DISCUSSION NEGATIVE DECLARATION - HFI.I.MAN RANCH TANK FARM RF.PI.ACFMFNT PROGRAM: Prnjert Overview: Prnposerl Hellman Ranch Tank Farm (T-TRTF) I.nration• The proposed location for the Hellman Ranch Tank Farm Replacement Program site is located in the central portion of the mineral production area on approximately .53 acres approximately 2,500 feet easterly of the east levee of the San Gabriel River, approximately 1,200 feet westerly of Seal Beach Boulevard, and approximately 1,200 feet northerly of existing residences along Crestview Drive in the City of Seal Beach. (Please see Figure 9 of Initial Study/Mitigated Negative Declaration 05 -1). This relocation will allow consolidation of facilities in this area of the property with other existing tanks, pumping units, pipelines and access roads. It will also allow for the existing tank farm area to be made available for acquisition for wetland restoration and open space purposes, once use of that area for oil production is terminated. The project will also entail the construction of about 1,800 linear feet of new pipeline and the abandonment of about 4,300 linear feet of existing pipeline. Existing Hellman Ranch Tank Farm and Mineral Production Operations. The existing HRTF site is located easterly of the east levee of the San Gabriel River, northerly of Pacific Coast Highway in the City of Seal Beach. Seal Beach is located in the northwest portion of the County of Orange. A "Regional Map" is provided as Figure 1 of the Mitigated Negative Declaration. Hellman Properties LLC owns and operates a mineral production facility on the Hellman Ranch in Seal Beach, California. A Project Area map is provided as Figure 2 of the Mitigated Negative Declaration. This facility has been in operation since the 1930's and consists of over 60 wells, oil and gas pipelines, offices, storage facilities, and a tank farm. The existing HRTF is approximately 60 years old and is in need of on -going maintenance. A replacement and relocation program is proposed rather than continuing maintenance and repair of the existing, older and less efficient facilities. Both the existing and proposed HRTF's are located within the Coastal Zone. The existing HRTF is on a 1.6 -acre site located in the southwest portion of the Hellman Ranch oil production property near the Haynes Cooling Channel, existing wetlands and adjacent to the 100 -acre area reserved for wetland restoration and open space. A map indicating the Existing Oil Facilities is provided as Figure 3 of the Mitigated Negative Declaration. The replacement HRTF will be located on a 0.53 -acre site in the central portion of the oil production area, further from sensitive resource areas and consolidated with several existing facilities, including pumping units, tanks, pipelines and access roads. (See Figure 9 of the Mitigated Negative Declaration) Deconstruction of the existing HRTF facilities and any necessary remediation of the existing HRTF site will occur when the site is redeveloped for its ultimate open space use. Hellman Tank Farm Neg Dec.CC Staff Report 2 Adoption of Negative Declaration — Hellman Ranch Tank Farm Replacement Program City Council Staff Report April 11, 2005 Existing General Plan, Zoning and Other Land Use Regulations • A. City of Seal Rearh• The Hellman Ranch property is zoned S.P.R. (Specific Plan Regulation). The Hellman Ranch Specific Plan (HRSP) was adopted by the City in October 1997. The HRSP provides for mineral production uses on portions of the property. The existing and replacement tank farm facilities are located in Planning Area 9. Permitted land uses identified in the HRSP in Section 7.4.4, Development Planning Area 9, include the following: ❑ Drilling operations for the extraction, processing and transport of oil, gas or other mineral substances ❑ Separation centers for oil and gas ❑ Storage tanks and related facilities ❑ Maintenance and operations yards in conjunction with mineral production ❑ Administrative offices ❑ All facilities and equipment required for oil, gas and hydrocarbon production Therefore, the replacement tank farm proposed for Planning Area 9 is consistent with the land use regulations of the HRSP. The HRSP was previously analyzed for compliance under the California Environmental Quality Act (CEQA) through the Final Environmental Impact Report (FEIR) for the HRSP, certified through City Council Resolution 4562. The FEIR for the HRSP did not analyze the replacement of the existing tank farm. Please Note that there are no discretionary land use entitlements required for this project, so there will no public hearing on a project application considered by either the Planning Commission or City Council, only review and ultimate approval of the Mitigated Negative Declaration 05 -1 by the City Council. B. County of Or ng r The property is within the jurisdiction of the Orange County Fire Authority (OCFA). The OCFA regulates combustible materials in Seal Beach. All required permits from the OCFA have been issued which allows the installation, construction, alteration and operation of oil and gas processing facilities. State. of California — Coastal Commission and Division of nil and Gas. California Coastal Commission • The Hellman Ranch is located within the coastal zone as determined in accordance with California Coastal Act, Section 30103 and is subject to the jurisdiction of the California Coastal Commission (CCC). Sections 30260 and 30262 of the Coastal Act encourage and allow oil and gas development. Section 30260 states, in relevant part that: "Coastal- dependent industrial facilities shall be encouraged to locate or expand within existing sites and shall be permitted reasonable long -term growth where consistent with this division." Section 30262 states, in relevant part that: "Oil and gas development shall be permitted in accordance with Section 30260 if development is performed safely and consistent with the geologic conditions of the site.... and if the facilities are consolidated to the maximum extent feasible." Additionally, the CCC approved Hellman Ranch Coastal Development Permit 5-97-367 - Al on October 11, 2000. This approval included residential and open space land uses as well as grading and the subdivision of land. There were a number of special conditions associated with the approval. Special Condition 28 specifically relates to the mineral production property in the lowlands, where the tank farm replacement project is located. Special Condition 28 requires that once oil production ceases on the property the area needs to be reserved for public acquisition and wetland restoration/open space uses for a period of 25 years. This condition does not restrict maintenance, replacement of facilities, new facilities or in any way prohibit the continuing business of mineral production activities on the property. By consolidating the facilities in the central portion of the property, the property now occupied by the existing tank farm can be available for open space and restoration purposes. California Division of Oil and Gas • The State of California Division of Oil and Gas does not regulate the construction and operation of tanks and equipment for tank farm use. R egional Agpnnies• All facilities with a vapor recovery system including the production tanks, wash tanks, Wemco unit, etc., require a permit from the South Coast Air Quality Management District (SCAQMD). Permits for existing facilities from the SCAQMD are in place and new permits will be obtained for the replacement facilities prior to operation. Summary of Negative neelaratinn Preparation and Puhlir RPView Prnress The Negative Declaration for the Hellman Ranch Tank Farm Replacement Program has been prepared by city staff and has completed the required 30- day time period for receipt of comments. Comments were received by the City from January 14 to February 14, 2005, in accordance with the provisions of the California Environmental Quality Act. A copy of the subject document has previously been provided for the information of the City Council. The Initial Study, proposed Negative Declaration, and required public notices are on file at the Department of Development Services. The Initial Study/Mitigated Negative Declaration was distributed for review and comment to the following agencies and organizations: ❑ State of California Office of Planning and Research ❑ County of Orange — County Clerk ❑ County of Orange — Public Facilities and Resource Department ❑ City of Long Beach — Planning Department ❑ Regional Water Quality Control Board — Santa Ana Region ❑ South Coast Air Quality Management District ❑ Army Corps of Engineers — Los Angeles District ❑ California Department of Fish & Game — Region 5 ❑ U.S. Fish and Wildlife Service ❑ Los Angeles County Flood Control District ❑ California Coastal Commission — South Coast Region ❑ Orange County Sanitation District ❑ Caltrans District 12 ❑ Seal Beach Country Club Apartments ❑ Gabrielino/Tongva Tribal Council ❑ Gabrielino/Tongva Tribal Council of the Gabrielino Tongva Nation ❑ Gabrielino Tongva Indians of California Hellman Tank Farm Neg Dec.CC Staff Report 5 Adoption ofNegative Declaration — Hellman Ranch Tank Farm Replacement Program City Council Staff Report April 11, 2005 Mailed copies of the Notice of Intent to Adopt a Mitigated Negative Declaration were provided to 82 property owners adjacent to the existing Hellman Ranch Tank Farm property and Gum Grove Nature Park on January 10, 2005. In addition, the Notice of Intent to Adopt a Mitigated Negative Declaration was published in the local newspaper, The Sun, on January 13, 2005. Copies of the Mitigated Negative Declaration were also made available for public review at the Development Services public counter and at each library within the City. The City of Seal Beach received 2 comment letters on the Mitigated Negative Declaration from public agencies and also received comments from the Environmental Quality Control Board, the Archaeological Advisory Committee, and the Planning Commission during the public comment period. CEQA section 21091(d)(1) requires that the City, as Lead Agency, must consider any comments on the proposed Mitigated Negative Declaration that are received within the public review period. The City also received a comment letter from the State of California Department of Toxic Substances Control on March 3, 2005, after the close of the public comment period on February 14, 2005. Although CEQA does not require Lead Agencies to respond to late comments, the letter and its comments are addressed within the "Responses to Comments" document. Pursuant to CEQA, the Lead Agency is only obligated to respond to comments on an Environmental Impact Report, not for a proposed Mitigated Negative Declaration. However, the City does so voluntarily in order to acknowledge public input and fully address any issues raised. Staff Recommendations regnrding Negative T)eclaratinn 05-1 — Hellman Ranch Tank Farm Replacement Program - The required environmental review process has been completed and the analysis has indicated that the proposed project will not have any significant effects on the environment if the mitigation measures proposed in the IS/MND document are implemented. The California Environmental Quality Act (CEQA) requires that all public agencies establish monitoring and/or reporting procedures for mitigation measures (MMs) adopted as conditions of approval in order to mitigate or avoid significant project impacts. Specifically, Section 21081.6(a)(1) states: "The public agency shall adopt a reporting or monitoring program for the changes made to the project or conditions of project approval, adopted in order to mitigate or avoid significant effects on the environment. The reporting or monitoring program shall be designed to ensure compliance during project implementation." A Mitigation Monitoring and Reporting Program has been prepared in compliance with the requirements of CEQA, and includes all mitigation measures from the Final Initial Study/Mitigated Hellman Tank Farm Neg Dec.CC Staff Report 6 Adoption of Negative Declaration — Hellman Ranch Tank Farm Replacement Program City Council Staff Report April 11, 2005 Negative Declaration addressing the Hellman Ranch Tank Farm Replacement Program. The Mitigation Monitoring and Reporting Program also identifies the required timing and responsible parties for implementation and monitoring. The mitigation measures have been sorted by topical area in the order presented in the IS/MND. A copy of the Mitigation Monitoring and Reporting Program is provided as Attachment 5 for the information of the City Council. Staff recommends the City Council adopt a resolution that will memorialize the following determinations of the Council: ❑ The City Council hereby affirms that it independently reviewed and analyzed Mitigated Negative Declaration 05 -1 and finds as follows: ❑ Initial Study/Mitigated Negative Declaration 05 -1 — Hellman Ranch Tank Farm Replacement Program was prepared by a city staff and therefore reflects the independent judgment of the City; ❑ There is no substantial evidence in the record that would support a fair argument that approval of the project might have a significant environmental impact; ❑ Adoption of the proposed "Mitigation Monitoring and Reporting Program ", dated April 2005 as conditions of approval for the proposed project will mitigate or avoid significant project impacts. ❑ Approval of this project involves no potential for adverse effects, either individually or cumulatively, on wildlife resources and will not have an adverse impact on fish and wildlife. The project consists of the constructing new tank farm facilities within Hellman Ranch in a location with no existing sensitive vegetation or wildlife, and has no impact on wildlife resources, since there are no identified wildlife resources on or adjacent to the site. The City Council directs the Director of Development Services to file the appropriate De Minimis Impact Finding for the California Department of Fish and Game Certificate of Fee Exemption. ❑ The City Council approves the "Notice of Determination" and "California Department of Fish and Game Certificate of Fee Exemption" and instructs the Director of Development Services to execute and file these documents in accordance with the provisions of CEQA. Copies of these documents are provided as Attachments 3 and 4, respectively. FISCAL IMPACT None. Approval of Mitigated Negative Declaration 05 -1 will allow this project to proceed to preparation of final construction plans and specifications and eventual construction upon approval by the California Coastal Commission of a Coastal Development Permit and compliance with the adopted Mitigation Monitoring Program. The comment period on the subject Negative Declaration ended on February 14, 2005. On March 3, 2005 the City received a comment letter from the State of California Department of Toxic Substances Control after the close of the public comment period on February 14, 2005. Although CEQA does not require Lead Agencies to respond to late comments, the letter and its comments are addressed within the "Responses to Comments for Initial Study/Mitigated Negative Declaration 05 -1, Hellman Ranch Tank Farm Replacement Program" prepared by City staff and dated April 1, 2005. WHEREAS, the City's staff has prepared a "Responses to Comments for Initial Study/Mitigated Negative Declaration 05 -1, Hellman Ranch Tank Farm Replacement Program ", dated April 1, 2005 document that includes written responses to all of the above - received comments on the subject Initial Study/Mitigated Negative Declaration. A copy of that document was provided for the information of the City Council; and WHEREAS, the City Council considered the adoption of the subject Mitigated Negative Declaration 05 -1, Hellman Ranch Tank Farm Replacement Program Mitigation Monitoring and Reporting Program, and Responses to Comments documents, along with a Staff Report on April 11, 2005, and received additional public comments; and WHEREAS, the City has addressed each of these concerns within the Initial Study/Negative Declaration document. Moreover, although CEQA does not require responses to comments made concerning a negative declaration, the City responded in writing to comments received, in the "Responses to Comments for Initial Study/Mitigated Negative Declaration 05 -1, Hellman Ranch Tank Farm Replacement Program" document dated April 1, 2005. NOW, THEREFORE BE IT RESOLVED, that the City Council hereby: 1. Finds that there is substantial evidence in the record that the project may have a significant effect on the environment, but mitigation measures imposed herein would avoid or mitigate the effects to a point where clearly no significant effect would occur and there is no substantial evidence in the record that any significant effect would remain after mitigation. Finds that there has been no evidence presented that Mitigated Negative Declaration 05 -1 has been "substantially revised" so as to require recirculation under the California Environmental Quality Act. 3. Adopts Mitigated Negative Declaration 05 -1 — Hellman Ranch Tank Farm Replacement Program. 4. Approves and adopts as conditions of approval the Mitigation Measures set forth in "Exhibit A" of this resolution for the Hellman Ranch Tank Farm Replacement Program. 5. Determines that approval of this project involves no potential for adverse effects, either individually or cumulatively, on wildlife resources and will not have an adverse impact on fish and wildlife. The project consists of the relocation of existing tank farm facilities within Hellman Ranch to a location in the central portion of the mineral production area on approximately .53 acres or 23,045 square feet, and will contain the same basic structural components as the existing tank farm location to an area identified within the Initial Study/Mitigated Negative Declaration 05 -1 as not impacting existing vegetation or wildlife, and has no impact on wildlife resources, since there are no identified wildlife resources on or adjacent to the site. 6. Finds that the foregoing findings are based on substantial evidence in the record, including without limitation, the draft Mitigated Negative Declaration 05 -1, staff reports and both oral and written testimony. The documents that comprise the record of the proceedings are on file with the Department of Development Services, 211 Eighth Street, Seal Beach. The custodian of said records is the Director of Development Services. 7. Instructs the Director of Development Services to file appropriate documentation with the County of Orange.
