TAX INCREMENT REVENUES - 1971 - 1990
The Acting Executive Director stated the March 25th
memorandum from the Director of Development Services
provides a summary of tax increment revenues collected by
the Riverfront Redevelopment Project Area from 1971 to 1990
as an information item for the Agency and recommended that
the report be received and filed. Members of the Agency
spoke briefly of their analysis of the revenues, percentage
increases, and question was raised as to what caused certain
increases or decreases for a fiscal year, with specific
reference to 1973, 1975, 1977 and 1978, as well as the
overall increase during the period of the Project Area. It
was the consensus of the Agency to receive and file the
report.

It was the order of the Chair, with consent of the Agency,
to adjourn the meeting at 7:10 p.m.

The Redevelopment Agency of the City of Seal Beach met in
regular session at 6:47 p.m. with Chairman Forsythe calling
the meeting to order with the Salute to the Flag.

STATUS REPORT - AGENCY REOUESTS
The Development Services Director presented an update
regarding requests of the Agency relating to: 1) history of
approval process for the Trailer Park and summary of the

conditions of approval; 2) reformation of the Project Area
Committee for Trailer Park audit purposes; 3) ability of
City or Agency to require the preparation of a recorded
lease-line site survey of the Trailer Park; and 4)
advantages/ disadvantages of the Department of Water and
Power property remaining in the Riverfront Redevelopment
Agency Project Area. The Director stated it is presently
an~icipated that r~ports on the first two issues may be
presented to the Agency by the next meeting. It was the
consensus of the Agency to receive and file the report.

ORAL COMMUNICATIONS
Chairman Forsythe declared Oral Communications open. Mr.
Gordon Shanks, 215 Surf Place, referred to a recent
financial analysis prepared by a Mr. Corin in which it was
stated that twenty percent of the tax increment to the
Agency must be held in a separate fund for low income
housing, and inquired if there is a penalty for not doing so
and if 1988 legislation requires that those funds be used
within a specific period of time or they will revert to the
County for low/moderate income housing use. The Assistant
City Attorney responded that he was not certain of the
penalty for noncompliance with the twenty percent set aside,
and it seems plausible that those monies could revert to the
County for such programs. He explained that the twenty
percent set aside has a number of technical exceptions and
it was his understanding that this Redevelopment Agency has
not been obliged to meet the twenty percent because it has
been able to make certain findings that more than eighty
percent of its monies have been necessary to service the
existing bonded indebtedness of the Agency. He offered his
opinion that the law is becoming increasingly strict and
over time the Agency may find it necessary to devote larger
sums of money to low income housing projects than it has
been required to do in the past, and noted some cities have
transferred their set aside monies to other cities for such
projects, which was felt to be an effective means of meeting
the affordable housing requirements. Mr. Colantuono offered
to review the State statute regarding the twenty percent set
aside for the Agency. Chairman Forsythe requested a copy of
the statute. Members of the Agency noted that the courts
are now looking at whether it is appropriate for one city to
transfer their set aside to another city, the contention
being that such action could increase the percentage of
affordable housing, another issue being the impact of one

community on the infrastructure of another in developing
such projects. There being no further comments, Chairman
Forsythe declared Oral Communications closed.
