SUBJECT: Agreement to Accept Federal Surplus Property
Through the Federal 1033 Program.
SUMMARY OF REQUEST:
The proposed City Council action will adopt a resolution allowing the City of Seal
Beach to enter into an agreement to accept a surplus military boat and
equipment. The City Manager will be authorized to execute on behalf of the City
of Seal Beach any actions necessary for the purpose of obtaining a surplus
military boat and equipment through the Federal 1033 program.
BACKGROUND:
1033 Program Overview: The National Defense Authorization Act authorizes
the Secretary of Defense to transfer excess Department of Defense (DoD)
personal property to federal, state, and local Law Enforcement Agencies (LEA)
with special emphasis given to counter drug and counter terrorism. The 1033
program allows LEAs to receive DoD excess property.
Seal Beach became a member of the West County Special Weapons and
Tactical (SWAT) team in 2007. When Seal Beach joined West County SWAT, a
special unit within the team, known as the water borne element, was created to
provide special equipment and training to a select few SWAT team members to
be able to work in a harbor and ocean environment. The team currently does not
have a boat and relies on mutual aid from the Orange County Sheriff or
Lifeguards. Currently available through the 1033 program is an approximate 22
foot Zodiac with dual outboard motors. This type of boat will be extremely
beneficial as an asset to the West County SWAT water borne element.
The City of Cypress will accept the boat through the federal 1033 program on
behalf of West County SWAT.

FINANCIAL IMPACT:
The City of Seal Beach funds its participation in West County SWAT using
Supplemental Law Enforcement Services Fund ( SLESF) monies. Any equipment
purchases, maintenance, or training will be funded using SLESF monies. No
general fund monies will be used. As this boat and equipment is surplus property,
the exact cost cannot be determined until the city of Cypress takes possession. If
the cost to equip and maintain the boat is determined to be prohibitive, the
property can be sent to auction or donated to another entity after one year.
RECOMMENDATION:
It is recommended that the City Council adopt Resolution No. 5996 authorizing
the City Manager to execute on behalf of the City of Seal Beach any actions
necessary to receive a surplus boat and equipment through the Federal 1033
program.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL
BEACH APPROVING THE ACCEPTENCE OF A SURPLUS
MILITARY PROPERTY THROUGH THE FEDERAL 1033 PROGRAM
WHEREAS, the City of Seal Beach is eligible to receive surplus property through
the Federal 1033 program and
WHEREAS, the City of Cypress will serve as the applicant on behalf of the City of
Seal Beach as a West County Special Weapons and Tactics team member.
THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE
AS FOLLOWS:
SECTION 1. The City Manager is hereby authorized to execute for and on behalf of
the City of Seal Beach, a public entity established under the laws of the State of
California, any actions necessary to obtain federal surplus property through the
Federal 1033 program.
SECTION 2. The City Clerk shall certify as to the adoption of this Resolution.

meeting hereof held on the 26h day of April , 2010 by the following vote:
