Crumby P.E., Director of Public Works SUBJECT: AUTHORIZE THE SUBMITTAL APPLICATION TO THE STATE DEPARTMENT OF RESOURCES RECYCLING AND RECOVERY FOR USED OIL GRANT FUNDS SUMMARY OF REQUEST: Approve Resolution No. 6033 authorizing the City Manager to execute all necessary applications, contracts, payment requests, agreements and amendments for the purposes of securing used oil grant funds. BACKGROUND: The people of the State of California have enacted the California Oil Recycling Enhancement Act that provides funds to cities and counties for establishing and maintaining local used oil collection programs that encourage recycling and appropriate disposal of used oil. The Department of Resources Recycling and Recovery (CalRecycle), formally known as the California Integrated Waste Management Board, offers grants to local governments to implement local used oil collection programs. The Council has authorized applying for this grant in past years, including last year. In order to be eligible for the next cycle of grant funding, the City filed its annual application on June 30, 2010 to the State of California. A final approved resolution is due by July 30, 2010. The application and resolution are attached. The City of Seal Beach has teamed with the City of Cypress on this grant opportunity in the past. Cypress was leading a regional Used Oil program with numerous other cities and declined to continue the program. The City of Seal Beach collected these funds last year and used them on public outreach programs to educate the public regarding used oil recycling. The City desires to do the same this year. Agenda Item W Page 2 FINANCIAL IMPACT: This project is funded through a State Used Oil Program grant with a maximum amount of $5,000, with no City match requirement. RECOMMENDATION: It is recommended City Council approve Resolution No. 6033 authorizing the City Manager to execute all necessary applications, contracts, payment requests, agreements and amendments for the purposes of securing used oil grant funds. Used Oil Grant Application RESOLUTION NUMBER 6033 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, AUTHORIZING THE SUBMITTAL OF A USED OIL PAYMENT PROGRAM APPLICATION TO CALRECYCLE FOR THE PURPOSE OF SECURING USED OIL GRANT FUNDS AND TO IMPLEMENT AND CARRY OUT THE PURPOSES SPECIFIED IN THE GRANT APPLICATION WHEREAS, pursuant to Public Resources Code 48690 the Department of Resources Recycling and Recovery (CalRecycle), formerly known as the California Integrated Waste Management Board, has established the Used Oil Payment Program (OPP) to make payments to qualifying jurisdictions for implementation of their used oil programs; and WHEREAS, in furtherance of this authority CalRecycle is required to establish procedures governing the administration of the Used Oil Payment program; and WHEREAS, CalRecycle's procedures for administering the Used Oil Payment Program require, among other things, an applicant's governing body to declare by resolution certain authorizations related to the administration of the Used Oil Payment Program. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: Section 1. That the City of Seal Beach authorizes the submittal of a Used Oil Payment Program application to CalRecycle. Section 2. That the City Manager is hereby authorized and empowered to execute in the name of the City of Seal Beach all documents, including but not limited to, applications, agreements, annual reports including expenditure reports and amendments necessary to secure said payments to support our Used Oil collection Program. Section 3. That this authorization is effective until rescinded by the City of Seal Beach.
