AGENDA APPROVAL By Motion of the Planning Commission this is the time to notify the public of any changes to the Agenda, re-arrange the order of the Agenda, and provide an opportunity for any member of the Planning Commission or staff to request an item be removed from the Consent Calendar for separate action. CONSENT CALENDAR Items on the Consent Calendar are considered to be routine and are enacted by one motion unless prior to enactment a member of the Planning Commission or staff requests a specific item be removed from the Consent Calendar for separate action. 1. Approve Planning Commission Meeting Minutes of July 21, 2010. 2. Minor Plan Review 10-11 316 Marina Drive Applicant/Owner: Scott & Alys Dickson Request: To remodel and modify interior walls to reconfigure living areas without an expansion of square footage on a nonconforming residential structure. The property is nonconforming since it does not provide a carport or an enclosed garage. The meeting was 1 9 held in the City Council Chambers and began with the Salute to the Flag. 10 ROLL CALL 11 12 13 Present: Chairperson Deaton, Commissioners Bello, Cummings, Galbreath, and 14 Massa-Lavitt. 15 16 Also 17 Present: Department of Development Services 18 Mark Persico, Director of Development Services 19 Jerry Olivera, Senior Planner 20 Quinn Barrow, City Attorney 21 22 Absent: None 23 ORAL COMMUNICATIONS 24 25 26 Chairperson Deaton opened oral communications. 27 28 Clyde Huzenga spoke regarding disturbance from lighted signage at the rear of the 29 Regency Center along Balboa Drive and Bolsa Avenue. The property is 23 nonconforming since it does not provide a carport or an 24 enclosed garage. 25 26 Recommendation: Approval, subject to conditions, and adoption of Resolution 27 10-32. 28 29 Staff Report 30 31 Mr. Olivera delivered the staff report and noted that the City Zoning Code (ZC) permits 32 reconfiguration of up to 25% of interior walls for nonconforming structures. He 33 explained that this property was formerly zoned for commercial use and most of the 34 interior walls of the structure had been removed. The applicant now wishes to convert 35 this to a residential property within what is now a residential zone. Staff recommends 36 approval of Minor Plan Review 10-11. 37 38 Commissioner Cummings commented that the she visited the property and is 39 concerned that the structure is surrounded by blacktop. 40 41 The applicant, Scott Dickson, noted that the ultimate goal is to convert this structure to a 42 “beach cottage” with more greenery. He indicated that, as he understands, covered 43 parking would not be required as long as there is no modification to the exterior of the 44 structure. He stated that in the future they do plan to add on to the home, including 45 covered parking. 46 2 of 5 City of Seal Beach Planning Commission Meeting Minutes of August 4, 2010 1 MOTION by Massa-Lavitt; SECOND by Bello to approve Minor Plan Review 10-11, 2 subject to conditions, and adopt Resolution 10-32 as presented. 3 MOTION CARRIED: 5 – 0 4 AYES: Deaton, Bello, Cummings, Galbreath, and Massa-Lavitt 5 NOES: None 6 ABSENT: None 7 8 9 Mr. Barrow advised that the adoption of Resolution No. 10-32 begins a 10-day calendar 10 appeal period to the City Council. The Commission action tonight is final and the 11 appeal period begins tomorrow morning. 12 SCHEDULED MATTERS 13 14 15 3. Clarification of Home Occupancy Standards Related to On-Site Visitors - Title 11: 31 (Zoning Code). 32 33 Staff Report 34 35 Mr. Persico noted that at the July 21, 2010, meeting the Planning Commission 36 considered 4 items related to Title 11 – Zoning, and after discussion, modifications were 37 requested related to allowable on-site visitors to home-based business. The proposed 38 revised text reads “The home occupation may allow up to 6 clients, patients, or pupils, 39 to be present at any one time, except for child day care facilities, provided that only one 40 group, regardless of size, is allowed per day.” 41 42 Chairperson Deaton proposed permitting groups of up to 6 people once per week, and if 43 the home business owner wishes to have more that one group per week, this would 44 require an Administrative Use Permit. 45 3 of 5 City of Seal Beach Planning Commission Meeting Minutes of August 4, 2010 1 Commissioner Cummings stated that once per week was restrictive, particularly for 2 tutoring. 3 4 Commissioner Bello was in favor of limiting groups to once a week. 5 6 The Commission agreed to recommend permitting a home occupancy business to have 7 one client, patient, or pupil at a time throughout the day all week, and up to 6 people 8 once per week.
