Roll Call Present: Chairperson Voce, Members Barton, Hurley, and Vineyard Also Present: Department of Development Services Christy Teague, Senior Planner Absent: Member Neal Lee Whittenberg, Director II Approval of Agenda MOTION by Hurley; SECOND by Barton to approve the Agenda as presented. Receive and File - Memorandum Re: Los Cerritos Wetlands (Bryant Property) - Proposed Acquisition By Coastal Conservancy, Dated April 25, 2006. 2. APPROVAL OF MINUTES - April 26, 2006. Recommendation: Approve Minutes subject to any corrections determined appropriate. MOTION by Hurley; SECOND by Barton to approve the Meeting Minutes of April 26, 2006 as presented. MOTION CARRIED: AYES: NOES: ABSENT: 4-0-1 Voce, Barton, Hurley, and Vineyard None Neal 2of4 .~ 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 .23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 .45 City of Seal Beach Environmental Quality Control Board Meeting Minutes of May 24, 2006 VI Staff Concerns Ms. Teague indicated that a copy of the Draft Mitigated Negative Declaration (MND) for Naval Weapons Station IR Site 70 has been provided to the Members tonight for information purposes only. She noted that the 30-day comment period will end on June 24,2006, and the next scheduled EQCB meeting is June 28,2006. She said that Staff has requested additional time to review the document and provide comments, but, should this request not be granted, Staff may convene the EQCB on June 14, 2006 in order to allow for comments. Ms. Teague then stated that Staff expects to have a copy of the San Gabriel Master Plan Final Environmental Impact Report (FEIR) available for distribution at the June 28th meeting. She noted that it might be available for a June 14th meeting. The Senior Planner then reported that Staff is monitoring the preparation of a Mitigated Negative Declaration (MND) for the Accurate Metal property. She stated that an application is pending for conversion of the zoning of this property to residential, and the MND may be available for the June 28th meeting. VII Board Concerns Member Barton noted that a "For Rent" sign is still posted at 400 Marina Drive. She asked if this was permissible, since the property is being sold. Ms. Teague stated that she would inquire about this. Member Hurley requested an update on the Bryant Property acquisition. Ms. Teague stated that she did not know, but would follow up and provide an update at the next EQCB meeting. Member Hurley then requested that an update be provided on the Hellman Ranch wetlands area. Chairperson Voce stated that a Joint Powers Agreement has been signed to appoint a Joint Powers Authority, and all interested parties have agreed to work together on this. Member Hurley expressed his concern regarding the implementation of the City's construction noise policy. He asked how the Board is to know whether this policy is being enforced? Ms. Teague stated that this policy strengthens the ability for the Code Enforcement Officer to follow up on complaints about construction noise. She indicated that she would inquire of the Code Enforcement Officer and Building Officials regarding the number of complaints received and how they were addressed. Member Hurley noted that developers/contractors should be provided with a copy of the newly adopted construction noise policy so that they will know what is required. City of Seal Beach Environmental Quality Control Board Meeting Minutes of May 24, 2006 Member Hurley noted that the Board was promised an overview of upcoming EQCB agenda items, and this was not included with tonight's agenda. He requested that this be provided at the next meeting. Ms. Teague explained that both she and Lee Whittenberg had taken vacation time, which limited the time available to complete and provide reports on these items, but an update would be provided at the next meeting. Member Hurley then noted that the subject of leaf blowers was also supposed to be on tonight's agenda and requested that it be included on the next meeting agenda. VIII Adjournment Chairperson Voce adjourned the meeting at 7:02 p.m. to the next adjourned meeting of June 14, 2006, in City Council Chambers.
