AGENDA STAFF REPORT DATE: August 9, 2010 TO: Honorable Mayor and City Council THRU: David Carmany, City Manager FROM: Sean P. Crumby P.E., Director of Public Works SUBJECT: APPROVING RELOCATION OF PUBLIC UTILITY EASEMENT AT 811 AVALON DRIVE SUMMARY OF REQUEST: It is requested that the City Council adopt Resolution No. 6044 approving relocation of a Public Utility easement located at 811 Avalon Drive, Seal Beach and authorizing and directing the City Manager to record all necessary documentation with the County of Orange. BACKGROUND: In 1955 Tract Map 1817 was recorded covering portions of the "Hill' within the City of Seal Beach. A six -foot wide "Public Utility" easement was recorded along the northerly and westerly boundary of the tract. This is located on the properties that bordered Gum Grove Park and the Hellman property. This easement included portions on two sides of Lot 6 (811 Avalon Drive). In 1997, Joe Davis (home owner) acquired property adjacent to Lot 6, to expand. The acquired property would allow the original property to be significantly larger in size. At that time a Lot Line Adjustment was filed with the City and recorded with the County. This lot line adjustment is an appropriate action to incorporate the additional property into the existing parcel. This easement was not addressed on the recorded Lot Line Adjustment and the easement remains along the original property boundary. Currently, the homeowner is in the process of obtaining a grading permit for a home teardown and rebuild on this lot. In order to make full use of his enlarged lot, this easement must be relocated to run at the edge of the new property line. The engineer on record (on behalf of the owner) notified the affected utility companies that have rights to the easement. Those companies include Verizon, The Gas Company, Time - Warner, and Southern California Edison (SCE). Three Agenda Item U Page 2 of the companies: Verizon, The Gas Company, and Time - Warner only have rights to this easement through the Public Utility Commission "PUC ". Each of these companies gave a "Non - Interference" letter, allowing the easement to be moved. SCE owns an individual easement on the property. They have agreed to vacate the old easement providing a "quit -claim deed ", that will be sent off to be recorded at the County. Copies of all the documents, including a map in depicting both the old location and the proposed location of the easement, are attached. FINANCIAL IMPACT: There will be no fiscal impact to the City. RECOMMENDATION: It is recommended that the City Council adopt Resolution No. 6044 approving relocation of Public Utility easement at 811 Avalon Drive and authorizing and directing the City Manager to record all necessary documentation with the County of Orange. The Council hereby approves the relocation of that certain public utility easement generally located at 811 Avalon in the City of Seal Beach and authorizes recordation of a new easement along the property line. The locations of the old and new easements are described in more particularity in the attached exhibit A. Section 2. The Council hereby authorizes and directs the City Manager to record all necessary documentation with the County of Orange.
