The meeting was held in City Council Chamber. Roll Call Present: Chairperson Voce, Members Barton and Vineyard Also Present: Department of Development Services Lee Whittenberg, Director Christy Teague, Senior Planner Absent: Members Hurley and Neal For the record, Chairperson Voce noted that Member Hurley's absence is excused, as he had previously notified the Board that he would be out of town. II Approval of Agenda MOTION by Vineyard; SECOND by Barton to approve the Agenda as presented. Receive And File - City Comment Letter Re: Naval Weapons Station Sites 42, 44/45, And SWMU 57 - Draft Non-Time Critical Removal Action Work Plan, Dated January 25, 2006. 2. Receive And File - City Council Memorandum Re: Coastal Conservancy Approves Participation In Los Cerritos Wetlands Joint Powers Authority, Dated February 3, 2006. 3. Receive And File - City Comment Letter To Orange County Transportation Authority Re: Draft Program EIR - 2006 Long Range Transportation Plan, Dated February 13, 2006. 4. Receive And File - Memorandum Re: Rossmoor Center Reconstruction Project, Provision Of Media Materials and Anticipated City Processing of Development Plans Letter, Dated February 13, 2006. 5. APPROVAL OF MINUTES - January 25,2006. Recommendation: Approve Minutes subject to any corrections determined appropriate. Chairperson Voce recommended that since two members are not present tonight, review of the minutes of January 25, 2006 be continued to the next scheduled EQCB meeting. MOTION by Vineyard; SECOND by Barton to continue Item 6 to the next scheduled meeting of the Environmental Quality Control Board. Approval of City Response Letter Re: Draft 2005 Second Semiannual Post- Closure Inspection and Maintenance Report, Installation Restoration Program Site 7 (Station Landfill), Naval Weapons Station. Recommendation: Authorize the Chairman to sign the draft response letter, with any additional comments determined appropriate, and instruct staff to forward to the City Council for information purposes. Receive and File Staff Report. Mr. Whittenberg noted that the Board members were provided with excerpts from this report. He explained that the initial report indicated that there has been much surface erosion due to the heavy rain storms from 2005, and as part of the rehabilitation work at Site 7, the Naval Weapons Station (NWS) will have to replace the topsoil in certain areas and re-vegetate the site. He indicated that this report is a follow up explaining how this work was completed and the present status of Site 7. He stated that Staff has no major issues and the response letter basically concurs with the NWS findings as set forth in the report. MOTION by Vineyard; SECOND by Barton to authorize Chairman to sign the response letter, with no additional revisions, and instruct staff to forward to the City Council for information purposes. Approval of City Response Letter Re: Draft First Semiannual Performance Monitoring Report, Installation Restoration Program Site 40, Naval Weapons Station. Recommendation: Authorize the Chairman to sign the draft response letter, with any additional comments determined appropriate, and instruct staff to forward to the City Council for information purposes. Receive and File Staff Report. Mr. Whittenberg stated that again, excerpts from the report have been provided to the Board members, which basically describes bioremediation activities taking place at Site 40. MOTION CARRIED: AYES: NOES: ABSENT: 3-0-2 Voce, Barton, and Vineyard None Hurley and Neal VI Staff Concerns Mr. Whittenberg recommended that Chairperson Voce adjourn this meeting to March 15, 2006, rather than to the regular meeting of March 29th, as Staff has prepared a Draft Mitigated Negative Declaration (DMND) for a project at 400 Marina Drive with a comment period closing date of March 27, 2006. He stated that this would allow the EQCB to provide their comments on the DMND at the March 15, 2006 meeting. VII Board Concerns Chairperson Voce encouraged the public to vote at the upcoming election. Mr. Whittenberg reported that at the City Council meeting of Monday, February 27, 2006, the Orange County Transportation Authority (OCT A) provided a presentation on the extension of Measure M, the countywide gas tax for public road and transportation improvements. He indicated that a copy of this presentation will be provided to the Planning Commission at its next meeting, and Staff also provided copies for the EQCB members. He noted that City Council did take formal action in support of the extension of Measure M. VIII Adjournment Chairperson Voce adjourned the meeting at 6:43 p.m. to the adjourned meeting of March 15, 2006.
