SUBJECT: BIENNIAL REVIEW OF CONFLICT OF INTEREST CODE
SUMMARY OF REQUEST
The proposed City Council action will be to proceed with the biennial review of the City's
conflict -of- interest code by directing the City Attorney to review the current code for required
amendments.
BACKGROUND
The Political Reform Act requires all local governments and agencies to review and, if
necessary, to update their conflict -of- interest code in each even - numbered year. The City last
updated its conflict of interest code on December 13, 2004, when the City Council adopted
Resolution Number 5288.
A biennial review generally consists of three steps: (1) by July 1st the "code reviewing body"
(the City Council) issues a direction to staff that the conflict -of- interest code is to be reviewed
for required amendments; (2) by October 1st staff gives the code reviewing body a report of
required amendments or a statement that no amendment is required; and (3) by December 30th
the code reviewing body adopts any required amendments to the conflict -of- interest code.
FINANCIAL IMPACT
No fiscal impact.
RECOMMENDATION
It is recommended that the City Council proceed with the biennial review of the City's conflict of
interest code by directing the City Attorney to review the current code for required amendments.
