Agencymember Hastings again posed a question as to whether there are one hundred twenty- six or one hundred twenty-five spaces in the Trailer Park, and requested that the Project Area committee be reactivated to investigate and resolve the questions that have been brought forth. The Development Services Director said he hoped to have a report to the Agency at the next meeting addressing the current membership of the PAC, the terms, current duties imposed by the Agency, along with a review of the approval process for the Trailer Park, which was an Unclassified Use Permit rather than a Conditional Use Permit, as well as a review of the agreements and covenants between the Agency and the Park management. He explained that the PAC was meant to assist the Agency with housing related matters that are within the Redevelopment Project Area. Mr. Gordon Shanks, 215 Surf Place, mentioned AB 315 which he said would call for either forty or fifty percent low and moderate income housing set-aside. There being no further comments, Chairman Forsythe declared Oral Communications closed. ROLL CALL Present: Chairman Forsythe Agencymembers Hastings, Hunt, Laszlo, Wilson Absent: None I Also present: Mr. Archibold, Acting Executive Director Mr. Barrow, Assistant City Attorney Mrs. Yeo, Secretary WAIVER OF FULL READING Wilson moved, second by Laszlo, to waive the reading in full of all resolutions and that consent to the waiver of reading shall be deemed to be given by all Agencymembers after reading of the title unless specific request is made at that time for the reading of such resolution. 3-25-91 AYES: NOES: Forsythe, Hastings, Hunt, Laszlo, Wilson None Motion carried ASSEMBLY BILL 315 - HOUSING SET-ASIDES The Acting Executive Director summarized the staff report from the Development Services Director regarding AB 315, proposed legislation to increase from twenty percent to . I forty percent the production of housing units affordable to those of low and very-low income through redevelopment agency funding. He stated by January 1, 1992 AB 315 would require all redevelopment agencies to allocate not less than fifty percent of their annual tax increment revenue to increase, improve, or preserve the supply of low/moderate income housing, with only one category of exception for those agencies in cities where the regional fair share of affordable housing allocation has already been met and in those cases the set-aside would be forty rather than fifty percent. He said AB 315 would affect all existing project areas and project areas adopted after the effective date of the Bill, and further, repeals entirely the current law findings that allows an agency to set-aside less than twenty percent for housing under certain circumstances, AB 315 would disrupt current redevelopment activities and obligations and the increase would create cash flow shortages that would delay or negatively impact desirable proj. ects . Wilson moved, second by Hastings, to authorize the Chairman of the Redevelopment Agency to sign the proposed letter to the Chairman of the Assembly Housing and Community Development Committee opposing AB 315 (Friedman). Chairman Forsythe asked if the fifty percent applies to those cities I currently not meeting their set-aside, and if the City would be contesting the 1992 unit requirements based upon land value and resources. The Acting Executive Director replied in the affirmative, yet for cities that have satisfactorily met their set-aside requirements the forty percent set-aside would apply, and Seal Beach would fall under the fifty percent requirement. The Assistant city Attorney explained that until 1986 there was no requirement for a twenty percent set-aside for projects formed before 1977, the law then changed where the set-aside did not apply if an agency could make certain findings, as has been done in Seal Beach, determining that the funds were necessary to fulfill agency obligations, therefore there are no monies in the Riverfront project set-aside, however money was set-aside for the Surfside project which was formed after 1977, and confirmed there was no set-aside required of the Zoeter site. Agencymember Hunt noted the statement that Seal Beach would be required to set-aside fifty percent, and questioned if that determination had been made with certainty or if it is arguable. The Acting Executive Director stated it is arguable however the principal is that those agencies that have met their regional fair share affordable housing requirement would be subject to the forty percent. Agencymember Hunt asked if the six thousand units in Leisure I World could be determined lower income units given the sale prices and income levels, and be taken into consideration. Brief discussion followed. Vote on the motion to authorize the Chairman to sign the letter in opposition to AB 315: AYES: NOES: Forsythe, Hastings, Hunt, Laszlo, Wilson None Motion carried 3-25-91/4-22-91 1- TAX INCREMENT REVENUES - 1971 - 1990 The Acting Executive Director stated the March 25th memorandum from the Director of Development Services provides a summary of tax increment revenues collected by the Riverfront Redevelopment Project Area from 1971 to 1990 as an information item for the Agency and recommended that the report be received and filed. Members of the Agency spoke briefly of their analysis of the revenues, percentage increases, and question was raised as to what caused certain increases or decreases for a fiscal year, with specific reference to 1973, 1975, 1977 and 1978, as well as the overall increase during the period of the Project Area. It was the consensus of the Agency to receive and file the report. ORAL COMMUNICATIONS There were no Oral Communications.
