Minutes of August 30, 2006
Chairperson Voce called the Environmental Quality Control Board (EQCB) meeting to
order at 6:30 p.m. on Wednesday, August 30, 2006. The meeting was held in City
Council Chambers and began with the Salute to the Flag.

1. APPROVAL OF MINUTES - July 26,2006.
Recommendation: Approve Minutes subject to any corrections determined
appropriate.
Chairperson Voce noted that he was not in attendance at the meeting of July 26, 2006,
and would abstain from voting on this item.
Member Barton noted that she was also absent from that meeting and would abstain
from voting.

1 VI Staff Concerns

3 Mr. DaVeiga referred to the copy of the Draft Staff Report on the Seaport Marina Project
4 distributed to the Board members tonight, and noted that this would be presented at the
5 adjourned meeting of Wednesday, September 13, 2006, at 6:30 p.m. He stated that
6 Staff has significant issues with the Environmental Impact Report (EIR) and has
7 identified these concerns in the Staff Report.

9 VII Board Concerns

11 Member Hurley asked if the City could have avoided convening tonight's meeting if the
12 adjournment statement for the last meeting had been to "adjourn to August 30, 2006,
13 unless cancelled," in which case the Board would have adjourned to September 13,
14 2006, unless there was another reason for having tonight's meeting. Mr. DaVeiga noted
15 that tonight's meeting is a regularly scheduled meeting; however, the adjournment
16 statement could have been worded as suggested by Member Hurley. Member Hurley
17 recommended that this be kept in mind for future meetings.

19 Member Hurley referred to Page 3, Line 9 of the minutes of July 26, 2006, and noted
20 that the text is misleading related to his comments being about the Staff Report rather
21 than about the attached letters of comment. He requested that a new page number
22 sequence be used for the attachments, rather than continuing the page numbering
23 sequence from the last page of the Staff Report itself. Mr. DaVeiga stated that Staff
24 could do this.

26 Member Neal asked for the definition of a "plume." Chairperson Voce explained that
27 this is an area that is dissolving into another area, basically in a solution. He gave the
28 example of a toxic chemical dispersing through the groundwater. He said that this could
29 be a liquid or gas.

31 Member Barton stated that she had asked Mr. DaVeiga to provide an update on the
32 Seaport Marina Project at the next meeting.

34 Chairperson Voce stated that the issue of leaf blowers being used to blow roof dust off
35 homes when removing and replacing roofs must be addressed as well as the issue of
36 the proper use of leaf blowers during landscape maintenance activities. Member Hurley
37 noted that several months ago the Board was told that Bob Eagle was going to handle
38 this issue. Chairperson Voce indicated that some follow-up should be done and a
39 report made to the Board at its next meeting. Chairperson Voce then commented that
40 many residents are now purchasing portable metal receptacles designed for burning
41 wood for a campfire. He said that these should be prohibited, as it is bad enough
42 having the back yard fireplaces burning, although the fireplaces do require a natural gas
43 flame. Member Hurley stated that the South Coast Air Quality Management District
44 (SCAQMD), or the state, at one time attempted to outlaw outdoor briquette burning
45 barbeques and had not been successful. Chairperson Voce requested that Staff check
46 on the current status of this issue. He commented that smoke fumes from these types

of devices come in through open windows and get into one's home and are recirculated
in heating systems. He noted that these are greenhouse gases and toxic fumes that
are being produced for recreational purposes. He added that the City has approved
many of these wood pit barbeques or grills in restaurants, like Hennessey's, and there is
no control over these emissions. Also, residents will soon begin using their indoor
fireplaces adding more particulate matter to the air. He cautioned that the City must
begin addressing these issues as they are only going to get worse. Member Hurley
asked if Chairperson Voce had any recommendations for Staff on how to begin to
address this. Chairperson Voce stated that a review of the existing pollution standards
must be completed to determine the level of enforcement available, and whether this is
sufficient to effectively address the issue of pollution. Member Hurley agreed and
stated that he is unclear about the definition of an Ordinance and a Policy. Mr. DaVeiga
explained that policies implement objectives and goals but are not enforceable; an
Ordinance is law and can be enforced. Member Barton asked whether the Board could
direct Staff to research this information and prepare a report to City Council.
Chairperson Voce stated that the Board should review this information prior to making
recommendations to City Council.
Member Hurley asked if there were any other items on the agenda for September 13th
other than the EIR for the Seaport Marina Project. Mr. DaVeiga stated that at this point
this would be the only item on the agenda, but he would check with the Director of
Development Services to determine whether there would be any other items for
discussion.
VIII Adjournment
Chairperson Voce adjourned the meeting at 7:02 p.m. to the adjourned meeting of
Wednesday, September 13, 2006, at 6:30 p.m.
