HomeMy WebLinkAboutCC AG PKT 2010-10-25 #B AGENDA STAFF REPORT DATE: October 25, 2010 TO: Honorable Mayor and City Council • THRU: David Carmany, City Manager • FROM: Mark Persico, AICP, Director of Development Services SUBJECT: CREATE A MAIN STREET SPECIFIC PLAN (MSSP) UPDATE ADVISORY COMMITTEE AND PROVIDE DIRECTION TO THE PLANNING COMMISSION REGARDING THE EXISTING MSSP SUMMARY OF REQUEST: That the City Council (1) form a Main Street Specific Plan (MSSP) Update Advisory Committee and (2) direct the Planning Commission to consider amendments to the existing Specific Plan to ensure that commercial uses are compatible with adjacent residential uses. BACKGROUND AND FACTS: Over the past 25 years there have been 3 different City Council appointed committees created to examine downtown revitalization and business activity issues. A 15 member committee was appointed in 1983, a 9 member committee was appointed in 1989 and a 7 member committee was appointed in 1991. Each of the committees had a defined task and met for a limited duration. It should be noted that records of these committees are incomplete. The Main Street Specific Plan was finally adopted by the City Council on July 8, 1996. Over the past few years there has been renewed discussion about the adequacy of the MSSP relative to mix of uses, the number of alcohol licenses, A -frame signs and parking. Most recently as part of the Zoning Code update, members of the Planning Commission and City Council expressed the need to re- examine the MSSP. On July 21, 2010, the Planning Commission made a unanimous recommendation to the City Council that a Main Street Specific Plan Advisory Committee be created. DISCUSSION: Agenda Item B Page 2 DISCUSSION: Based upon past practice, staff is recommending that a 9 member committee be appointed consisting of 5 residents and 4 members of the business community. As an example each Council member could appoint a member, who may or may not need to live within their district, and the 4 members of the business community could be appointed by the Chamber of Commerce. However, there are other methods of making appointments as well. The Committee should meet for not more than 12 months and should examine the following issues: 1) can or should the City regulate the mix of uses along Main Street, 2) what additional controls can or should be placed on new alcohol licenses on Main Street, 3) should the standards for A -Frame signs be amended, and 4) general parking issues on Main Street. Additionally, there have been on -going issues regarding Main Street Cyclery and impacts upon adjacent uses. The issues could be addressed as part of the MSSP update, or the Council could direct the Planning Commission to address these issues ahead of the rest of the updating of the Plan. • FINANCIAL IMPACT: There are no direct financial impacts created through the formation of the MSSP Update Advisory Committee. RECOMMENDATION: That the City Council (1) form a Main Street Specific Plan (MSSP) Update Advisory Committee and (2) direct the Planning Commission to consider amendments to the existing Specific Plan to ensure that commercial uses are compatible with adjacent residential uses. Resolution No. 6070 ATTACHMENT "A" RESOLUTION NO. 6070 A RESOLUTION OF THE SEAL BEACH CITY COUNCIL CREATING THE MAIN STREET SPECIFIC PLAN (MSSP) UPDATE ADVISORY COMMITTEE RESOLUTION NUMBER 6070 A RESOLUTION OF THE SEAL BEACH CITY COUNCIL CREATING A MAIN STREET SPECIFIC PLAN UPDATE ADVISORY COMMITTEE THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE THAT: Section 1. The City Council of the City of Seal Beach does hereby create an advisory committee to be known as the Main Street Specific Plan Update Advisory Committee. Section 2. The Main Street Specific Plan Update Advisory Committee shall consist of nine (9) voting members. Five members shall be appointed by the City Council and four members shall be recommended by the Chamber of Commerce and ratified by the City Council. The members of the committee shall have particular skills, background, and knowledge of Main Street issues. Section 3. The Director of Development Services, or his designee, will serve as staff support to the Main Street Specific Plan Update Advisory Committee; however, no voting privileges will be given. Section 4. The Main Street Specific Plan Update Advisory Committee shall be charged by the City Council with: a. determining if the City should establish standards regarding the mix of uses within the MSSP; b. determining if the City should establish standards for new alcohol licenses within the MSSP; c. determining appropriate standards for A -frame signs and outdoor displays within the MSSP; d. reviewing the Main Street parking standards and the in -lieu fee program. Section 5. The Main Street Specific Plan Update Advisory Committee shall select from its membership a person to chair its meeting and a person to record its action. All actions by the Committee shall be taken by majority vote of the nine (9) voting members. The Committee shall . abide by the California Government Code and Seal Beach Charter and City Code relative to open public meetings and conflict of interest regulations. Copies of the minutes of each meeting and of any written reports or correspondence of the Committee shall be filed with the City Clerk. Section 6. The term of the Main Street Specific Plan Update Advisory Committee shall expire as of December 31, 2011, unless extended by the City Council.
