommendation: Authorize Chairman to sign proposed Comment Letter, and instruct staff to forward to the City Council for review and approval. Receive and File Staff Report. Mr. Whittenberg reported that the Planning Commission reviewed this document at its meeting of April 6, 2005, and did not formally request any amendments to the letter, but did request that emphasis be placed on the issue of Best Management Practice being utilized for trash issues along the river. He indicated that Staff would include an additional paragraph to reinforce this request. He noted that the City has received two grants from the San Gabriel River and Mountains Conservancy for completion of projects along the river. He stated that when plans for these projects are finalized the EQCB would review any related environmental documents. He reported that one of the projects is a physical improvement plan to the San Gabriel River Bike Trail from Pacific Coast Highway (PCH) down to the beach. He stated that there would also be a general planning project to complete an evaluation of the open space areas in town and attempt to incorporate these projects with some of the work to be done along the river. The Director of Development Services then stated that the comment letter basically focuses on some minor revisions to the Mitigation Measure language related to water quality requirements. Mr. Whittenberg stated that there has never been concrete on the riverbed and it has been left as a natural river bottom. Member Barton then asked who bears the cost of this project? Mr. Whittenberg indicated that the County of Los Angeles Department of Public Works prepared the Master Plan and the Environmental Impact Report (EIR). He noted that the cost for any proposed improvement projects along the river would be borne by the agency proposing the project. Member Hurley asked if approval of the Master Plan is to occur in conjunction with approval of the EIR. Mr. Whittenberg confirmed that this was correct. Member Hurley then asked which agency would be giving final approval on this plan. Mr. Whittenberg stated that the document has no binding authority, but is simply a plan document setting standards in an effort to coordinate any open space projects proposed along the river corridor by any of the cities through which the river runs. Member O'Malley commented that he wonders whether this Master Plan is a beginning to creating another Coastal Commission. Mr. Whittenberg stated that the organization adopting the plan does not have any permit review authority over local jurisdictions. He noted that any projects within the Coastal Zone would still require Coastal Commission approval. Member Hurley complimented Staff on the work done on the comment letter and provided some minor corrections, which were noted by the Director of Development Services. Chairperson Voce commented that it is important to mention the Regional Water Quality Control Boards (RWQCB) for Los Angeles and Orange Counties since Seal Beach is on the receiving end of the water quality of the San Gabriel River. He noted that the City does what it can, but it can't do everything. MOTION by O'Malley; SECOND by Hurley to authorize Chairperson to sign the Comment Letter as revised, and instruct staff to forward to the City Council for review and approval. Receive and File Staff Report. MOTION CARRIED: AYES: NOES: ABSENT: 5-0 Voce, Barton, Hurley, O'Malley, and Vineyard None None VI Staff Concerns Mr. Whittenberg related that the City Manager had indicated at the last City Council meeting that in the months of January-February-March 2005 the City had removed from the beach 548 tons of debris that had come down the San Gabriel River. City of Seal Beach Environmental Quality Control Board Minutes of Adjourned Meeting of April 13, 2005 The Director of Development Services then reported that the model homes at Heron Pointe are now open. He noted that the first phase of 14 homes sold out in 15 minutes at a price between $1.3 and $1.5 million. He indicated that the archaeology fieldwork at this site should be completed by the end of April. Member Hurley inquired about the Hellman Ranch Tank Replacement Project. Mr. Whittenberg reported that City Council had approved the Negative Declaration (ND) on April 11 , 2005, and the document will now go before the California Coastal Commission. VII Board Concerns Member Barton asked why Heron Pointe is to be a gated community. Mr. Whittenberg stated that it is closed to vehicles, but pedestrians and bicyclists can go through on the pedestrian path. Member Hurley inquired about the Boeing Project. Mr. Whittenberg reported that these plans are still under review so the actual work will not begin until June or July.
