SUBJECT: Adopt Resolution related to the proposition concerning the City's Transient
Occupancy Tax to be submitted to the voters at the March 28, 2006 Election
SUMMARY OF REQUEST
Adopt Resolution Number to change the phrase on ballot measure A -06 to read: "Shall
Ordinance Number 1541, which increases the Hotel Visitor Tax from 9% to 12% be adopted ?"
BACKGROUND
The City Council previously ordered that a proposition increasing the transient occupancy tax be
submitted to the voters at the March 28, 2006 election. The Council also directed City staff to
research whether it would be permissible to phrase the proposition as a measure to increase the
"Hotel Visitor Tax ". Staff has done that research and determined that Transient Occupancy Tax
(TOT) and Hotel Visitor Tax are synonymous. Accordingly, the City Council, pursuant to its
right and authority, hereby orders that the measure be phrased as follows: "Shall Ordinance
Number 1541, which increases the Hotel Visitor Tax from 9% to 12% be adopted ?"
FINANCIAL IMPACT
No additional financial impact.
RECOMMENDATION
Adopt Resolution Number , to change the phrase on ballot measure A -06 from Transient
Occupancy Tax to Hotel Visitor Tax .

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SEAL BEACH RELATED TO THE PROPOSITION
CONCERNING THE CITY'S TRANSIENT OCCUPANCY
TAX TO BE SUBMITTED TO THE VOTERS AT THE
PRIMARY NOMINATING ELECTION ON MARCH 28, 2006
THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES RESOLVE AND
ORDER AS FOLLOWS:
Section 1. The City Council has previously ordered that a proposition increasing
the transient occupancy tax be submitted to the voters at the Primary Nominating
Election to be held in the City on March 28, 2006.
Section 2. The Council also directed City staff to research whether it would be
permissible to phrase the proposition as a measure to increase the hotel visitor
tax. Staff has done that research, and determined that transient occupancy tax
and hotel visitor tax are synonymous. Accordingly, the City Council, pursuant to
its right and authority, hereby orders that the measure be phrased as follows:
Shall Ordinance No. 1541, which YES NO
increases the Hotel Visitor Tax from
9% to 12 %, be adopted?
Section 3. The City Clerk shall certify to the passage and adoption of this
Resolution and shall enter it into the book of original resolutions.

Beach this 23rd day of January 2006 by the following vote:
