HomeMy WebLinkAboutCC AG PKT 2005-11-14 #U AGENDA REPORT DATE: November 14, 2005 TO: Honorable Mayor and City Council FROM: Lee Whittenberg, Director of Development Services SUBJECT: GENERAL PLAN AMENDMENT 05 -2 OPEN SPACE/RECREATION /CONSERVATION ELEMENT AMENDMENT LAND USE ELEMENT CONFORMING AMENDMENTS BOEING INTEGRATED DEFENSE SYSTEMS SPECIFIC PLAN - PERIMETER BUFFER/WATER RETENTION AREAS SUMMARY OF REQUEST: To amend the Open Space/Recreation /Conservation Element of the General Plan to reflect the final location and size of the "Perimeter buffer areas /retention areas" as set forth within the approved Boeing Integrated Defense Systems ( "BIDS ") Specific Plan and other conforming amendments to the Land Use Element. BACKGROUND: The City initiated this General Plan Amendment to amend the Open Space/Recreation /Conservation Element of the General Plan to reflect the final location and size of the "Perimeter buffer areas /retention areas" as set forth within the approved Boeing Integrated Defense Systems ( "BIDS ") Specific Plan and to make other conforming amendments to the Land Use Element of the General Plan. At the time of City Council approval of the BIDS Specific Plan in July 2003 this project component was not established in the Open Space/Recreation /Conservation Element of the General Plan, as it was uncertain as to what the final approvals of the California Coastal Commission might establish for these proposed areas. The Coastal Commission approvals were consistent with the delineated areas location and size of the "Perimeter buffer areas /retention areas" as set forth within the approved BIDS Specific Plan. The project site is irregular in shape and is identified as Lot B, Tract No. 16375. The property is located along the western edge of the Being Integrated Defense Systems property adjacent to the Los Alamitos Retention Basin and along the northern side of Adolfo Lopez Drive, comprising approximately 194,433 square feet or 4.5 acres. Figure 2 -5, Illustrative Site Plan, from the approved BIDS Specific Plan, indicating the subject "Perimeter buffer areas /retention areas" is provided as Attachment 4 for the information of the City Council. The General Plan, Specific Plan and Zoning Designations of the subject property are: ❑ General Plan — Industrial-Light ❑ Specific Plan - Boeing Integrated Defense Systems Specific Plan ❑ Zoning Map — Specific Plan Regulation (SPR). The Planning Commission serves as an advisory body to the City Council on the requested actions before it regarding this General Plan Amendment and adopted Resolution 05 -55 on October 26, 2005 after conducting the required public hearing. The Planning Commission determined to recommend approval of the requested amendments to the General Plan. A copy of the Planning Commission Resolution and a "draft" minute excerpt is provided as Attachment 2 and 3, respectively. There were no public comments received by the Planning Commission at the public hearing. ENVIRONMENTAL REVIEW An Environmental Impact Report was certified for the BIDS Specific Plan by the City Council on July 28, 2003 through its adoption of Resolution Number 5149 and it is on file at the Department of Development Services. This component of the BIDS Specific Plan was fully evaluated in the certified Environmental Impact Report and no additional environmental review is required. OVERVIEW OF EXISTING GENERAL PLAN OPEN SPACE/RECREATION /CONSERVATION ELEMENT AND LAND USE ELEMENT PROVISIONS AND REQUESTED REVISIONS • 2 GPA 05 -2.CC Staff Report.BIDS Open Space Amendment General Plan Amendment 05 -2, Open Space/Recreation/Conservation Element Amendment and Land Use Element Conforming Amendments Boeing Integrated Defense Systems Specific Plan — Perimeter Buffer /Water Retention Areas City Council Staff Report November 14, 2005 Open Space/Recreation /Conservation Element of the General Plan Revisions: ❑ The Open Space/Recreation /Conservation Element of the General Plan provides an overview of the various Planning Areas (The BIDS Specific Plan area is located within Planning Area 2) identified in the General Plan and specifically provides an overview of the "Natural Resource Land" classification on page OS- 8, stating: "Natural Resource Land Areas within the City have been designated for the preservation of natural resources. Natural resource areas would include land set aside for the preservation of plant and animal life, areas required for ecological and other scientific study purposes, bays and estuaries and coastal beaches. Seal Beach National Wildlife Refuge habitats are typical of this category. A 100 -acre portion of the Hellman Ranch Specific Plan area has been deed restricted for 25 years for sale at fair market value to a public agency for the purposes of wetlands restoration, open space, and environmental education ,purposes. The adjacent oil production property (approximately 50 acres) has been similarly restricted, although the 25 -year period does not commence until cessation of the oil production activities." Staff Comments: No Revisions to this section of the General Plan Open Space/Recreation /Conservation Element are necessary. This park, which will be extended to Seal Beach Boulevard as part of the Hellman Ranch project, '.v has been dedicated to the City for the enjoyment of the residents of the community. The BIDS Specific Plan includes a 4.5 - acre area adjacent to the Los Alamitos Retention Basin and Adolfo Lopez Drive that is re stricted for use as a storm water quality treatment basin area in accordance with City and Coastal Commission permit conditions. The water quality concept is to introduce bio- filtration, treatment areas, and best management practices (BMPs) to capture low water flows and provide storm water retention capacity to meet the stormwater runoff and water quality objectives of the City and other State agencies. The Hellman Ranch Specific Plan provides for potential additional recreation/open space areas that may be developed as part of the total planned community. These areas /uses include: • Los Alamitos Retarding Basin — 34.7 acres retarding basin/open space • Hellman Ranch Lowlands —100 acres on Hellman Ranch for future restoration, open space, and environmental education purposes. 5 GPA 05 -2.CC Staff Report.BIDS Open Space Amendment General Plan Amendment 05 -2, Open Space/Recreation/Conservation Element Amendment and Land Use Element Conforming Amendments Boeing Integrated Defense Systems Specific Plan — Perimeter Buffer /Water Retention Areas City Council Staff Report November 14, 2005 • Oil Production Acreage — approximately 50 acres on the Hellman Ranch that is currently used for oil production operations for future restoration, open space, and environmental education purposes upon the cessation of all mineral production activities. A pedestrian trail is planned to link to the Class I San Gabriel River Trail through the Los Angeles Department of Water and Power property adjacent to the .west boundary of the Specific Plan site." Staff Comments: The proposed revisions to the information in this section are shown by bold and double- underlined text as indicated above. ❑ The "City of Seal Beach Parks /Recreation/Open Space Map" on Page OS -15 will require a revision to indicate the appropriate inclusion the "Water Quality & Flood Retention Basins" of the BIDS Specific Plan as shown graphically on Figure 3 -3, Storm Drain and Water Quality Concept Plan, Boeing Specific Plan as "Open Space" on said Open Space Map. The requested action will bring the City's General Plan into conformity with the adopted BIDS Specific Plan, in compliance with the provisions of State law regarding internal consistency between a city's General plan and its implementing land use regulations (specific plans, zoning ordinance, subdivision ordinance, etc.). The City is initiating this General Plan Amendment to amend the Open Space /Recreation/Conservation Element of the General Plan to reflect the final location and size of the "Perimeter buffer areas /retention areas" as set forth within the approved Boeing Integrated Defense Systems ( "BIDS ") Specific Plan and to make other conforming amendments to the Land Use Element of the General Plan. At the conclusion of said Planning Commission public hearing the Planning Commission determined to recommend to the City Council approval of General Plan Amendment 05 -2 on a 4 -0 -1 vote, with Commissioner Deaton being absent. Section 6. A duly noticed public hearing was held before the City Council on November 14, 2005 to consider the subject amendments to the General Plan. At the public hearing, the City Council invited and considered any and all testimony offered in favor or opposition to said project. Section 7. (g) The surrounding land uses and zoning are as follows: NORTH: The Leisure World Retirement community, located in the Residential High Density, Planned Development (RHD -PD) Zone. SOUTH: City of Seal Beach facilities including the Animal Care Center, the Public Works maintenance Yard and the Police Station in the Public Land Use /Recreation (PLU/R) Zone. WEST: the Los Alamitos Retarding Basin, in the Public Land Use/Recreation (PLU/R) Zone. EAST: The remainder of the Boeing Integrated Defense Systems Specific Plan area, in the Specific Plan Regulation (SPR) Zone. Section 8. Based upon substantial evidence in the record of the City Council hearing regarding the application, including the facts stated in § 1 through § 7 of this resolution, and in the previously certified environmental documentation prepared in conjunction with this project, and pursuant to §§ 28 -2600 and 28 -2602 of the City's Code, the City Council hereby fords that General Plan Amendment 05 -2, consisting of an amendments to the Open Space/Recreation /Conservation Element of the General Plan and other conforming amendments to the Land Use Element of the General Plan, will be beneficial to the short term and long term land use goals of the City of Seal Beach. The City Council further fords that approval of the subject amendments to the General Plan will promote the public health, safety and welfare. General Plan Amendment 05 -2 Open Space /Recreation /Conservation Element Amendment Boeing Integrated Defense Systems Specific Plan — Perimeter Buffer/Water Retention Areas Applicant/Owner: City of Seal Beach Request: To amend the Open Space /Recreation /Conservation Element of the General Plan to reflect the final location and size of the "Perimeter Buffer Areas /Retention Areas" as set forth within the approved Boeing Integrated Defense Systems (BIDS) Specific Plan and other conforming amendments to the Land Use Element. Recommendation: Approval and adoption of Resolution 05 -55. Staff Report Mr. Whittenberg delivered the staff report. (Staff Report is on file for inspection in the Planning Department.) He provided some background information on this . item and noted that this is a "clean -up" item on the City's approvals of the Boeing Integrated Defense Systems (BIDS) Specific Plan. He stated that when this plan was approved by the PC, and ultimately by the City Council, the conforming amendments to the Open Space /Recreation /Conservation (OSRC) Element regarding water retention basins was purposely deferred by the City due to the concern that during its review the California Coastal Commission (CCC) might change the areas and boundaries of the proposed water retention /storm water quality basins. He explained that the CCC had approved the project in 2004 without any changes to the boundaries, so the City is now seeking approval for the amendment to the OSRC Element and the proposed conforming amendments to the Land Use Element (LUE) of the General Plan to identify these areas as open space within the City so that future owners of the buildings cannot request an amendment to incorporate these areas into the parking lots or for construction of additional buildings. He noted that the area in question measures approximately 4.5 acres and runs in a north /south direction from Westminster Avenue southerly adjacent to the Los Alamitos retention basin, then turns near Adolfo Lopez Drive. Commissioner Questions Chairperson Shanks asked if there were plans to install a drainage pipe to alleviate the flooding that occurs along Seal Beach Boulevard (SBB) near the Boeing facility. Mr. Whittenberg indicated that there is a condition of approval on the subdivision map for the BIDS property that states that the drainage problem along SBB must be resolved before the final tract map receives approval. He noted that resolution of the flooding would not mean that this water would be routed to the drainage basins to the west, but would simply address drainage along SBB from the new buildings.
