HomeMy WebLinkAboutAGMT - AKM Consulting Engineers (Master Plans)1 ��� • � 0 as I.vw• J11�'m PROFESSIONAL SERVICES AGREEMENT between SFAI I tI �1 Q: l� 9hlryT ? � • City of Seal Beach 211 8`" Street Seal Beach CA 90740 (hereinafter "City") and AKM Consulting Engineers 101 Pacifica, Suite 150 Irvine CA 92718 (hereinafter "Consultant ") for MASTER PLAN OF DRAINAGE, 001 - 49686 -042, SEWER SYSTEM MASTER PLAN, 043 - 49726 -060, SEWER FUNDING STUDY, 043 - 49724 -060 Contract No. 98001 o2/os /99 0 PROFESSIONAL SERVICES AGREEMENT THIS AGREEMENT, is made and entered into this _?_5th day of March , ` 199 by and between the CITY _ OF SEAL BEACH (hereinafter called "City "), and AKM Consulting Engineers , ( hereinafter called "Consultant")- RECITALS WHEREAS, City is a municipal corporation duly organized and validly existing under the laws of the State of California as a Charter City, with the power to carry on its business as it is now being conducted under the Statues of the State of California and the Charter of the City; and WHEREAS, the City requires the services of a Consultant to provide the professional services as described in the Scope of Services; WHEREAS, the Consultant is able and willing to perform the required services under the terms and conditions of this Contract; NOW, THEREFORE, the parties do mutually agree as follows: SECTION 101 101.1 CONSULTANT SERVICES. Consultant, as an independent contractor, agrees to perform during the term of this Agreement, each and every service set forth on the "Scope of Services" attached to this Agreement as Exhibit "A ". The initiation of service by the Consultant will commence upon receipt of a written notice from the Designated Official authorizing Consultant to proceed, and only to the extent of such authorization. The services of the consultant shall include the making of all investigations, studies, and analysis required by the conditions involved in each request of the Designated Official. 101.2 TIME OF PERFORMANCE. Consultant shall complete all services set forth in "Schedule ", Exhibit C, Schedule. The foregoing time schedule may be modified by the mutual written consent of the parties hereto. 101.3 COMPENSATION. The City will pay for the services of Consultant as indicated on the "Schedule of Compensation" which is set forth in Exhibit `B ". No payment for expenses or labor shall be paid by City unless it is related to a service which is referred to in the "Schedule of Compensation ". The total cost to the City shall not exceed the amount designated in Exhibit `B ", without the written approval and authorization of the City Council. 101.4 PAYMENT. The City will pay for services of the Consultant according to the progress payments schedule established in the Schedule of Compensation. City's payment to Consultant I shall be made within thirty (30) days of the date of completion of each phase as set forth in the progress schedule. 101.5 INDEPENDENT CONTRACTOR. Consultant and its subcontractor(s) shall act hereunder as independent contractors, and shall have no power to incur any debt or obligation for City. Neither City or any of its officers or employees shall have any control over the conduct of Consultant, or any of Consultant's employees or subcontractor, except as herein set forth, and Consultant expressly warrants no to, at any time or in any manner, represent that it, or any of its agents, servants, subcontractors or employees, are in any manner agents, servants or employees of City, it being distinctly understood that Consultant is and shall at all times remain to City a wholly independent contractor and Consultant's obligations to City are solely such as are prescribed by this Agreement. 101.6 ASSIGNMENT This Agreement may not be assigned in whole or in part, without the prior written consent of City. 101.7 DOCUMENT OWNERSHIP. Each and every report, draft, instrument of service, map, record, and other document reproduced, prepared, or caused to be prepared by the Consultant pursuant to or in connection with this Agreement shall be the exclusive property of the City. City acknowledges and agrees that all reports, drafts, instruments of service, maps, records, and other documents prepared by Consultant pursuant to this Agreement shall be used exclusively on this project and shall not be used for any other work without the written consent of Consultant. In the event City and Consultant consent permit the reuse or other use of the reports, drafts, instruments of service, maps, records, and other documents, City shall require the party using them to indemnify and hold harmless City and Consultant regarding such reuse or other use, and City shall require the party using them to eliminate any and all references to Consultant from the reports, drafts, instruments of service, maps, records, and other documents. This paragraph shall not restrict the duties of the City under the public records act. 101.8 CITY MASON. Consultant shall perform under the general supervision of the Director of Public Works of City or his designee, and all communications, instructions and directions on the part of the City shall be communicated exclusively through the Director of Public Works or his designee. 101.9 PERSONNEL. Consultant represents that it has, or shall secure at its own expense, all personnel required to perform Consultant's services under this Agreement. Consultant may associate or employ associates or subcontractors in the performance of it services under this agreement, but all times shall be responsible for their services. 101.10 INSURANCE. Consultant shall procure at its sole expense and maintain in force throughout the entire term of the Agreement insurance as indicated below. Consultant shall submit to City certificates indicating compliance with the following minimum insurance requirements not less than one day prior to the beginning of performance of this Agreement. Fa 0 0 Statutory Workers' Compensation Insurance with Employer's Liability in an amount not less than $1,000,000 covering all employees of Consultant performing services under this Agreement. Comprehensive Commercial Liability Insurance including Blanket Contractual Liability and Broad Form Property Damage coverage in an amount not less than $1,000,000 combined single limit of liability. Business Auto Liability Insurance including coverage for Hired and Non -owned Autos in an amount not less than $1,000,000 combined single limit of liability. Professional Liability Insurance in an amount not less than $1,000,000 each occurrence and annual aggregate covering any negligent act, error or omission of the Contractor for services performed under this Agreement. 101.11 MISCELLANEOUS INSURANCE REQUIREMENTS. 101.11.1 Contractor's Insurance Primary. In the event of claim or loss, any insurance purchased by the Contractor shall be primary. The City's insurance shall not contribute with Contractor's in the settlement or payment of any loss or claim. 101.11.2 Policy Requirements. Each policy of insurance shall: 1. Be issued by an insurance company which is an admitted insurer in the State of California. 2. Specify that it acts as primary insurance. Name and list as additional insured the City, its officers, agents, and employees except for the Professional Liability Insurance and Worker's Compensation Insurance. 4. Contain a clause substantially in the following words, "It is hereby understood and agreed that this policy shall not be canceled or materially changed except upon thirty (M) day's prior written notice to the City of Seal Beach of such cancellation or material change a evidenced by a return receipt for a registered letter." 101.11.3 Evidence of Insurance. The Contractor shall provide the City with Certificates of Insurance evidencing each of the coverage's procured to satisfy the requirements of this Agreement. 101.11.4 Failure to Secure. If the Consultant at any time during the term hereof should fail to secure or maintain the foregoing insurance, City shall be permitted to obtain such insurance in the Consultant's name or as an agent of the Consultant and shall be compensated by the Consultant for the costs of the insurance premiums at the maximum 3 • • rate permitted by law computed from the date written notice is received that the premiums have been paid. 101.11.5 Subrogation Waiver. Consultant agrees that in the event of loss due to any of the perils for which it has agreed to provide insurance, that the Consultant shall look solely to its insurance for recovery. Consultant hereby grant to City, on behalf of any insurer providing insurance to either Consultant or City with respect to services of Consultant herein, a waiver of any right of subrogation which any such insurer of said Consultant may acquire against City by virtue of the payment of any loss under such insurance. 101.12 INDEMNIFICATION. Consultant shall indemnify the City and its officers, employees and agents against, and will hold and save them and each of them harmless from, any and all actions, claims, damages to persons or property, penalties,. obligations or liabilities that may be asserted or claimed by any person, firm, entity, _corporation, political subdivision or other organization arising out of the negligent or intentional tortious acts, errors or omissions of Consultant, its agents, employees, subcontractors, or invitees. Consultant will defend the City, its officers, agents and employees from and against any action or actions filed in connection with any of said claims, damages, penalties, obligations or liabilities and will pay all costs and expenses, including attorney's fees for counsel of City's choice incurred in connection herewith; Consultant will promptly pay any judgment rendered against the City, its officers, employees or agents for any such claims, damages, penalties, obligations or liabilities: In the event , its officers, employees or agents is made a party to any action or proceeding to any action or proceeding filed or prosectued against Consultant for such damages or other claims arising out of or in connection with the sole negligence of Consultant hereunder, Consultant agrees to pay City, its officers, employees or agents, any and all costs and expenses incurred by City, its officers, employees or agents in such action or proceeding, including but not, limited to, reasonable attorney's fees. 101.13 TERMINATION OF AGREEMENT. This Agreement may be terminated without cause by City upon ten (10) days' written notice to the Consultant without further action by the City. This Agreement may be terminated by the Consultant upon thirty (30) days' written notice to the City. In the event the City terminates this Agreement as provided above, Consultant shall terminate work at the earliest possible point, and complete all attendant reports and /or graphic representations, conceptual plans, construction plan, or construction specifications. The City shall compensate the Consultant proportionately for work, provided such work is in a form useable to the City. Notice. Any notice required to be given to the Consulant shall be deemed duly and properly given upon mailing, postage prepaid, to: (Insert Address) 4 A or personally delivered to Consultant at such address or other address specified to the City in writing by Consultant. Any notice required to be given to the City shall be deemed duly and properly given upon mailing, postage prepaid, to: Attn: Director of Public Works City of Seal Beach 211 Eighth Street Seal Beach CA 90740 or personally delivered to City at such address or address specified to the Consultant in writing by the City. 101.14 STANDARD OF PERFORMANCE. . The Consultant shall perform and require its Subcontractors to perform the Services in accordance with the requirements of this Agreement and in accordance with professional' standards of skill, care and diligence adhered to by firms recognized for their expertise, experience and knowledge in performing services of a similar nature. The Consultant shall be responsible for the professional quality, technical accuracy, completeness, and coordination of the Services, it being understood that the City will be relying upon such professional quality, accuracy, completeness, and coordination in utilizing the Services. The foregoing obligations and standards shall constitute the "Standards of Performance" for the purposes of this Contract. The Consultant shall carefully study this Contract, shall verify all figures in these Contract Documents before performing the Services; shall promptly notify the City of all errors, inconsistencies, and/or omissions that it discovers; and, in instances where such non - conformities are discovered, shall obtain specific instructions in writing from the City before Consultant's proceeding with the Services. Any Services affected which are performed prior to the City's decision shall be at the Consultant's risk. The Consultant shall not take advantage of any apparent non - conformity that may be found in this Contract. The City shall be entitled to make such corrections therein and interpretations thereof as it may deem necessary for the fulfillment of the intent of this Contract. Omissions or misdescriptions of any Services that are manifestly necessary to carry out the intent of this Contract, or that are customarily performed, shall not relieve the Consultant from performing such Services at no additional expense and/or delay, and such Services shall be performed as if fully and correctly set forth in this Contract. 101.15 WARRANTY. The Consultant warrants that all Services shall be in accordance with this Contract and shall comply with the Standard of Performance for a period of one year from final acceptance of the Services. In the event of breach of this warranty, the Consultant shall take the necessary actions to correct the breach and the consequences thereof, at the Consultant's sole expense, in the most expeditious manner as permitted by existing circumstances. If the Consultant 5 does not promptly take steps to correct the breach upon notification thereof by the City, the City without waiving any other rights or remedies it may have at law or otherwise, may do or cause others to do so, and the Consultant shall promptly reimburse the City for all expenses and costs incurred in connection therewith. 101.16 DATA AND SERVICES TO BE FURNISHED BY CFI'Y. Consultant shall deliver to the City the studies, plans, specifications, or other documents as are identified in the Scope of Services; and Consultant shall upon completion of all work, submit to the City all information developed in the course of the Consultant's services. Consultant shall, in such time and in such form as the City may require, furnish reports concerning the status of services required under this Agreement. Consultant shall, upon request by City and upon completion or termination of this Agreement, deliver to the City all material furnished to Consultant by the City. 101.17 CONFIDENTIALITY. Consultant shall not disclose, publish, or authorize others to disclose or publish, design data, drawings, specifications, reports, or other information pertaining to the projects assigned to consultant by the City or other information to which the consultant has had access during the term of this agreement without the prior written approval of the designated Official during the term of this Agreement and for a period of two (2) years after the termination of this agreement. 101.18 RECORDS. Consultant shall maintain complete and accurate records with respect to sales, costs, expenses, receipts, and other such information required by the City or the Designated Official. The Consultant shall maintain adequate records on services provided in sufficient detail to permit an evaluation of services. All such records shall be maintained in accordance with generally accepted accounting principles and shall be clearly identified and readily accessible. Consultant shall provide access to the Designated Official or his designees at all proper times to such books and records, and gives the Designated Official or his designees the right to examine and audit such books and records and to make transcripts as necessary, and to allow inspection of all work, data, documents, proceedings, and activities related to this Agreement. 101.19 ASSIGNMENT. This agreement is personal to the Consultant and the Consultant's Representative. Any attempt at assignment by the Consultant shall be void unless approved in writing by the Designated Official. Consultant's services pursuant to this Agreement shall be provided by the Consultant's Representative or directly under the supervision of the Consultant's Representative and Consultant shall not assign another to supervise the Consultant's performance of this Agreement without the prior written approval of the City, by and through the designated Official. 101.20 SAFETY REQUIREMENT. All work performed under this Agreement shall be performed in a manner as to provide safety to the public and to meet or exceed the safety standards outlined by CAL -OSHA. The City reserves the right to issue restraint or cease and desist orders to the Consultant when unsafe or harmful acts are observed or reported relative to the performance of the work under this agreement. The Consultant shall maintain the work sites free of hazards to persons and property resulting from its operations. Any hazardous condition 0 noted by the Consultant which is not the result of his operations shall be immediately reported to the City. 101.21 NUISANCE. Consultant shall not maintain, commit, or permit the maintenance or commission of any nuisance in connection with the performance of services under this Agreement. 101.22 PERMITS AND LICENSES. Consultant, at its sole expense, shall obtain and maintain during the term of this Agreement, all appropriate permits, licenses, and certificates that may be required in connection with the performance of services under this Agreement. 101.23 CONFLICT OF INTEREST. Consultant covenants that neither consultant, nor any officer thereof, has any interest, nor shall they acquire any interest, directly or indirectly which will conflict with in any manner or degree with the performance of the Consultant services under this Agreement. Consultant further covenants that in the performance of this Agreement, no person having any such interest shall be employed by Consultant. Consultant further covenants that Consultant has not contracted with nor is the Consultant performing any services directly or indirectly, with any developer and/or property owners and /or firms, and/or partnerships owning property in the City, and further covenants and agrees that Consultant and /or its subcontractors shall provide no service or enter into any contact with the Developer and /or property owner and/or firms, and/or partnerships owning property in the City prior to the completion of this Agreement. 101.24 WAIVER A waiver by the City of any breach of any term, covenant, or condition contained in this Agreement shall not be deemed to be a waiver of any subsequent breach of the same or any other term, covenant, or condition contained in this Agreement whether of the same or different character. 101.25 COST OF LITIGATION. If any legal action is necessary to enforce any provision of this Agreement or for damages by reason of any alleged breach of any provisions of this Agreement, the prevailing party shall be entitled to receive from the losing party all costs and expenses in such amount as the court may determine to be reasonable. In awarding the cost of litigation, the court shall not be bound by any court fee schedule, but shall, if it is in the interest of justice to do so, award the full amount of costs, expenses, and attorneys' fees paid or incurred in good faith. 101.26 SEVERABILITY. If any part, term, or provision of this Agreement shall be held illegal, unenforceable, or in conflict with any law of a federal, state, or local government having jurisdiction over this Agreement, the validity of the reminding portions or provisions shall not be affected by such holding. 101.27 INTEGRATED CONTRACT. This Agreement represents the entire Agreement between the City and the Consultant and all preliminary negotiations and agreements are deemed a part of this Agreement. No verbal agreement or implied covenant shall be held to vary the provisions of this Agreement. This Agreement shall bind and inure to the benefit of the parties to this Agreement and any subsequent successors and assigns. FA 0 101.28 CHOICE OF LAW . The terms of this Agreement shall be interpreted according to the laws of the State of California. The City has interviewed five consultants. In this step, the City has selected a few consultants from the interview process to submit a cost proposal; revised technical proposal, and schedule for the work. 100 GENERAL REQUIREMENTS OF PROPOSAL: 100.1 PROPOSAL CONTENT: The proposal packet shall consist of the following: 1. Proposal Letter 2. City's Scope of Work with optional Work Plan/Technical Description 3. Final List of Key Personnel and their project role 4. Schedule of work 5. "Sealed" Cost Proposal 100.2 FORMAT OF PROPOSAL: The Consultant shall provide 5 copies of each packet of submittals to the City. Upon selection, the Consultant shall provide any needed copies for reproduction or inclusion into the final consultant agreement. 100.3 COST PROPOSAL: Under a separate sealed enclosure, the Consultant shall provide a "not to exceed" cost for performing all the Work specified in the Scope of Work. The cost proposal shall cover all the services listed in the City provided scope of work and include both an Hourly Breakdown and Cost Breakdowns. The Consultant shall provide the name of each person involved, their hourly rate, the number of hours each individual spent on each task and the computed cost total for each. These breakdowns shall present the same information and format as the sample sheets attached in the appendix. 100.4 WORK PLANITECHNICAL DESCRIPTIONS: The Consultant is encouraged to make any extra minor enhancements to the City Scope of Work that may be of benefit to the City and the Consultant. The Consultant shall explain its reasoning for the modification for improvement to the City of Scope of Work and how it is of benefit to the City. The Consultant should base its cost proposal upon meeting the City Scope of Work as a minimum requirement. The Consultant shall address any problems they envision to be associated with the Work citing specific suggestions for avoiding or solving these problems. The City will, at its sole discretion, incorporate the Consultant's Work Plan/Technical Description into the scope of work for final inclusion into the Consultant Agreement. Major modifications or alternative proposals are covered in the section that follows. 11 0 • 100.4 MODIFICATIONS AND ALTERNATIVE PROPOSALS: The Consultant shall submit its proposal in strict conformity with the requirements of the RFP documents. The proposal shall conform to the requirements contained herein. The Consultant is strongly cautioned to limit exceptions, conditions, limitations or provisions attached to a proposal as they may be determined significant enough to cause its rejection. The Consultant submitting a conforming proposal may also submit alternate proposals as complete SEPARATE offers in addition to the requested proposal, if the alternate proposals offer major technical improvements or modifications that are to the overall benefit of the City. City Engineering Staff reserves the right to accept or reject any alternate proposal. Said alternate proposals shall meet include a proposals letter, alternate scope of work, discussion of methodology, key personnel, summary of City benefits, sealed cost proposal, and schedule. Oral, telegraphic or telephonic proposals or modifications will not be considered. 100.5 DIRECT EXPENSES: It is expected that the Consultant has extensive knowledge and experience performing this type of work. The Consultant shall prepare a not to exceed budget for direct expenses and breakdown costs for services such as copying, blue prints, computer time, reproduction, delivery, and any other foreseeable expense not covered in the Consultant's hourly rates. Therefore, the Consultant shall receive no additional compensation beyond that which is detailed in their budget. The City will not pay for mileage charges from the Consultant's office to the City. 100.6 SCHEDULE: The Consultant shall provide a schedule (bar chart and CPM /PERT diagram) with milestones for each task included in the scope of work. 100.7 INSURANCE: The Consultant shall obtain a minimum of $1,000,000 worth of professional error and omissions insurance prior to entering into an agreement with the City. The insurance requirement is non- negotiable. 100.8 ACCEPTANCE OF TERMS: Submission of a proposal pursuant to the RFP shall constitute acknowledgment and acceptance of all terms and conditions hereinafter set forth in the RFP unless otherwise expressly stated in the proposals. 100.9 SIGNING OF PROPOSAL/AUTHORIZATION TO NEGOTIATE: The Consultant shall have an authorized officer of its company executes each proposal submitted. In addition, the Consultant must identify those persons authorized to negotiate on its behalf with the City in connection with this RFP. Submission of Proposal /Period of Acceptance: Each proposal submitted by the Consultant shall be delivered to the City at the address shown herein up to the date and time shown therein. It is the Consultant's sole responsibility to assure that its proposal is received as stipulated. In compliance with this RFP, the Consultant agrees 12 • • to provide the services at the costs stipulated therein of its proposal if accepted with 120 days from the date specified in this RFP for receipt of proposals. 100.10 FINANCIAL RESPONSIBILITY: The Consultant understands and agrees that the City will have no financial responsibility for any costs incurred by the Consultant in responding to this RFP. 100.11 AWARD OF CONTRACT: The Consultant to whom the contract is awarded shall be required to enter into a written contract with the City in a form approved by the City Attorney. This RFP and proposal, or any part thereof, may be incorporated into and made a part of the final contract; however, the City reserves the right to further negotiate the terms and conditions of the contract with the selected proposer. The contract, in any event, will include a maximum "fixed cost" to the City. 200 GENERAL REQUIREMENTS FOR THE SCOPE OF WORK 200.1 EXAMINATION OF RFP /RFQ DOCUMENTS: The Consultant shall be solely responsible for examining the City's RFP /RFQ documents, including any addenda issued, and for informing itself with respect to any and all conditions which may in any way affect the amount or nature of the proposal, or the performance of the Services in the event the Consultant is selected. No relief for error or omission will be given. 200.3 E MAIL: The Consultant shall supply the City with individual Internet E — mail addresses for each of the project managers and principals involved in the project and other consultant personnel as the City deems necessary. 200.4 INVOICES: The Consultant shall submit not more than one invoice a month and shall obtain a copy of the accounts payable schedule. The invoice will be in a format that is acceptable to City Engineering Staff and shall detail individual personnel who worked on the project, specific tasks performed, hours worked, billing rate, total costs, and previous billing history, percentage of work completed, percentage of dollars spent. The Consultant shall prepare invoices that show costs against each major milestone task. The Consultant shall notify the City when the cumulative compensation payable under this Contract has reached 75% of the Contract not to exceed price. If at any time the Consultant has reason to believe that the total cost to the Authority for the performance of this Contract will be greater or substantially less that the Contract not to exceed price, the Consultant shall notify the Consultant in writing to that effect and give its revised estimate of the total cost for the performance of this Contract. The notice shall state the estimated amount of additional funds required to continue performance for the remainder of the contract term. In no event is the Consultant authorized to exceed the "not to exceed price" without prior written approval from the City. 13 • 0 200.5 COMPUTER FILES: The Consultant shall supply the City with a digital and editable copy of all files that are included in the hard copy of the report. The Consultant shall use or transfer into the following formats: Word Processing: Microsoft Word 97, Spreadsheets: Excel 97, Databases: Filemaker Pro, Microsoft Access, GIS: ArcView, Drawings: Autocad 13. If the Consultant wishes to use another program that would increase productivity, the Consultant will provide the City a licensed copy or transfer into a format that is acceptable to City Engineering Staff. All digital files shall be submitted on a "zip disk." The City shall have the right to use, duplicate, modify or disclose the technical data and the information contained 200.6 KEY PERSONNEL: The Consultant shall not reassign any personnel mentioned in the RFQ /Interview process unless under extraordinary circumstances. The Consultant shall secure the prior written approval the City for any change or reassignment of the key personnel, submitting written documentation of the new individual's qualification. The Consultant's project manager shall supervise and direct the services, and have overall responsibility for the services in accordance with the Consultant agreement and Scope of Work. The Consultant shall be solely responsible for implementation of all services, means, methods, techniques, sequences, and procedures and for coordination of all portions of the services. All workers shall have sufficient skill and experience to perform the work assigned to them. The City shall have the right, in its absolute discretion to require the removal of the Consultant's personnel at any level assigned to the performance of the Services at no additional fee to the City, if the City considers such removal necessary and in its best interest and request such removal in writing. Further, an employee who is dismissed for any of the above reasons shall not be re- employed on this Contract. 200.7 UNAUTHORIZED WORK: Any services not required by the terms of the final scope of work or proposal that are performed without written authority from the City, will be considered as unauthorized and at the sole expense of the Consultant. Services so performed will not be paid for, and no extension in the period of performance shall be granted on account thereof. 200.8 AUDITS: The Consultant shall keep and maintain full and complete records and books of account of its costs and expenses relating to the performance of the Services, in accordance with generally accepted accounting practices. Such records and accounts shall permit the Consultant to furnish the City, upon written notice, an accurate written allocation of the costs to the various elements of the Services, as may be required by the Authority. Upon reasonable advance written notice the City or its representatives shall have the right to examine, any books, records, accounts, and other documents of the Contractor directly pertaining to costs when such costs are the 14 basis of a claim or of reimbursement to the Consultant hereunder. The Consultant will make reasonable efforts to assure that the any such representative is not a competitor of the Contractor to which the disclosure of such cost information would have a detrimental effect on the Consultant's business. The Consultant shall keep and preserve all such books, records, accounts, and other documents for a period of at least three years from after completion of the Services after Final Payment or if this Contract is terminated in whole or in part after the final termination agreement. 200.9 CONSULTANT'S INTERACTION WITH MEDIA AND THE PUBLIC: The Consultant shall refer all inquiries from the news media to the City. If the Consultant receives a complaint from a citizen or the community, the Consultant shall inform the City what action was taken to alleviate the situation. 200.10 SUBCONTRACTORS /SUBCONSULTANT: The City reserves the right of prior approval of all subcontractors and retains the right to request the Consultant -to terminate any subcontractor, for any reason appropriate by the City, by so notifying the Consultant in writing. Should said notification be submitted to the Consultant, it shall terminate said subcontractor immediately. The City shall have no liability to any subcontractor(s) for payment for services under this Contract or other work performed for Contractor. Any subcontract entered into by Consultant under the contract shall duly note that the responsibility for payment for the technical services or any other services performed shall be the sole responsibility of the Consultant. 15 0 0 300 SEWER SYSTEM MASTER PLAN - SCOPE OF WORK TASK 1: ADMINISTRATION AND MANAGEMENT 1.1 PROJECT KICK -OFF MEETING: Within one week after the City's Notice to Proceed, the Consultant shall meet with City Engineering Staff to initiate the Sewer Master Plan Study. The purpose of this meeting will be to establish clear lines of communications, review and revise, if needed, the proposed project schedules and scopes, establish general study guidelines, discuss project parameters and constraints, and obtain background data. 1.2 WORK PLAN: The Consultant will provide a detailed plan for management coordination and quality control to ensure successful and timely completion of the studies. 1.3 STATUS MEETINGS: The Consultant and City Engineering Staff will meet at regular intervals to review the cost and schedule status and progress of the work, as well as anticipated problems and potential solutions 1.4 SCHEDULE AND MILESTONES: The Consultant shall establish review milestones in the project schedule. The Consultant shall submit working and final drafts on all work products in a timely manner to allow for adequate City review and revision. 1.5 PUBLIC MEETINGS: The City may ask the Consultant to attend various public meetings. For budgetary purposes, the Consultant shall expect to attend the following meetings: Public Meeting — Input from residents, Council Meeting — Acceptance by Council of the reports. The Consultant's role will be to answer questions and assist staff as necessary. TASK 2: COLLECTION AND PREPARATION OF INFORMATION OF THE SEWER SYSTEM 2.1 DATA COLLECTION: The Consultant shall be responsible for the researching, gathering and reviewing all available information, including studies, plans, maps and data. Sources may include the City of Seal Beach and the County Sanitation District of Orange (CSDOC). This information shall include: • Existing master plans and rate studies, and their back up data 16 • • Status of the ongoing update to CSDOC's Master Plan as it relates to district 3 and the City of Seal Beach • Status of CSDOC's "Rehabilitation of Outlying Pump Stations" project as it relates to the West Side Pump Station and Seal Beach Pump Station • Latest zoning maps, general plan, redevelopment plans, land use map and their updates in the study area including areas outside the City boundaries that are tributary to the City's sewer system • Existing Atlas sheets of the City's sewer system and as -built plans to obtain manhole locations, invert elevations, pipe lengths, pipe materials, .pipe diameters, and slopes • Construction Plans and maintenance records for the sewer pump stations and forcemains • Available historical flow data from Orange County Sanitation Distirct's trunk sewers, for dry and wet weather periods • Electric Meter records for the pump stations • Service Charge data and its basis • Sewer collection system maintenance records • Any existing tapes of televised sewers. The City may be able to perform "videoing" upon request. The Consultant may propose a firm to video sites where necessary. • Rainfall data from County, water table contour plans and drainage maps showing surface runoff flow patterns • Inflow /infiltration Studies • Water meter records for large water users (except agriculture) to estimate large point discharges • Other master plans as their recommended facilities may affect the type and location of the necessary sewer improvements. • Purchase of Recent Aerial photographs of the Study areas 2.2 MAINTENANCE STAFF INTERVIEWS: The Consultant shall interview the City's maintenance staff to better understand the sewer system condition, maintenance methods and particular problem areas. The Consultant shall submit a letter report summarizing its findings from these interviews. 2.3 FIELD REVIEWS: The Consultant shall perform a field review of all the existing pump stations and other facilities. During this review, the Consultant shall verify the as- built information including manholes, flow rates, pipe conditions and develop a general assessment condition of each pump station. The review shall cover the electrical service and equipment for their compliance with electrical codes and standards, control 17 91 0 equipment, telemetry, mechanical equipment, structures, emergency power and service, odor and safety. 2.4 INVENTORY AND DATABASE: The Consultant shall enter into a database all available information from the sewer atlas sheets, as -built plans, and pump station construction plans /maintenance records. The database configuration must be acceptable to City Engineering Staff so that all appropriate information is extracted. The Consultant shall submit this database in accordance with the digital formatting requirements specified in this scope of work. 2.5 SEWER ATLAS: The City will supply the consultant a base map. From the Consultant created database, the Consultant shall prepare a comprehensive sewer atlas map in digital format in an approved and appropriate layering scheme. The map shall include manholes with identification numbers, invert elevations, gravity sewers with size, slope, flow rate, peak flow, flow direction, pipe materials, pump stations with wet well invert, influent sewer invert, high and low pumping levels, pump impeller elevation, discharge pipe elevations, forcemain sizes, elevations, forcemain pipe materials, appurtenances, street right of way and names, sewer easements and dimensions. The Consultant shall ensure through quality control that this sewer system information that will be utilized in the studies is accurate. The Consultant shall submit a letter report summarizing this task and its conclusions to the City. The Consultant shall submit this base map in accordance with the digital formatting requirements specified in this scope of work. TASK 3: ANALYSIS OF THE SEWER SYSTEM 3.1 CRITERIA: Based upon the Information Collection Phase, the Consultant shall prepare and submit a set of study criteria. The criteria shall include methods of estimating peak flows, gravity sewer pipe criteria with respect to velocity and depth to diameter ratios, recommendations for flow measurements, unit flow factors for the various land uses, flow peaking relationships, recommendations for inflow /infiltration studies, allowances for inflow and infiltration, pump station capacity, individual pump capacities, redundancies, wet well sizing, forcemain sizing, materials and operation, and general useful life spans as guidelines in planning for facility replacements and rehabilitations. It may be necessary for the Consultant to use different set of criteria for existing facilities and replacement/new facilities. For example, an existing sewer, which does not provide adequate self - cleaning velocity or depth to diameter ratio, may not be recommended for immediate replacement. Life cycle maintenance costs for the sewer with less than self - cleaning velocities would need to be compared to the cost of 18 C� • replacement/additional pumping as well as availability of funding prior to a recommendation for replacement. The City will review the criteria and the Consultant will then further refine and finalize. The Consultant shall submit a letter report documenting the task. Upon approval, the Consultant shall use the criteria to assess the adequacy of the existing system. The Consultant shall review the commercially available sewer system modeling programs, listing both the advantages and disadvantages. The City with the Consultant shall jointly select the program to be used in the City. 3.2 DEVELOPMENT OF UNIT FLOW FACTORS: The Consultant will use the various research performed in the data collection phase (water meter records, flow records at pumping stations, City census data, aerial photos, field verification) to develop unit flow factors for various land uses within the City. The Consultant will identify single and multi — family residential, commercial, industrial, public, and open space areas to develop flow. The Consultant may use CSDOC generated unit flow factors as the initial basis for developing flow factors. If adequate, the Consultant may estimate using 70% of the water meter totals to obtain an initial estimate of the sewage flows for the various land uses. These flows can be assigned to the trunk sewers to which they are tributary in the City and compared against flow records or the receiving pump stations. These unit flow factors may then be adjusted to match the calculated and observed flows at the pumping facilities. 3.3 FLOW MONITORING: If flow records are not adequate at the City's and CSDOC pumping stations, the Consultant shall set up a flow monitoring program at strategic manhole locations to allow the unit flow factors to be calculated accurately. 3.4 INFLOW AND INFILTRATION: The Consultant shall compare historic and seasonal ground water levels against sewer invert elevations and the year of construction to identify possible reaches of high infiltration. The Consultant shall identify inflow potential at reaches where manholes are located in the vicinity of gutters and other flow paths of storm /irrigation factors. 3.6 HYDRAULIC MODEL DEVELOPMENT: The Consultant shall propose what software (SANSYS, HYDRA, etc... ) it expects to use to develop the hydraulic model for the City's Sewer Collection System. The final selection of the software program will be contingent upon acceptance by the City. The software shall have a built -in utility that can readily translate data to CAD systems for plotting. The Consultant shall translate its data into to a database program, giving the City the option of developing this model into its GIS system at a future date. 3.6 SEWER SYSTEM ANALYSIS: Based upon the Hydraulic Model, the Consultant shall perform an analysis for the ultimate land use based on the built -out condition of 19 • 0 the present General Plan and appropriate Specific Plans. The ultimate master plan shall include facilities that will solve existing and future deficiencies in the collection system, pump stations and forcemains, and will extend the system to service future developments. The Consultant shall evaluate potential solutions to relieve deficiencies in the system. These shall include diversion of flow to relieve and /or bypass deficient segments, sewer replacement with larger pipes, and providing parallel sewers to carry excess flows. Selection of the most viable solutions will maximize the use of the existing system capacity. The evaluation shall be based upon a number of factors including cost effectiveness based on construction, upgrade, replacement, operations and maintenance costs, level of deficiency for existing and ultimate conditions, existing conditions and remaining useful life of the existing facilities. 3.7 PUMP STATION EVALUATION: The Consultant shall evaluate all the City's sewer pump stations using the information gathered during the Information Collection phase. The Consultant shall consider at a minimum the following in its evaluation: pump station condition and age, conformance with applicable codes and regulations, access, provisions for stand -by power, pump operation and efficiency, wet well capacity, odors, noise, maintenance considerations, forcemain age, condition and size, pump control system, telemetry system, and safety. The Consultant shall make recommendations for upgrades to the pump stations and include in its Improvement Program. The Consultant shall ensure quality control to ascertain that all analyses and evaluations conducted are cost effective and based on both sound principles and established criteria. 3.8 ALTERNATIVE DEVELOPMENT SCENARIOS: The City may require additional model runs incorporating alternative development scenarios. The Consultant shall evaluate potential impacts to the collection systems caused by the proposed developments. The Consultant shall submit letter reports addressing each alternative scenario. 20 • • TASK 4: IMPROVEMENT PROGRAM /COST ESTIMATES 4.1 PROJECT COST ESTIMATES: The Consultant shall generate quantity take -offs and cost estimates for all the proposed facility improvements. The cost estimates shall include construction, contingencies, engineering, administration and inspection. The Consultant should tie the unit prices to a cost index (i.e. Engineering News Record's Construction Cost Index) so it is in a format that can be easily update or revised. The Consultant shall also incorporate its knowledge of similar costs for projects in the Southern Californian Region. 4.2 OPERATIONAL AND MAINTENANCE COST ESTIMATES: The Consultant shall develop operational and maintenance cost estimates for the existing facilities from interviews with City Staff and review of maintenance records. These costs need to be extended to the ultimate accounting for additional facility length and capacities. 4.3 CAPITAL IMPROVEMENT PROGRAM: The Consultant shall formulate and submit a Capital Improvement Program based upon the results of the studies undertaken. Based upon funding sources available, the Consultant shall prepare a 5 and /or 10 year program. Assuming full built out of the General Plan (ultimate condition) to occur in the next twenty years, a rate and pattern of development will be project based on input provided by the City's planning department. Currently, the City is 98% built — out and the Naval Weapons Station is not part of this analysis. The Hellman and Bixby developments are two major ongoing development projects. If these two projects are approved, the City will be essentially built — out. Based on the development projections and the facilities identified to serve further developments, if any, the Consultant shall develop a separate CIP for facilities that serve future developments. The CIP will include prioritization of the recommended improvements and an implementation plan in 5 year intervals. TASK 5 FINANCING /FEE STRATEGY 5.1 FEE STRATEGY: The Consultant shall evaluate cash flow needs to implement the Capital Improvement program. The Consultant shall review the existing fee structure to determine if a rate increase is necessary. The Consultant shall examine alternative financing mechanisms and make recommendations. TASK 6 FINAL REPORTMORK PRODUCTS 6.1 MASTER PLAN MAP: The Consultant shall use the previously prepared sewer atlas map as a base. The Consultant shall prepare overlays on separate layers of 21 • • recommended master plan facilities with sizes, project identity, and priority numbers, land base data and tributary sub -area delineations. Projects recommended for implementation in each of the 5 -year period intervals shall be clearly identified using color codes. Existing facilities shall be differentiated with dashed lines or other approved scheme. The purpose of digitizing the Sewer Base Map with existing system data and the Master Plan Map with the recommended facility data on the same land base but using different layers for each type of information, is to have the flexibility to control the scale, size, color and amount of information plotted on any specific map for clarity and usefulness for office use or public presentation. 6.2 REPORT: The Consultant shall prepare three copies of the draft Sewer Master Plan Report summarizing all the work, findings, assumptions, criteria, conclusions, recommendations, maps and data described in previous tasks. The Consultant shall submit the draft report for the City's review and comment. As letter reports on the Study will have been prepared, reviewed and approved, compilation of the Final Master Plan Report should be a relatively straightforward process. Comments received shall be reviewed and discussed with City Engineering Staff, and incorporated in the Final Report. The Consultant shall employ an extensive quality control review of the report prior to submittal of the report to the City. All analyses shall be included in a separate technical appendix. The Consultant shall submit fifteen copies of the final report along with all the mounted color exhibits of the existing and ultimate sewer facilities, and digital data files. The final report shall be bound in a separate volume from the model analysis and technical data. The Final report shall include the following: Executive Summary Introduction and History Study Area Criteria System Analysis CIP Program Colored Exhibits: Location Map City Limits and Study Area Map Land Use Map Areas Served by City Wastewater System 22 • • Existing Trunk Systems and Pump Stations Wastewater Drainage Regions Individual Drainage Regions w /Sewer lines and Pump Stations Recommended CIP Projects 6.3 SUBCONTRACTS /OTHER MISC WORK: It is the intent of the City to have operational GIS system that incorporates the results of both Master Plans for future planning, maintenance, and analysis of its infrastructure. The City is obtaining the Intergraph base map from Orange County and it will be converted into an Arc View 3.0 Format. Although the City is not having AKM perform the GIS component, the layering and drawings for the Master Plan will be compatible for ease of transfer into Arc View. The Consultant may also be required to purchase specific software for this project. Upon written notice from the Engineering Division, the Consultant shall purchase requested software /hardware at no additional markup costs. The Consultant proposes to use ADS Environmental Services for the videotaping of sewers in the Seal Beach Collection System. The need for this service will be determined after available information has been collected and interviews with Staff performed. The per foot unit price for this service is $4.25 (based on a minimum of 1,000 linear feet). The City reserves the right to have the Consultant use its video camera should that be in the best interests of the City. The Consultant proposes to use ADS Environmental for flow monitoring. The Consultant shall recommend the need for such services after all the available flow information has been collected and analyzed. A two week monitoring period at each chosen site has been recommended by the Consultant to ensure that an accurate representation of tributary flows are collected. The per unit site price for this service is $3,500. 6.4 SYSTEM INSTALLATION AND TRAINING: Upon finalization of the hydraulic modeling and analysis, the Consultant shall procure and install a fully documented copy of the sewer modeling software and tutorial package licensed to the City along with the system data. The Consultant shall perform trial runs of the model to confirm full compatibility with the City's computer system. The Consultant shall perform a workshop to train the City staff in the application of the program and in working with the model system files. The workshop will consist of four 2 -hour sessions or other approved schedule. Sources may include the City of Seal, County of Orange, County of Los Angeles, Corps of Engineers, and Caltrans). This information shall include: • Previous drainage studies, project reports 24 • • • Latest zoning maps, general plan, redevelopment plans, land use map and their updates in the study area. • Record drawings for existing storm drains including facility type, size, slope, elevations, year constructed. • Construction Plans and maintenance records for existing pump stations • Drainage plans for the San Diego and San Gabriel River Freeways • Electric Meter records for the pump stations • Any existing tapes of televised drains. The City may be able to perform °videoing" upon request. Other physical inspection reports. • Recent Aerial photographs of the Study areas As part of the inventory effort, the Consultant shall perform field reconnaissance to confirm the location of existing drainage facilities, as well as to confirm watershed and drainage boundaries and pump station appurtenances. 2.2 MAINTENANCE STAFF INTERVIEWS: The Consultant shall interview City and County maintenance staff to better understand the system condition, maintenance methods, pump station operation and particular problem areas. The Consultant shall submit a letter report summarizing its findings from these interviews. 2.3 FIELD REVIEWS: The Consultant shall perform a field review of all the existing pump stations and other facilities. During this review, the Consultant shall verify the as- built information and develop a. general assessment condition of the pump station. The review shall cover the electrical service and equipment for their compliance with electrical codes and standards, control equipment, mechanical equipment, structures, emergency power and service, and safety. 2.4 INVENTORY AND DATABASE: The Consultant shall enter into a database all available information from the storm drain reference sheet, as -built plans, and pump station construction plans /maintenance records. The database configuration must be acceptable to City Engineering Staff so that all appropriate information is extracted. The Consultant shall submit this database in accordance with the digital formatting requirements specified in this scope of work. 2.5 PRELIMINARY STORM DRAIN MASTER PLAN MAP: The City will supply the consultant a base map. From the Consultant created database, the Consultant shall prepare a comprehensive sewer atlas map in digital format in an approved and appropriate layering scheme. The map shall include location, size and flow direction of the existing storm drain facilities, land use and soil classification, flow concentration points, street flow direction. 25 0 • The Consultant shall ensure through quality control that this sewer system information that will be utilized in the studies is accurate. The Consultant shall submit a letter report summarizing this task and its conclusions to the City. The Consultant shall submit this base map in accordance with the digital formatting requirements specified in this scope of work. TASK 3: ANALYSIS OF THE DRAINAGE SYSTEM 3.1 HYDROLOGY: Based upon the data collected in Task 2, the Consultant shall perform the system hydrology and delineate subarea boundaries. All work must be in conformance with the latest Orange County Standards and Procedures. The Consultant shall coordinate with the County through out the Study. The Consultant shall review the hydrologic data for the County facilities, including the soon to be completed Los Alamitos Channel Project report, to ensure that drainage boundaries are the same as being used for the City's study. The Consultant shall analyze the Seal Beach Storm Drain (COOP02). This drains part of Seal Beach north of PCH, west of Seal Beach Boulevard, south of Catalina/Driftwood and terminates at the Seal Beach Pump Station. The Consultant shall review any drainage studies prepared for the Hellman Ranch development. Although Leisure World drainage system is privately owned, the Consultant shall review, identify, and account for any Leisure world system deficiencies that may affect City facilities. The Consultant shall provide a special quality control review to ensure that the correct tributary area boundaries are used, and that the magnitude of the runoff is reasonable for the corresponding land use, sub area size and slope. 3.2 HYDRAULIC ANALYSIS: The Consultant may use RATOC (Orange County Hydrology Computer program) to perform the analysis. The Consultant may propose the use of another program but it must be acceptable to City Engineering Staff. The program must be capable of generation of 10, 25, and 100 -year peak discharge in conformance with County hydrologic criteria. Hydrologic data should be based on ultimate development conditions. The Consultant shall perform a detailed hydraulic analysis per County criteria to identify deficiencies. The hydraulic analyses shall include hydraulic grade elevations for control. In addition to identifying existing under -sized facilities, the Consultant shall determine where existing systems need to be extended upstream to satisfy the County's flooded width criteria. As part of the hydraulic analysis, the Consultant shall collect hydraulic grade line (HGL) data for the facilities that receives the City drains. The shall include the Montecito 26 0 0 Storm Channel, Bixby Storm Channel, Federal Storm Channel, Bolsa Chica Channel, Los Alamitos Channel and Retarding Basin and the Seal Beach Pump Station (COOPS1). All identified deficiencies shall be denoted graphically as a part of the base map as well as non - graphically in the GIS database. Although the Consultant will not be analyzing all the County's storm drain facilities, the Consultant shall collect information on systems because downstream deficiencies on the County system can affect the methodology and the priority given to an individual City system. For example, the disposition of Bolsa Chica Channel at the San Diego Freeway crossing should be determined to properly analyze the area draining to Bolsa Chica Channel. 3.3 PUMP STATION EVALUATION: The Consultant shall evaluate all the City's drainage pump stations (West Side Pump Station, 1959) using the information gathered during the Information Collection phase. The Consultant shall consider, at a minimum, the following in its evaluation: pump station condition and age, suction side storage, pump capacities, discharge pipes, redundancies, conformance with applicable codes and regulations, access, provisions for stand -by power, pump operation and efficiency, noise, maintenance considerations, condition and size, spare part availability, useful life of its components, pump control system, and safety. The Consultant shall make recommendations for upgrades to the pump stations and include in its Improvement Program. The Consultant shall ensure quality control to ascertain that all analyses and evaluations conducted are cost effective and based on both sound principles and established criteria. 3.4 SYSTEM ALTERNATIVE ANALYSIS: Once the existing system deficiencies have been identified, the Consultant shall formulate the recommended relief /replacements facilities. The Consultant shall take into account existing downstream deficiencies, existing traffic patterns, major utility corridors and the impacts associated with the deficiency, and the status of any storm drain facilities proposed by the County. The Consultant shall initiate discussions on capacity with the County at an early stage to avoid any potential conflicts. The Consultant will identify and evaluate alternative relief facilities using the factors described above. Each recommendation will contain an estimated construction cost and traffic impacts. Based upon funding sources available, the Consultant shall prepare a 5 and /or 10 year program. Assuming full built out of the General Plan (ultimate condition) to occur in the next twenty years, a rate and pattern of development will be project based on input provided by the City's planning department. Currently, the City is 98% built — out and the Naval Weapons Station is not part of this analysis. The Hellman and Bixby developments are two major ongoing development projects. If these two projects are approved, the City will be essentially built — out. Based on the development projections and the facilities identified to serve further developments, if any, the Consultant shall develop a separate CIP for facilities that serve future developments. The CIP will include prioritization of the recommended improvements and an implementation plan in 5 -year intervals. TASK 5 FINANCING /FEE STRATEGY 5.1 FEE STRATEGY: The Consultant shall examine alternative financing mechanisms and make recommendations. 28 0 0 TASK 6 FINAL REPORTMORK PRODUCTS 6.1 MASTER PLAN MAP: The Consultant shall use preliminary map as a base. The Consultant shall prepare overlays on separate layers of recommended master plan facilities with sizes, project identity, and priority numbers. Projects recommended for implementation in each of the 5 -year period intervals shall be clearly identified using color codes. Existing facilities shall be differentiated with dashed lines or other approved scheme. The purpose of digitizing the Master Plan Map with the recommended facility data on the same land base but using different layers for each type of information, is to have the flexibility to control the scale, size, color and amount of information plotted on any specific map for clarity and usefulness for office use or public presentation. 6.2 REPORT: The Consultant shall prepare three copies of the draft Master Plan of Drainage Report summarizing all the work, findings, assumptions, criteria, conclusions, recommendations, maps and data described in previous tasks. The Consultant shall submit the draft report for the City's review and comment. As letter reports on the Study will have been prepared, reviewed and approved, compilation of the Final Master Plan Report should be a relatively straightforward process. Comments received shall be reviewed and discussed with City Engineering Staff, and incorporated in the Final Report. The Consultant shall employ an extensive quality control review of the report prior to submittal of the report to the City. All analyses shall be included in a separate technical appendix. The Consultant shall submit fifteen copies of the final report along with all the mounted color exhibits of the existing and ultimate sewer facilities, and digital data files. The Final report shall include the following: Executive Summary Introduction and History Study Approach, assumption and criteria Existing drainage Facilities Technical Data including results of hydrologic and hydraulic analysis Proposed drainage facilities including recommendations on implementation of BMP's to control stormwater pollution, and detect illegal discharges Prioritized Drainage Improvement Program Colored Exhibits: Location Map Study Area Map Land Use Map P • • Soils Map Existing Watershed /Facilities Map Proposed Facilities Map Storm Drain Service Area Map Hydrology Map The final report shall be bound in a separate volume from the model analysis and technical data. 6.3 SUBCONTRACTS /OTHER MISC WORK: It is the intent of the City to have operational GIS system that incorporates the results of both Master Plans for future planning, maintenance, and analysis of its infrastructure. The City is obtaining the Intergraph base map from Orange County and it will be converted into an Arc View 3.0 Format. Although the City is not having AKM perform the GIS component, the layering and drawings for the Master Plan will be compatible for ease of transfer into Arc View. The Consultant may also be required to purchase specific software for this project. Upon written notice from the Engineering Division, the Consultant shall purchase requested software at no additional markup costs. 6.4 SYSTEM INSTALLATION AND TRAINING: Upon finalization of the hydraulic modeling and analysis, the Consultant shall procure and install a fully documented copy of the hydrologic and hydraulic software and tutorial package licensed to the City along with the system data. The Consultant shall perform trial runs of the model to confirm full compatibility with the City's computer system. The Consultant shall perform a workshop to train the City staff in the application of the program and in working with the model system files. The workshop will consist of four 2 -hour sessions or other approved schedule. The City may require that the initial training session be conducted as the Master Plan analyses are being conducted. 30 FUNDING STUDY SEWER INFRASTRUCTURE IMPROVEMENT PROGRAM SCOPE OF WORK 1. CURRENT FINANCIAL REVIEW: Review existing rate structure, customer classes, water uses and meter records. 2. O & M REVIEW: Review the historical personnel, operations and maintenance, and capital improvement budgets and expenditures. 3. REVENUE REQUIREMENTS: Based upon the Capital Improvement Program developed by the Sewer System Master Plan, and historical personnel, and operations & maintenance expenditures, identify the minimum revenue requirements. Discuss with the City the desirability of establishing a depreciation fund and a reserve. 4. RATE STRUCTURE DEVELOPMENT: Develop a fair and equitable rate structure that will generate the revenue requirements identified in Task 3. This rate structure can have a fixed service charge and a portion based upon water usage, or the entire rate can be based upon estimated inside water usage. The additional cost of service required due to the wastewater produced by certain commercial uses, such as restaurants, can be separated out and accounted for in the rate structure. 5. PUBLIC MEETINGS- INPUT: Hold meetings four with City staff, participate in up to four public meetings/Workshops and meetings with City Council.
