Roll Call Present: Chairperson Voce, Members Barton, Hurley, and Vineyard Also Present: Department of Development Services Lee Whittenberg, Director Absent: Member Neal, Mr. Whittenberg stated that he had received a telephone message from Member Neal stating that she would not be present at tonight's meeting and requesting that she be excused. MOTION by Hurley; SECOND by Barton to excuse Member Neal from the Environmental Quality Control Board meeting of November 30, 2005. Receive and File - City Of Seal Beach Comments Re: Draft Initial Study/Mitigated Negative Declaration - U.S. Army Corps Regional General Permit 67, Opportunistic Beach Nourishment, Southern California. 2. Receive and File - City Comment Letter Re: 2005 Draft Diesel Particulate Matter Exposure Assessment Study For The Ports Of Los Angeles And Long Beach. APPROVAL OF MINUTES - November 2, 2005. Recommendation: Approve Minutes subject to any corrections determined appropriate. Member Barton noted a correction to Page 6, Line 26, and to Page 7 Lines 35, 38 and 43, to read Member Barton rather than Member Neal. Member Hurley noted a revision to Page 4, Lines 23 and 24, to read: "Phrase should be replaced with one containing objective quantities of time." Line 26 to read: Should add after the word "ordinance," "Zone 1 Standard of 55dBA." Line 36 to read "100 feet" and Line 37 to read "50 feet." Approval Of Comment Letter - Draft EIS/EIR - Long Beach LNG Import Project (SCH No. 200~091130). Recommendation: Instruct Chairman to sign proposed Comment Letter, and instruct Staff to forward to the City Council for information purposes. Receive and File Staff Report. Mr. Whittenberg stated that a memorandum was provided to the Board Members with slight revisions to Page 2 of the proposed comment letter, which is the same comment used for the Long Beach Airport Terminal Project stating that both projects need to review the other as part of the cumulative impact analysis for each project because neither one recognizes that the other is circulating and under consideration at the same time. Chairperson Voce referred to Page 3, last bullet, and asked for a definition of "Hotelling." Mr. Whittenberg explained that hotelling is a term used in port operations when a ship is tied to the dock and is idling and running its on-ship engines to power electrical systems and other power systems in the ship. He indicated that this generates a high level of emissions as all of the ship engines use diesel fuel, and noted ttiat the California Air Resources Board (CARB) has proposed new regulations that over time would require that ships coming into the Los Angeles or Long Beach Harbors must be equipped to plug into electrical generating stations on the dock facilities in order to draw up electrical power. He noted that there are issues between the CARB and the South Coast Air Quality Management District (AQMD) over who has the authority to impose these regulations. Chairperson Voce commented that eventually the question would arise as to how much the law can do to protect citizens from this type of pollution and he believes this letter is a good beginning in terms of the City's response to this problem. He noted that any shift in the winds would expose the City of Seal Beach to more of this particulate matter, since the Port of Long Beach lies just west of Seal Beach. Member Hurley provided several corrections to grammar and punctuation, which were noted by Mr. Whittenberg for revision to the comment letter. Mr. Hurley then referred to Page 15 of the Staff Report, Section 4.1, 1 st Paragraph and stated that the information is insufficient, as it does not provide the estimated dates of the most recent earthquakes. Mr. Whittenberg suggested adding the following text to the end of Paragraph 3 under Section 4.1 : "We are also requesting information on the estimated last occurrences of earthquakes on the Palos Verdes and Thumbs-HB Fault Systems. " Member Hurley stated that he was unable to locate Figure 4.1.4-1 and noted that this might be the Newport-Inglewood fault. Approval Of Comment Letter Re: Draft Environmental Impact Report 37-03 - Long Beach Airport Terminal Improvement Project (SCH No. 200309112)) Recommendation: Authorize approval of letter with any modifications determined appropriate, instruct Chairman to sign proposed Response Letter, with any revisions determined appropriate and forward to the City Council for final review and signature by the Mayor. Receive and File Staff Report. Mr. Whittenberg stated that after any changes made by the Board, this document will be reviewed by City Council on December 12, 2005, at which time they may make further changes and approve the letter for the mayor and Board Chairperson's signatures. He indicated that in looking at the project, it appears to have minimal direct impacts to Seal Beach, and noted that the main issue upon which the letter focuses is the ongoing flight operations over the air space above Leisure World. Member Hurley again provided corrections to grammar and punctuation errors, which Mr. Whittenberg noted for revision to the comment letter. Member Hurley then referred to Page 9, Paragraph 5, Line 6, and questioned the use of the text, "approach patterns are not be rigorously monitored. . ." After receiving suggestions from Chairperson Voce, Mr. Whittenberg suggested that the following: "There is concern that the enforcement of the existing flight approach patterns are not monitored and enforced rigorously enough by the Airport." Member Hurley then referred to the last sentence in this paragraph and recommended that the sentence read: "... airport responses have not been timely nor have adequately addressed concerns, . . ." Member Hurley referred to the 2nd line at the top of Page 1 0 and suggested that it be revised to read: "... deviations for the flight patterns, . . ." He then referred to the 2nd paragraph on Page 1 0, Line 8 and proposed a change to this sentence. Mr. Whittenberg suggested the following text: "... flight deviations on the noise environment in Seal Beach, and particularly within the Leisure World retirement community. " Member Vineyard asked if City Council would receive the same copy of the Staff Report as the EQCB. Mr. Whittenberg stated that the Staff Report would be fairly similar and the letter will be presented to City Council as it has been revised here tonight. MOTION by Hurley; SECOND by Vineyard to have Chairman sign the comment letter as amended, and instruct Staff to forward to the City Council for final review and signature by the Mayor. Receive and File Staff Report. MOTION CARRIED: AYES: NOES: ABSENT: 4-0-1 Voce, Barton, Hurley, and Vineyard None Neal VI Staff Concerns Mr. Whittenberg wished the Board members a Happy Holiday Season and stated that he anticipates there will be no meeting held on December 28, 2005. Mr. Hurley stated that he may be traveling during the end of December, and he would like to receive notice of a cancelled meeting as soon as possible. VII Board Concerns Member Hurley stated that he had misplaced his CEQA Guidelines Book. Mr. Whittenberg reported that a replacement copy has been ordered. VIII Adjournment Chairperson Voce adjourned the meeting at 7:15 p.m. to the next scheduled meeting as notified by Staff.
