Bahorski, Executive Director FROM: Lee Whittenberg, Director of Development Services SUBJECT: AUTHORIZATION OF CHANGE OF PROPERTY MANAGEMENT FIRM - SEAL BEACH TRAILER PARK SUMMARY OF REQUEST: Adopt Resolution No. , A Resolution of the Seal Beach Redevelopment Agency Consenting to a Change of Property Management Firms for the Seal Beach Trailer Park. BACKGROUND: LINC Housing submitted a request on March 30, 2005 requesting a change in the property management firm at the Seal Beach Trailer Park to Pacific West Management effective May 1, 2005. City staff has reviewed the provisions of the "Regulatory Agreement (Seal Beach Mobilehome Park "), between the Agency and Linc Community Development Corporation, recorded on December 20, 2000 to ensure compliance with the Regulatory Agreement in the requested transfer of property management responsibilities. Article 5 ( "Property Management and Maintenance "), Section 5.1 ( "Management Responsibilities ") states: "The Owner is responsible for all management functions with respect to the Property including, but not limited to, the selection of Resident Households, certification of household size and income, certification of the ages of all household members pursuant to any lawful senior housing requirements, evictions, collection of rents and deposits, maintenance, landscaping, routine and extraordinary repairs, replacement of capital items, and security. The Agency shall have no responsibility for or over management of the Property. The Owner shall retain a professional property management company approved by the Agency in its reasonable discretion to perform its management duties hereunder. A resident manager shall also be retained, if required by law. Pacific West Management manages real estate with an estimated value in excess of $1 billion and annual scheduled income of more than $100 million. They are strictly a fee based management firm without competing ownership of interests in the assets they manage. They maintain a regional corporate office in Irvine and currently manage of have managed approximately 90 projects in California, comprising in excess of 16,000 housing units, and ranging in size from 36 to 585 units. Management experience in Orange County is in the cities of Anaheim, Buena Park, Costa Mesa, Fullerton, Garden Grove, Huntington Beach La Habra, and Santa Ana. They also manage properties in Arizona, Colorado, Louisiana, Oklahoma, Texas, and Washington. A copy of the agreement transmittal letter from LINC Housing and background information provided by LINC on Pacific Management West is provided as Attachment 2. Based on a review of the documentation provided, it is recommended that the requested change of the property management firm for the Seal Beach Trailer Park be approved through the adoption of Redevelopment Agency Resolution No. , A Resolution of the Seal Beach Redevelopment Agency Consenting to a Change of Property Management Firms for the Seal Beach Trailer Park FISCAL IMPACT: No impacts to the Agency. As indicated within Section 5.1 of the Regulatory Agreement between the Agency and Linc, "The Agency shall have no responsibility for or over management of the Property." A RESOLUTION OF THE SEAL BEACH REDEVELOPMENT AGENCY CONSENTING TO A CHANGE OF PROPERTY MANAGEMENT FIRMS FOR THE SEAL BEACH TRAILER PARK The Redevelopment Agency of the City of Seal Beach hereby resolves as follows: SECTION 1. The Redevelopment Agency hereby approves the requested change in property management firms to Pacific West Management in accordance with the provisions of Article 5, Section 5.1 of the "Regulatory Agreement (Seal Beach Mobilehome Park) ", between the Agency and LINC Community Development Corporation, recorded on December 20, 2000. SECTION 2. The Agency hereby directs the Chairman of the Redevelopment Agency to execute as "Authorized Signatory" on the letter request from LINC Housing, dated March 30, 2005. SECTION 3. The City Clerk shall certify to the passage and adoption of this resolution.
