Bahorski, City Manager FROM: Lee Whittenberg, Director of Development Services 0 SUBJECT: APPROVAL OF COMMENT LETTER RE: DRAFT EIS — PROPOSED SITE DESIGNATION OF THE LA -3 OCEAN DREDGED MATERIAL DISPOSAL SITE OFF NEWPORT BAY, ORANGE COUNTY, CALIFORNIA SUMMARY OF REQUEST: Authorize Mayor to sign proposed Comment Letter with any changes deemed appropriate. Receive and File Staff Report. BACKGROUND: The City has received a copy of the "Draft EIS — Proposed Site Designation of the LA -3 Ocean Dredged Material Disposal Site off Newport Bay, Orange County, California', which is in the public comment stage of review. The comment period on the Draft EIS (DEIS) will close at 5:00 PM on March 7, 2005. Staff has previously provided a complete copy of the DEIS for the information of the Environmental Quality Control Board (EQCB) in reviewing the proposed project and draft comment letter. The EQCB reviewed the DEIS and approved a draft comment letter on February 16 and the comment letter is now being considered by the City Council. The draft comment letter is provided as Attachment 1. A copy of the EQCB Staff Report on this matter is provided as Attachment 2 for the information of the City Council. It provides more detailed discussion of the proposed project, the environmental analysis and the concerns being discussed in the comment letter. Summary of Proposed Action, Project Objectives, and Environmental Impacts: Project Summary: Agenda Item Z:\My Documents \CEQA \LA- 3DEIS.CC Staff Report.doc \LW \02 -17-05 Approval of Comment Letter re: Draft DEIS — Proposed Site Designation of the LA -3 Ocean Dredged Material Disposal Site City Council Staff Report February 28, 2005 The project proposes to designate a deep water ocean disposal site located offshore of Newport Beach in Orange County that would supplement an existing ocean disposal site offshore of Los Angeles where dredgers have long disposed of dredged material from Southern California port deepening and maintenance projects. Purpose of and Need for Action: The purpose of the proposed action is to ensure that adequate, environmentally acceptable ocean disposal site capacity is available for suitable dredged material generated in the greater Los Angeles County -Orange County area in conjunction with other management options including upland disposal and beneficial reuse. Summary of Potential Significant Environmental Impacts after Mitigation: The DEIS document does not identify any environmental impacts as significant after the " imposition of mitigation measures. Provided on pages 3 through 5 of the EQCB Staff Report is a summary of the "environmental consequences" of the proposed project from the DEIS Executive Summary: Principal Actions and Approvals Required: The Environmental Protection Agency has identified the following remaining actions to complete for the project to proceed: ❑ California Coastal Act Consistency Determination — California Coastal Commission; ❑ Federal Register Notice of Final EIS and proposed Rule — 45 day comment rule; ❑ Federal Register Final Notice of Rule — 30 day period before rule becomes effective; and ❑ Site designation for LA -3 becomes effective after the 30 -day time from Federal Register Notice of Final Rule if no legal challenge is filed. DEIS Comment Period: The comment period on the DEIS will conclude at 5:00 PM on March 7, 2005. In addition, the DEIS is available at each library within the City. It is not provided with this Staff Report due to its length, 392 pages. The document is also available for review and downloading at www.epa.gov /region9 /water/1a3. Recommended City Action: Staff has prepared a comment letter for consideration of the EQCB on February 16, and the EQCB has approved the letter and forwarded• it for City Council consideration this evening (Refer to Attachment 1). The comment letter focuses on the proposed "Site Monitoring and Management Plan" that is proposed to monitor the long-term environmental consequences of the proposed disposal of ocean dredged material. The letter also requests clarification of information within the document in Section 3.3.4.1. that relate to contaminant levels in edible portions of fish at the request of EQCB Member Hurley. Major Area of Concern Discussed in City Comment Letter: The draft letter concurs with the conclusions reached within the DEIS regarding environmental impacts, based on the information, modeling, and analysis presented within the document. The major area of concern stated in the letter is related to the long -term disposal of ocean dredged material and ensuring that it does not violate the identified water • quality standards. As such, the focus of the proposed comment letter is on the proposed "Site Monitoring and Management Plan" that is provided as Appendix A of the DEIS document. Staff reviewed the "Site Monitoring and Management Plan", attended a public meeting on the Draft EIS on February 9, and discussed the plan with representatives of EPA. It is the opinion of staff that the proposed "Site Monitoring and Management Plan" provides the necessary framework for analysis of future disposal actions to ensure compliance with the appropriate standards and requirements of the permitted activity. Section 3, "Site Monitoring Plan" contains monitoring modules for "Physical/Biological" and "Chemical/Bioeffects" and the proposed tiered monitoring activities appear to be thorough and concise in describing the effects to be monitored and the thresholds that are necessary to be encountered to move from a certain tier of evaluation to the next tier of evaluation. On page 18 of the "Site Monitoring and Management Plan" there is discussion indicating "all sediment testing results for dredged material characterization projects will be entered into the regional sediment quality database being assembled by the Los Angeles Contaminated Sediment Task Force." The proposed project is in close proximity to the City of Seal Beach, and as such has raised concerns regarding environmental impacts upon the nearby ocean environment, in particular the Seal Beach National Wildlife Refuge located in Anaheim Bay and within the confines of the Seal Beach Naval Weapons Station. City of Seal Beach Preference for Alternative # 3 — Local Use of LA -3 and LA -2: The City of Seal Beach supports the implementation of Altemative 3, Local Use of LA -3 and LA -2, and would encourage the U. S. Environmental Protection Agency to select Alternative 3 for final submission to the California Coastal Commission for a Federal Consistency Determination. This alternative will result in establishment of a permanent dredged material site to handle the needs of Orange County that will be jointly managed with the Los Angeles site, a permanent ocean dredged material disposal site designated primarily to handle the dredging needs of Los Angeles County. The existing site offshore of Newport Beach, known as "LA -3" has been used as an interim ocean disposal site 1976; the project proposes the site as permanent. Z. However, assuming-more realistic average annual disposal activities, air quality emissions are not anticipated to be signifrcant for the Preferred Alternative, Local Use of LA -2 and LA -3: We concur with that determination. Support of Proposed "Site Monitoring and A'lanagelllent Plan'; lt'ith Modifications: The City supports the "Site Monitoring and Management Plan" with modifications. It is our opinion that the proposed "Site Monitoring and Management Plan" provides the necessary framework for analysis of future disposal actions to ensure compliance with the appropriate standards and requirements of the pennitted activity. On page 18 of the "Site Monitoring and Management Plan" there is discussion indicating "all sediment testing results for dredged material characterization projects will be entered into the regional sediment quality database being assembled by the Los Angeles Contaminated Sediment Task Force." It is requested that the "Site Monitoring and Management Plan" be revised to include a Section 5.0 on "Public Accountability ". This section would describe how interested citizens and organizations can obtain the documentation proposed within the Plan and provide comments to either EPA or the Army Corps of Engineers on those monitoring reports and on any proposed revisions to the adopted "Site Monitoring and Management Plan ". This action would ensure the future capability of interested parties in reviewing and commenting on the future monitoring programs and any future revisions to the "Site Monitoring and Management Plan" that may be appropriate. • Request for Additional Information in Section 3.3.4.1: On page 3 -78 the document states "Contaminant levels in edible portions of fish are found to be below human health advisory limits," but in the text and on Table 3.3 -8, it is indicated that levels of arsenic, chromium, and selenium meet or exceed FDA and /or MIS health limits at both LA -2 and LA -3. We were unable to find an explanation of the significance (insignificance ?) of the indicated levels and request clarification of the apparent contradiction cited above. The Environrnental Quality Control Board (EQCB) considered and discussed the Draft DEIS document on February 16, 2005. The existing site offshore of Newport Beach, known as "LA -3" has been used as an interim ocean disposal site 1976; the project proposes the site as a permanent alternative. Under the proposed project, the Los Angeles site, known as "LA -2," would increase the amount of materials it receives to 1 million cubic yards per year while limiting the amount at the Orange County site to 2.5 million cubic yards per year. Dredging projects from ports in Southern California -- the largest being Los Angeles /Long Beach -- can generate millions of cubic yards of sediment annually; much of the suitable (nontoxic) material has been reused for area construction projects or habitat restoration. The Orange County site is about 4.5 nautical miles offshore of Newport Beach in roughly 1,500 feet of water. The Los Angeles site is located almost 6 nautical miles offshore of the Los Angeles Harbor in water depths ranging from 360 to 1,100 feet. The Seal Beach Naval Weapons Station is approximately 11.9 nautical miles northeast of the LA -2 site is approximately 16.2 nautical miles northwest of the proposed LA -3 site. Dredged ocean disposal sediments from Anaheim Bay are proposed to be disposed of at the LA -2 site. Dredging maintains safe navigation in harbors and marinas in the Los Angeles County and Orange County region. In order for a dredging project to be authorized to dispose of dredged material, sediment evaluations -- which include physical, chemical, and biological testing — are first evaluated by the EPA and the U.S. Army Corps of Engineers. Under the general sediment management strategy, all dredged material will be evaluated for pollutants, and, if suitable, will then be transported to the approved location(s). To ensure that dredgers are complying with the strategy, the EPA, the Corps of Engineers and others agencies have enforcement authority under the Clean Water Act, the Marine Protection, Research and Sanctuaries Act, and state statutes. Impacts from dredged material disposal operations on water quality and geology are considered insignificant regardless which alternative is chosen. Based on sediment deposition modeling, deposits thicknesses greater than 30 cm (1 ft) will be confined within the LA -2 and proposed LA -3 site boundaries for all alternatives considered. Changes in sediment particle size distribution at LA -2 and LA -3 will likely continue as a result of dredged material disposal. These effects are considered locally not significant. Significant impacts on sediment quality at either of the sites are not expected given that the dredged material proposed for ocean disposal must be tested and determined suitable according to EPA and USACE testing criteria that include specific tests for water column impacts. Biological Environment Impacts to infauna, epifauna, and fishes are anticipated to be temporary and limited to the areas within the boundaries of the disposal sites. Impacts to the benthic community are anticipated to be greatest as a result of smothering of some organisms and alteration of sediment characteristics. However, these impacts are expected to only occur in areas with annual deposition thicknesses equal to or exceeding 30 cm (1 ft). Areas with depositional thicknesses less than 30 cm (1 ft) are not expected to incur significant changes in abundance or diversity of infauna, epifauna, or demersal fishes. As indicated above, deposition thicknesses of 30 cm 3 LA -3 DEIS.EQCB Staff Report Approval of Comment Letter re: Draft DEIS — Proposed Site Designation of the LA -3 Ocean Dredged Material Disposal Site Environmental Quality Control Board Staff Report February 16, 2005 (1 ft) or more are anticipated to be confined within the LA -2 and proposed LA -3 site boundaries for all alternatives. Consequently, impacts to these organisms are not anticipated to be significant. Impacts on water column organisms such as plankton, pelagic fishes, and marine mammals are expected to be minimal, temporary, and limited to the area within the site boundaries. No significant impacts to seabirds are anticipated for any of the alternatives. Furthermore, the exposure of marine organisms and other fauna to dredged material is not expected to result in significant adverse effects given that the dredged material proposed for ocean disposal must be tested and determined suitable according to EPA and USACE testing criteria. Socioeconomic Environment Dredged material disposal activities have occurred at the LA -2 and LA -3 sites since the late 1970s. The continued use of these sites is unlikely to interfere with other ocean uses such as shipping, fishing, and recreation. Effects on commercial and recreational fishing in the vicinity of the LA -2 and LA -3 sites will be temporary and insignificant. Additionally, most disposal impacts will be at the sea bottom and no significant demersal fisheries exist within the LA -2 or proposed LA -3 site boundaries. Potential hazards to commercial, military, and recreational navigation resulting from the transport and disposal of dredged material at the sites are also expected to be insignificant. Vessel traffic in the region is highly regulated and conflicts with disposal barges are anticipated to be minimal. There have been no impacts to commercial, military, or recreational vessel traffic due to the past use and operation of the LA -2 or interim LA -3 sites. As such, no significant impacts to navigation are anticipated with the continued use of these sites. There are no existing or planned oil developments within the LA -2 or proposed LA -3 site boundaries. Consequently, the continued use of these sites for the ocean disposal of dredged material is not anticipated to have an adverse impact on development of these resources. There are no known cultural or historical resources within the LA -2 or LA -3 site boundaries. As such, continued disposal operations at these sites will not adversely impact cultural or historical resources. Potential impacts to human safety would be very small as the number of disposal barge trips, even under worst -case conditions, is small compared to the overall vessel traffic in the region. 4 LA -3 DEIS.EQCB Staff Report Approval of Comment Letter re: Draft DEIS — Proposed Site Designation of the L4-3 Ocean Dredged Material Disposal Site Environmental Quality Control Board Staff Report February 16, 2005 The Preferred Alternative ,would minimize the coastwise disposal barge traffic that could potentially come in contact with existing developed oil facilities. However, such potential conflicts are considered insignificant for all of the alternatives. As stated in the MPRSA, the disposal of materials that are considered hazardous is prohibited at an ODMDS. Furthermore, as mentioned previously, dredged material proposed for ocean disposal will be subject to strict testing requirements established by the EPA and USACE. Material found not to be suitable for ocean disposal will be prohibited from disposal at either LA -2 or LA- 3. Therefore, the potential for human health and safety hazards is minimal and not significant for all of the alternatives." ,Summary of Alternatives: Four alternatives have been identified within the DEIS. They are: El No Action Alternative (Alternative 1) The No Action Alternative would mean that EPA would not designate an appropriate ODMDS for disposal of suitable dredged material from the Newport Harbor area. The interim status designation of the LA -3 site would remain expired prohibiting future disposal at this site. LA -2 would remain available for disposal of suitable dredged material and managed at historical levels evaluated in the original site designation EIS (an average of 200,000 yd3 [153,000 m3] per year). El Maximize Use of LA -2 (Alternative 2) As with the No Action Alternative, under this alternative the EPA would not permanently designate an ODMDS appropriate for disposal of suitable dredged material from the Newport Harbor and Bay area. The interim status designation of LA -3 would remain expired, prohibiting future disposal at this site. ❑ Alternative 3 — Local Use of LA -3 and LA -2 Under Alternative 3, EPA would permanently designate the LA -3 ODMDS with an annual quantity adequate to manage disposal of dredged material generated locally from the Newport Beach and general Orange County area. The existing LA -2 site would be evaluated for a higher maximum annual quantity to manage disposal of dredged material generated primarily from the Los Angeles County region. The document is also available for review and downloading at www.epa.gov /region9 /water/1a3. 6 LA -3 DEIS.EQCB Staff Report Approval of Comment Letter re: • Draft DEIS — Proposed Site Designation of the L4-3 Ocean Dredged Material Disposal Site Environmental Quality Control Board Staff Report February 16, 2005 Recommended City Action: Staff has prepared a comment letter for consideration of the Environmental Quality Control Board (Refer to Attachment 1). The comment letter focuses on the proposed "Site Monitoring and Management Plan" that is proposed to monitor the long -term environmental consequences of the proposed disposal of ocean dredged material. Upon EQCB review, the City Council will review and approve a final comment letter on February 28, 2005. Major Area of Concern Discussed in City Comment Letter: Staff generally concurs with the conclusions reached within the DEIS regarding environmental impacts, based on the information, modeling, and analysis presented within the document. The major area of concern of staff is related to the long -term disposal of ocean dredged material and ensuring that it does not violate the identified water quality standards. As such, the focus of the proposed comment letter is on the proposed "Site Monitoring and Management Plan" that is provided as Appendix A of the DEIS document. Staff has reviewed the "Site Monitoring and Management Plan", attended a public meeting on the Draft EIS on February 9, and have discussed the plan with representatives of EPA. It is the opinion of staff that the proposed "Site Monitoring and Management Plan" provides the necessary framework for analysis of future disposal actions to ensure compliance with the appropriate standards and requirements of the permitted activity. Section 3, "Site Monitoring Plan" contains monitoring modules for "Physical/Biological" and "Chemical/Bioeffects" and the proposed tiered monitoring activities appear to be thorough and concise in describing the effects to be monitored and the thresholds that are necessary to be encountered to move from a certain tier of evaluation to the next tier of evaluation. On page 18 of the "Site Monitoring and Management Plan" there is discussion indicating "all sediment testing results for dredged material characterization projects will be entered into the regional sediment quality database being assembled by the Los Angeles Contaminated Sediment Task Force."
