Bahorski, City Manager FROM: Mark Vukojevic, P.E., Director of Public Works/ City Engineer SUBJECT: APPROVAL OF THE RESOLUTION, APPROVING THE APPLICATION FOR GRANT FUNDS FOR THE CALIFORNIA RIVER PARKWAYS GRANT PROGRAM UNDER THE WATER SECURITY, CLEAN DRINKING WATER, COASTAL AND BEACH PROTECTION ACT OF 2002, PROPOSITION 50 SUMMARY OF REQUEST: The proposed City Council action will approve the attached Resolution No. and submission of applications for grant funds to the California River Parkways Grant Program under the Water Security, Clean Drinking Water, Coastal, and Beach Protection Act of 2002, Proposition 50. BACKGROUND: The voters of California passed the Water Security, Clean Drinking Water, Coastal and Beach Protection Act of 2002 (Proposition 50) on November 5, 2002. It added to the California Water Code, Section 79541, authorizing the Legislature to appropriate $100 million for the acquisition, restoration, protection and development of river parkways. The program is being administered by the State Resources Agency and Staff has applied for $1,187,348 in funds for the construction of the River's End Staging Area and Parking Lot Improvements Project No. 50171. In addition, the City has already been allocated $500,000 from the RMC Agency to facilitate construction of the project and to contract work for a grant writer. As part of the grant application, a resolution from the local agency is required for support of the project. FISCAL IMPACT: Staff is requesting a total of $1,187,348 in grant funds for the project listed above. There are no match funds required for the project. However, the Resources Agency has stated Agenda Item 0 1 that priority shall be given to projects that included a commitment for a matching contribution. Additional maintenance costs have not been calculated at this time. NOW, THEREFORE BE IT RESOLVED, the City Council of the City of Seal Beach, Calif. as follows: Section 1. Approves the filing of an application for the River's End Staging Area and San Gabriel River Bikeway Enhancement Project; and Section 2. Certifies that Applicant understands the assurances and certification in the application, and Section 3. Certifies that Applicant or title holder will have sufficient funds to operate and maintain the Project consistent with the land tenure requirements; or will secure the resources to do so, and Section 4. Certifies that Applicant or title holder will have sufficient funds to operate and maintain the Project consistent with the land tenure requirements; or will secure the resources to do so, and Section 5. Certifies that it will comply with the provisions of Section 1771.8 of the State Labor Code regarding payment of prevailing wages on Projects awarded Proposition 50 Funds, and Section 6. if applicable, certifies that the Project will comply with any laws and regulations including, but not limited to, legal requirements for building codes, health and safety codes, disabled access laws, and, that prior to commencement of construction, all applicable permits will have been obtained, and - Section 7. Appoints the City Engineer as agent to conduct all negotiations, execute and submit all documents including, but not limited to applications, agreements, payment requests and so on, which may be necessary for the completion of the aforementioned Project.
