ROLL CALL Present: Chairman Campbell Agencymembers Brown, Forsythe, Fulton, Hastings Absent: None Also present: Mr. Till, Executive Director Mr. Barrow, City Attorney Mrs. Yeo, City Clerk/Secretary APPROVAL OF AGENDA Fulton moved, second by Campbell, to approve the order of the agenda as presented. AYES: NOES: Brown, Campbell, Forsythe, Fulton, Hastings None Motion carried WAIVER OF FULL READING Brown moved, second by Fulton, to waive the reading in full of all resolutions and that consent to the waiver of reading shall be deemed to be given by all Agencymembers unless specific request is made at that time for the reading of such resolution. AYES: NOES: Brown, Campbell, Forsythe, Fulton, Hastings None Motion carried ORAL COMMUNICATIONS There were no Oral Communications. REVIEW - TRAILER PARK COMPLIANCE Agencymember Hastings noted her demand at the last meeting that a survey of the Trailer Park be conducted by a certified surveyor to assure compliance of the space sizes, distance between the spaces, and number of spaces, and requested that that task be included with the review of trailer park compliance matters. Agencymember Forsythe said she believed the initial intent was to first do an audit, with the participation of Agencymember Brown, to determine if the Park is in compliance with the low and moderate housing requirement, then by motion of the Agency direct that a survey of the Park be done with the contingency that the Park management be'financially responsible for the survey. Agencymember Hastings recognized the importance of the low and moderate rent compliance however cited a survey as equally important, it was her understanding the survey was to have been on the agenda, and although the cost of the survey will be borne by the Park management, the Agency has a 9-8-97 responsibility to assure compliance. The Executive Director responded that it was the intent to ask for a survey as part of the review process, confirmed that the record reflects that in the early 1990's the Park owner had agreed to do a survey yet it was never done, however mentioned that at the time building permits are requested for an addition or remodel the lot lines are required to be reviewed for compliance with the 1981 approved map, however concurred that a survey of the entire Park would be preferable. Forsythe moved, second by Hastings, to direct staff to conduct a review of low and moderate income eligibility and rent control standards, that Agencymember Brown be designated to participate in that review, and that a survey be conducted of the entire Trailer Park, the cost of which is to be borne by the Park. Councilmember Campbell offered her assistance with the audit. I AYES: NOES: Brown, Campbell, Forsythe, Fulton, Hastings None Motion carried PROFESSIONAL SERVICES CONTRACT - AFFORDABLE HOUSING PROGRAM The Executive Director reported this item pertains to the accumulation of $1.3 million set aside required by State law that can be used only for affordable housing programs or projects, affordable currently defined as in the $60,000 annual income range for a family of four or more than $40,000 for an individual. He noted that thus far there has been an inability to develop a program that would meet State mandates for affordable housing while also addressing the interests of the community, and explained that those monies are not required to be spent to develop new housing units therefore the rehabilitation of existing housing within the income categories is a possibility. To a question as to whether the monies could be used anywhere in the City or only in the Redevelopment Agency area, the City Attorney confirmed they could be used citywide, it was confirmed also that it would be the occupant rather than the owner that would be required to qualify within the income category. It was pointed out that a number of persons residing in the Trailer Park would likely qualify. The Director said to develop this program it is necessary to inventory eligible properties, develop program criteria, participant eligibility, evaluation criteria, etc. Agencymember Forsythe cited the requirement that the tenant, rather than the land owner would need to qualify under the income guidelines, therefore through such a program Redevelopment Agency monies could be used to improve a property where in fact the property owner could likely afford to do so. Agencymember Brown said his understanding is that there could be some type of cooperative arrangement, possibly matching funds. The Director concurred, noting that a property owner that is not willing to contribute will likely not maintain the improved dwelling once it is completed. The City Attorney added that of key importance to the State is affordable housing. As to time frames, the Manager said it will likely take about twelve weeks to develop the program, and as to deadlines for expenditure of the funds, the City Attorney stated under AB1290, a Redevelopment Reform Law, the State did establish deadlines I I 9-8-97 / 9-22-97 .1 for agencies, and made reference to the five year implementation plan adopted by this Agency about 1995. To an inquiry as to how a property owner or applicant would be made aware of this program, the Manager offered that some type of marketing program would be needed to identify the specific properties, explain the program, and its obligations. Brown moved, second by Hastings, to authorize the Executive Director to execute a professional services agreement with The City Associates for developing an affordable housing program at a cost not to exceed $20,000.
