SUBJECT: ACCEPTANCE OF THE ANNUAL STREET SEAL
PROGRAM, PROJECT No. 50176
SUMMARY OF REQUEST:
The proposed City Council action will adopt Resolution Number $land formally
accept the completion of the construction for the Annual Street Seal Program.
BACKGROUND:
The completed project, Annual Street Sealing Program for FY 05/06 (Project 50176)
slurry sealed various streets throughout the city. As identified in the City Council's
accepted Pavement Management Plan (June 14, 2004), a list of the streets included in this
project are listed below:

5 Street (Marina Ave. to PCH) Iris St (Hazelnut Ave to Ironwood Ave)
Ironwood Ave (Iris St to Rose St)
THE HILL Ironwood Ave (Sunflower St to Wisteria St)
Bolsa Ave (PCH to Seal Beach Blvd) Hazelnut Ave (Sunflower St to Wisteria St)
Silver Shoals (Bolsa Ave. to Fathom Ave.)
Balboa Dr. (Bolsa Ave. to Catalina Ave.)
Slurry seals extend the effective life of asphalt concrete pavements by placing a
protective seal over existing pavement surfaces that are just beginning to show signs of
wear. Slurry seals allow the City to stretch pavement rehabilitation funds and maintain a
higher level of pavement quality by protecting pavement from oxidation. It is standard
practice to slurry seal every 5 to 8 years.
On April 11, 2005, City Council awarded a project to All American Asphalt. In
accordance with the plans and specifications, the contractor has completed the
aforementioned project for a final contract amount of $55,912,44.

FISCAL IMPACT:
Funds were available in the 2004/2005 City's Capital Improvement Program budget for
the Annual Street Seal Program. Funding came from State Measure M — Local Turnback
funds, and had no impact to the General Fund.
RECOMMENDATION:
Upon motion of the consent calendar, it is recommended that the City Council:
1. By resolution, determine the work has been completed in accordance with the
contract documents and declare the work to be accepted and the total amount
of the contract is in the sum of $55,912.44.
2. Direct the City Clerk, within ten (10) days from the date of acceptance, file a
"Notice of Completion" with the Orange County Recorder.
3. Direct City staff, upon expiration of the thirty-five (35) days from the filing of
the "Notice of Completion," to make the retention payment to All American
Asphalt, in the amount of $5,591.24.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH
DECLARING WORK TO BE COMPLETED AS TO PLANS AND
SPECIFICATIONS FOR PROJECT NO. 50176 ANNUAL STREET SEAL
PROGRAM ENTERED INTO BETWEEN CITY OF SEAL BEACH AND ALL
AMERICAN ASPHALT
WHEREAS, on April 11, 2005, City of Seal Beach entered into a contract with All American
Asphalt, Inc.
WHEREAS, the City Engineer has determined that the work has been substantially completed
in accordance with the contract documents.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES HEREBY
RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS:
Section 1. That the work required to be performed by said Contractor has been completed.
Section 2. That the total cost of said work is in the amount of $55,912.44
Section 3. That the work is hereby accepted and approved.
Section 4. It is further ordered that a "Notice of Completion ", Exhibit A, be filed on behalf of
the City in the Office of the Orange County Recorder within 10 days of the date of
this resolution.
