HomeMy WebLinkAboutCC Min 1988-04-05 4-5-88 Seal Beach, California AprilS, 1988 The City Council of the City of Seal Beach met in regular adjourned session at 7:00 o'clock p.m. with Mayor Wilson calling the meeting to order with the Salute to the Flag. ROLL CALL Present: Mayor Wilson Councilmembers Clift, Hunt, Risner I Absent: Councilman Grgas Councilman Grgas' absence from the meeting was excused by action of the City Council on April 4th. Also present: Mr. Nelson, City Manager Mr. Rudell, Assistant City Attorney Mrs. Yeo, City Clerk WAIVER OF FULL READING Clift moved, second by Hunt, to waive the reading in full of all ordinances and resolutions and that consent to the waiver of reading shall be deemed to be given by all Councilmembers after reading of the title unless specific request is made at that time for the reading of such ordinance or resolution. AYES: NOES: ABSENT: Clift, Hunt, Risner, Wilson None Grgas Motion carried RESOLUTION NUMBER 3774 - DECLARING RESULTS - PRIMARY/SPECIAL MUNICIPAL ELECTION - MARCH 29. 1988 Resolution Number 3774 was presented to Council entitled "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, RECITING THE FACTS OF THE PRIMARY MUNICIPAL ELECTION HELD IN THE CITY OF SEAL BEACH ON THE 29th DAY OF MARCH, 1988, DECLARING THE RESULTS THEREOF, AND SUCH OTHER MATTERS AS ARE PROVIDED BY LAW." By unanimous consent, full reading of Resolution Number 3774 was waived. The City Clerk presented the staff report, reviewing the facts contained in Resolution Number 3774 and the certification of the election attached thereto. Wilson moved, second by Risner, to adopt Resolution Number 3774 as presented. I AYES: NOES: ABSENT: Clift, Hunt, Risner, Wilson None Grgas Motion carried CITY COUNCIL ITEMS Councilman Clift reported that the City is in receipt of a letter noticing the resignation of Mr. Jay Covington from the Planning Commission, Councilmanic District Four, effective immediately. Councilmember Risner presented the breakdown of the election results for Initiative Measure "A" by Councilmanic Districts 1 based upon the preliminary results as: District One - sixty- four percent no, thirty-six percent yes, District Two - seventy-two percent no, twenty-eight percent yes; District Three - seventy-five percent no, twenty-five percent yes; District Four - forty-seven percent no, fifty-three percent yes, and District Five - seventy-nine percent no, twenty-one percent yes. Councilman Hunt noted that there has been correspondence from Mr. Stark, Measure "A" proponent, to the City Attorney and recommended that the subject of the correspondence be placed on the next Council agenda. He 4-5-88 I expressed concern that City monies may be spent to reply to this correspondence which may be determined to be frivolous in nature, and if so, should be treated as such, also if such correspondence is to be repetitious, the person making the request should withstand the burden of cost rather than the public at large. Councilmember Risner stated her understanding that the three communications attack the Golden Rain Foundation, the TELL Committee in Leisure World, and the Concerned Residents of Seal Beach, and suggested that it may be desirable to have the individual group respond rather than the City Attorney. She reported the allegations made regarding the cost of campaign fliers of the Concerned Residents were incorrect. Councilmember Risner read a message from Councilman Grgas with regard to the overwhelming vote against the proposed initiative ordinance, the attempt to allege improprieties of campaign practices against those groups that opposed the measure, however stating that the group making the allegations will themselves be under investigation for what is believed to be campaign violations. Mrs. Risner again stated that the allegations that have been made are unfounded, however legal threats have recently been made against members of the City Council and members of the various committees. Councilmember Risner requested that the City Manager prepare a breakdown of City costs directly relating to the Initiative Measure "A". The City Manager responded that there is no complete cost breakdown at this time and that some areas will require additional research, such as legal costs, including the initial court case, and staff time in responding to the numerous correspondence generated by the proponents of the Initiative, however a preliminary cost review appears to be well in excess of sixteen thousand dollars without inclusion of legal fees and staff time. Councilman Hunt again referred to the three communications to the City Attorney from Mr. Stark, which he stated contained false allegations, and requested that the City Attorney advise the Council if there is any recourse should such allegations continue. The Assistant City Attorney stated that when this matter is brought back to the Council, their office would try to address the options available to the Council.
