Call to Order The meeting of the Archaeological Advisory Committee (AAC) was called to order at 4:40 p.m. on Tuesday, November 28,2000. The meeting was held in the City Council Chambers.! II. Roll Call Present: Absent: Members Basch, Fitzpatrick, and Vesely Chairperson Willey and Member Eigenbrood Also Present: Department of Development Services Lee Whittenberg, Director Mr. Whittenberg noted that he had not heard from either Chairperson Willey or Member Eigenbrood, and thus assumed that they were en route to the meeting. III. Approval of Agenda SO ORDERED by Acting Chairperson Vesely to approve the Agenda as presented. Member Fitzpatrick stated that he would abstain from voting on this item as he had been absent from the meeting of November 8,2000. REVIEW OF DRAFT INITIAL STUDY/MITIGATED NEGATIVE DECLARATION 00-1 - PACIFIC GATEWAY BUSINESS CENTER - PARCEL MAP 2000-134 Recommendation: Review Draft Initial StudylMitigated Negative Declaration 00-1 for Parcel Map 2000-134 (the Pacific Gateway Business Center project), receive a presentation from City Staff, receive public comments and provide Committee comments to staff regarding the adequacy of the Cultural Resources portion of the subject Draft Mitigated Declaration Mr. Whittenberg provided a brief overview of the areas to be subdivided by the proposed parcel map submitted to the City by Boeing. He stated that this area was part of the existing campus facility acquired from Rockwell a number of years ago. He said that the property is proposed to be subdivided for future sale for land uses consistent with the City's existing General Plan and Land Use designations for light industrial development. He reported that no zone changes were necessary and that there are no General Plan amendments required. Mr. Whittenberg noted that as part of the review process for the parcel map the City has completed an environmental analysis, and has determined that a full environmental impact report will not be necessary, and that the Draft Mitigated Negative Declaration is the appropriate document for the City to consider. He said the reason for this was that Staff has determined that any potential environmental impacts by the proposed subdivision of the property can be mitigated to a level of less than significant level in accordance with the provisions of the California Environmental Quality Act (CEQA). He explained the processes involved in using the Mitigated Negative Declaration as opposed to an Environmental Impact Report. He stated that the Archaeological Advisory Committee (AAC) is being asked to review this project because there are a number of areas on this property that have been identified as potential archaeological sites. He said that once the comment period ends, all comments would be compiled in a response to comments document that is forwarded to the Planning Commission along with the Draft Mitigated Negative Declaration when they consider approval of the actual subdivision plans for the property. Mr. Whittenberg stated that in reviewing the Mitigated Negative Declaration the AAC would determine whether the impacts described and the proposed mitigation measures are adequate to deal with the land subdivision of the property. He directed the Committee to focus on Section 3.5 of the MND, which discusses Cultural Resources. He reported that both an archaeologist and a Native American monitor would be on site during any work on the property. He stated that once the work is completed, the archaeologist would prepare a report for the City describing what the significance of any of the areas on the property mayor may not be. He said that this document would also come before the AAC for review and also for final approval by the City Council. Member Vesely asked how the Native American monitor would be selected. He said that KEA Environmental has completed work on several sites at the Naval Weapons Station with a Native American monitor who is very familiar with the archaeological setting of the area. He explained that monitors must be certified by the Native American Heritage Commission and must be a representative of the tribal group that this area represents. Member Vesely questioned the area on the property not designated for archeological survey. Mr. Whittenberg responded that this area had previously been surveyed and tested and is currently paved over. He noted that he had not included this previous report as part of the MND as the archaeological investigations are not required on paved areas or already developed land, as any potential archaeological sites would already have been disturbed. Member Fitzpatrick asked about how Native American monitor was appointed. Mr. Whittenberg explained that prospective monitors must submit a resume, which is presented to the Nave American Heritage Commission to determine whether there have been any complaints regarding the quality of the work performed by the monitor. He said that normally Staff would attempt to make a contact with the tribal leader to verify that the applicant monitor is in good standing with the tribe. The Director of Development Services recommended that if members of the AAC had any comments to add that they forward these comments to the Director of Development Services before December 6, 2000. Mr. Whittenberg reported that the Environmental Quality Control Board (EQCB) would be meeting tomorrow night at 6:30 to review the entire document and AAC members were welcome to attend. VII. Committee Concerns . None. . VIII. Staff Concerns Mr. Whittenberg reported that the Hellman Ranch was in the process of getting permit approvals from the Coastal Commission to begin the archaeology work. He said that field investigation work was scheduled to begin by January 8, 2001. He stated that once approval from the Coastal Commission is received, Staff would authorize KEA Environmental to begin the field investigation work. The Director of Development Services stated that he did not project that another special meeting of the AAC would be required before January 2001. He wished the members a happy holiday season.
