SUBJECT: DISADVANTAGED BUSINESS ENTERPRISE (DBE) PLAN -
FEDERALLY ASSISTED PROJECTS
SUMMARY OF REQUEST:
The proposed City Council action will adopt the attached resolution approving the City's
Disadvantaged Business Enterprise (DBE) plan and approving its submittal to Caltrans.
BACKGROUND:
Caltrans requires that the City prepare and submit a Disadvantaged Business Enterprise (DBE)
Plan to Caltrans annually for all Federally Assisted Projects. Accordingly, the Seal Beach
Disadvantaged Business Enterprise Plan 2005 / 2006 has been prepared and the Plan includes the
target goal of 5.0 %.
FISCAL IMPACT:
Failure to adopt this Disadvantaged Business Program (DBE) prohibits the City from
reimbursement of State and Federal Funding and participation in the Federal Emergency
Management Agency (FEMA) process in case of an emergency.
RECOMMENDATION:
Staff recommends that the City Council adopt the attached resolution approving the City's
Disadvantaged Business Enterprise (DBE) plan and approving its submittal to Caltrans.

RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL
BEACH APPROVING THE DISADVANTAGED BUSINESS
ENTERPRISE (DBE) PROGRAM AND OVERALL ANNUAL GOAL OF
FIVE PERCENT (5.0 %) FOR FEDERAL FISCAL YEAR 2005 / 2006, FOR
ADOPTION AND SUBMISSION TO THE CALIFORNIA DEPARTMENT
OF TRANSPORTATION (CALTRANS).
WHEREAS, the City of Seal Beach is required to develop and submit a Disadvantaged
Business Enterprise (DBE) Program and Overall Annual Goal .for DBE
participation for U.S. Department of Transportation (DOT) assisted contracts as a
condition of federal financial assistance, pursuant to Title 49 Code of Federal
Regulations (CFR) Part 26; Participation by Disadvantaged Business Enterprises
(DBE) in DOT Programs; and
WHEREAS, in accordance with DBE regulations, the City of Seal Beach has developed a
narrowly tailored DBE Program and Overall Annual DBE Goal of Five point Zero
percent (5.0 %) for Federal Fiscal Year 2005/2006; and
WHEREAS, City Council adoption is required to ensure compliance with Department of
Transportation federal funding requirements, provisions, and financial
responsibilities
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES
HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS:
SECTION 1. Approval; the DBE Program and Overall Annual Goal for Federal Fiscal
Year 2005/2006 is hereby approved.
SECTION 2. Authorization; the City Manager is hereby authorized to execute the
Disadvantaged Business Enterprise (DBE) Program and Overall Annual Goal for Federal Fiscal
Year 2005 and submission to the California Department of Transportation (Caltrans) on behalf of.
the City for funding authority approval.

meeting thereof held on the day of , 2005 by the
