SUBJECT: RECEIVE AND FILE - WINTER SAND DIKE (BERM)
SUMMARY OF REQUEST:
Receive and file the removal of the winter sand dike.
BACKGROUND:
Historically, the residents along the beach between the Anaheim Jetties and the pier are
subject to wave inundation during storms. The threat of washouts or flooding is lessened
by the annual construction of a sand berm. The "berm" is routinely removed prior to the
Easter Holiday except in cases where possible inclement weather and wave events would
make it prudent to leave it in place for longer periods.
On September 22, 2003, the City Council received and filed a report prepared by Moffat
Nichol Engineers regarding the construction and removal of the annual winter sand dike.
At that meeting the City Council directed staff to implement the following timeline:
❑ Start construction of the dike after November 1 with completion anticipated by
mid November.
❑ Remove the dike by March 31.
❑ During El Nino years, start construction of the dike so it is complete by
November 1 and leave in place until mid April.
The weather patterns currently being experienced by Southern California suggests that
the dike removal should occur in early April. The last week of March contains tides that
are over 5 -foot and the tides begin to drop the first week of April. The removal of the
sand dike will most likely begin on Monday, April 3, 2006 and should take less than one
week to remove. In the event of imminent storm or coastal wave events, removal may be
postponed an additional week. Cattrac Construction, the City's on -call contractor, will
perform removal of the berm, and Moffatt & Nichol Engineers will provide inspection
and monitoring services.

As reported in the September 22, 2003 City Council report, "It is important to note that
any policy involving natural occurrences involve risk. Often elected officials have to set
policy and protection based upon probability of occurrence, funding availability, and
geographic locale. This report analyzed the probability of tropical events and does make
a recommendation that will be perceived as more favorable by the public. The
information analyzed is not exact and there always looms the chance for an occurrence of
events similar to September 1997." Staff has also received input from a minority of the
public that desire additional storm protection, and that are against loss of beach views.
The current plan intends to strike a balance with community desires and protection from
unpredictable natural events.
FISCAL IMPACT:
There are sufficient funds within the contract professional services budget of the
Tidelands Beach/Pier Account. It is anticipated that the cost of the removal of the sand is
approximately $30,000.
RECOMMENDATION:
Receive and file the removal of the winter sand dike.

Contractors bid on two alternate slurry products. This approach was taken to ensure the
highest quality product under the current budget. Alternate A involves using a rubberized
slurry material that shall provide a longer life to the streets compared to the conventional
latex slurry specified in Alternate B. Per the stipulations specified in the bid documents,
Alternate A shall be selected if the difference in cost does not exceed 25% in comparison
with Alternate "B ".
Six bids were received and opened by the City Clerk on March 2, 2006 as listed below:

The difference between the low bid of Alternate A and the low bid of Alternate B is 27 %.
Staff has reviewed the submitted bid documents and found the low bidder to be in
compliance with the contract documents. Upon the successful execution of the contract
documents, the project is estimated to start in early May and completed in July.
FISCAL IMPACT:
Funds in the amount of $75,000 are currently available in fiscal year 2005/2006 from the
Measure M — Local Turnback fund within the City's approved 5 -year Capital
Improvement Program budget under Project No. 50177 for design, construction, and
inspection. There is no fiscal impact to the General Fund. The remaining funds in the
amount of $97,163.93, from the previous street seal project will be added to the current
fiscal year 2005/2006 budgets.
RECOMMENDATION:
It is recommended that the City Council award a construction contract for the Annual
Street Seal program, Project 50177, to the lowest responsible bidder, Pavement Coatings
in the amount of $56,716.96 and authorize the City Manager to execute the agreement.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL
BEACH AWARDING THE BID FOR THE ANNUAL STREET SEAL
PROGRAM, PROJECT #50177
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES
HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS:
SECTION 1. The City Council hereby approves the contract between the City of Seal
Beach and Pavement Coatings for the Annual Street Seal Program, Project
#50177.
SECTION 2. The Council hereby directs the City Manager to execute the contract for the
Annual Street Seal Program, Project #50177.
