SUBJECT: NOTICE OF COMPLETION FOR LOCAL STREET
RESURFACING PROGRAM PROJECT NO. ST0906 -A
(ST1004) - OLD TOWN
SUMMARY OF REQUEST:
It is requested that the City Council adopt Resolution No. 6080 to formally accept
completion of the Local Street Resurfacing Program Project No. ST0906 -A
(ST1004) — Old Town, direct the City Clerk to file a "Notice of Completion" with
the Orange County Clerk- Recorder within 10 days from the date of acceptance
and to release retention in the amount of $173,099.58 in 35 days.
BACKGROUND:
On March 8, 2010, City Council awarded a contract to Nobest Inc. in the amount
of $1,500,000 for the Local Street Resurfacing Program Project No. ST0909 -A
(ST1004) — Old Town.
The project consists of removing curb & gutter, alley entrances, curb ramps,
sidewalk, driveway entrances and portions of the parkway that are impervious
and replacing with new curb & gutter, alley entrances, curb ramps, sidewalk,
driveway entrances and new sod. The project also consists of grinding sections .
of concrete roadway, and repaving with rubberized asphalt. The work was done
on 1st Street, 6th Street, 7th Street, 8th Street, Central Avenue and parts of Seal
Way.
During construction, there were several work requests that came up that resulted
in change orders to the contractor, and delays in the construction schedule.
Some of these items included: changing the scope of Seal Way to concrete
pavement rather than asphalt, pouring new color stamped concrete curb ramps
and Central Avenue and Main Street, placing new PVC pipes under new
sidewalk for residential irrigation in new parkway sod, and installing parkway

pavers for residents who purchased the pavers and chose not to have sod
installed in the parkway in front of their residence.
The project is now complete to the satisfaction of the City Engineer and
recommends formal acceptance of the project.
FINANCIAL IMPACT:
In the approved 09/10 Budget, $5,050,000 was approved for the Project ST1004
Local Street Resurfacing Program. These funds are to be used for Project
ST1004 —A and ST1004 —B.
Below is a breakdown and summary of expenses for the project:

Inspection $28,000.00
Tree Planting $64,400.00
TOTAL _ $1,823,395.83
A summary of the expenditures from this allocation is being presented in agenda
item "K" (Citywide Paving Allocation - $5 million).
RECOMMENDATION:
It is recommended the City Council adopt Resolution No. 6080 to formally accept
completion of the Local Street Resurfacing Program Project No. ST0906 -A
(ST1004) — Old Town, direct the City Clerk to file a "Notice of Completion" with
the Orange County Clerk- Recorder within 10 days from the date of acceptance

A RESOLUTION OF THE SEAL BEACH CITY COUNCIL
DECLARING WORK TO BE COMPLETED PER CONTRACT
DOCUMENTS FOR LOCAL STREET RESURFACING PROGRAM
PROJECT NO. ST0906 -A (ST1004) — OLD TOWN
WHEREAS, on March 8, 2010 the City of Seal Beach entered into a contract
with Nobest Inc.; and
WHEREAS, the City Engineer has determined that the work has been
substantially completed in accordance with the contract documents.
NOW, THEREFORE, THE CITY COUNCIL DOES HEREBY RESOLVE:
Section 1. That the work required to be performed by said Contractor has
been completed.
Section 2. That the total cost of amount to be paid to contractor for the work
performed is $1,730,995.83.
Section 4. That the work is hereby accepted and approved.
Section 5. It is further ordered that a "Notice of Completion" be filed on behalf
of the City in the Office of the Orange County Recorder within 10
days of the date of this resolution.
