HomeMy WebLinkAboutAGMT - Don Wilson Builders (Accurate Metals Site) VIP AGREEMENT FOR REIMBURSEMENT OF CITY COSTS TO PREPARE ENVIRONMENTAL ANALYSIS AND NECESSARY DISCRETIONARY ACTION STAFF REPORTS FOR THE ACCURATE METALS SITE r � THIS AGREEMENT is made this 3 day of 2006, by and between the City of Seal Beach (hereinafter "CITY") d Don ilson Builders ( "APPLICANT "). RECITALS A. APPLICANT is currently in escrow to acquire approximately 4.5 acres of property located at the northwest comer of Seal Beach Boulevard and Adolfo Lopez Drive also known as 1011 Seal Beach Boulevard (the "Property "). APPLICANT proposes to construct approximately 87 residential units (the "Project "). B. The Parties agree that the Project Application shall receive an Environmental Analysis pursuant to the California Environmental Quality Act ( "CEQA," Public Resources Code Sec. 21000, etseq.). C. APPLICANT will reimburse CITY in full for all costs and expenses actually incurred by CITY in the preparation of the Environmental Analysis and for all necessary discretionary action staff reports and appropriate accompanying ordinances, resolutions, etc., for the Project in the manner provided for herein. In doing so, APPLICANT does not waive any rights or claims regarding excess payments or charges to which APPLICANT may be subjected as a result of CITY's payment of such costs. APPLICANT further agrees that in the manner provided for herein it will reimburse CITY in full for all costs and expenses actually incurred by CITY in the processing of the Project Application. D. APPLICANT also acknowledges that work on the Project Application, or Environmental Analysis shall be immediately suspended if at any time APPLICANT's payment is delinquent, or if APPLICANT notifies CITY of the abandonment of the Project Application as provided for herein. E. It is not the intent of this Agreement to have APPLICANT pay to CITY any amounts in excess of those costs actually incurred by CITY for work actually performed pursuant to the Environmental Analysis and necessary discretionary action staff reports for the Project Application. Don Wilson Builder, Reimbursement Agreement with Ciiy of Seal Beach re: Accurate Metals Site Project February 2, 2006 COVENANTS 1. City's Scope of Work for Project. CITY shall prepare the necessary Environmental Analyses pursuant to CEQA. The Environmental Analysis is necessary to allow the CITY and other responsible agencies to evaluate the Project Application in accordance with the provisions of the Code of the City of Seal Beach, CEQA, and the Government Code of the State of California, and other appropriate State and Federal laws and regulations. CITY shall also prepare all necessary and appropriate Staff Reports, Ordinances, Resolutions and other project consideration documents as may be necessary to allow the proposed project to be considered by the appropriate reviewing and approval bodies of the CITY including but not limited to the City Council, Planning Commission, Environmental Quality Control Board and the Archaeological Advisory Committee. A complete Scope of Work is included and referenced as Exhibit B. A proposal for Initial Study/Mitigated Negative Declaration for Accurate Metals Site Residential Project from RBF Consulting is included as Exhibit A. In the event the CITY determines that a focused Environmental Impact Report or and Environmental Impact Report is necessary, APPLICANT hereby acknowledges and agrees that it will reimburse CITY in full for all documented costs and expenses actually incurred by CITY pursuant to Section 2 of this Agreement. 2. Reimbursement. A. APPLICANT agrees to reimburse CITY in full for all documented costs and expenses actually incurred by CITY personnel (full -time and part-time positions) in processing the Project Application (including, without limitation, legal fees and expenses charged CITY by its City Attorney at the hourly rates City Attorney charges City for preparation and review of documents related to development proposals). (the "Reimbursable Staff Costs "). The City Attorney's rates for 2005 are set forth in Exhibit C. These rates will be adjusted for 2006 and the City will provide such updated information when informed of said adjustment by City Attorney. B. APPLICANT agrees to reimburse CITY according to the following schedule: (1) REIMBURSEMENT FOR STAFF COSTS. Upon the later of execution of this Agreement or the submission of the Project Application, APPLICANT shall deposit with CITY the sum of Ten Thousand Dollars ($10,000) (the "CITY Deposit Amount "), which CITY shall place in an interest bearing account (the "CITY Deposit Account "). CITY shall deduct from such CITY Deposit Amount, until the CITY Deposit Amount is exhausted, the 2 1 • • Don Wilson Builder, Reimbursement Agreement with City of Seal Beach re: Accurate Metals Site Project February 2, 2006 documented Reimbursable Staff Costs. All interest earned on the CITY Deposit Amount, if any, shall accrue to the benefit of, and be used for, completion of the scopes of services attached hereto as Exhibit "A." CITY may, in lieu of deposit of the CITY Deposit Amount into a separate bank account, separately account for such deposit in one or more of its various bank accounts, and upon doing so, shall proportionately distribute to the account(s) into which the CITY Deposit Amount resides, the average interest earned during the period on the CITY Deposit Amount. CITY shall monthly send to APPLICANT an accounting of amounts and reasons the CITY Deposit Amount has been used over the preceding month, including a description of who worked on the project, for how long, and their hourly rate, and an accounting of the interest earned and the accounts into which the eamed interest has been deposited. (2) SUBMISSION OF DOCUMENTATION. All invoices submitted by CITY to APPLICANT, and by the Consultant to CITY, shall include: reasonably detailed descriptions of the work performed and by whom; those persons hourly rates, the amount of time spent on each individual task of the work performed; applicable overhead rates, and a copy of the paid receipt for any claimed reimbursable expense for the billing period. . .. - (3) REPLENISHMENT OF CITY DEPOSIT ACCOUNT. On or before the fifteenth day of any month, CITY shall submit to APPLICANT a statement of expenses and reconciliation of CITY Deposit Account for the preceding month's costs of reimbursable services and expenses. CITY may carry over to the next month's invoice any charges not billed in a particular month. APPLICANT shall replenish the deposit account throughout the Project Application when a minimum balance of $3,500.00 is reached in the CITY Deposit Account ( "Supplemental Deposit "). APPLICANT shall replenish the CITY Deposit Account by an amount determined by the Director of Development Services to cover the anticipated billings for Reimbursable Staff Costs for a period not to exceed the ensuing sixty (60) days. Such Supplemental Deposit shall be made within twenty (20) days of receipt of the written request for Supplemental Deposit. Any request for a Supplemental Deposit shall include an explanation of the work completed to date and the anticipated cost of the work remaining to be performed. APPLICANT agrees that CITY's work on the Project Application or Environmental Analysis shall be immediately suspended if at any time APPLICANT fails to make a Supplemental Deposit in the time periods provided for in this Agreement. Any Supplemental Deposit amount shall be governed by the same terms of trust governing the original deposit. CITY shall remit to APPLICANT any balance remaining in the CITY Deposit Account within thirty (30) days after the date on which: (i). Project Application has been finally processed by CITY; or (ii) APPLICANT gives notice of abandonment of the Project in accordance with this Agreement, whichever occurs first. 3 Don Wilson Builder, Reimbursement Agreement with City of Seal Beach re: Accurate Metals Site Project February Z 2006 3. CITY Determination to Retain Environmental Consultants. In the event the CITY - prepared environmental evaluation receives public comments during the required public review and comment period that require additional professional expertise, in the opinion of the Director of Development Services, City shall so notify Owner within immediately. CITY shall provide a scope of work, budget, and anticipated time schedule for APPLICANT to review and approve. If CITY is not notified by APPLICANT of the intent to abandon the project, as set forth in Section 4 within 10 days, CITY shall proceed with the issuance of "Notice to Proceed" for said professional environmental evaluation work, and the Reimbursement and replenishment provisions of Section 2.B above shall apply to said professional evaluation work. • 4. Abandonment of the Project. In the event APPLICANT notifies CITY'S City Manager in writing of its intent to abandon the Project, APPLICANT shall reimburse CITY for all services of the CITY staff personnel (including CITY' s City Attorney) who had performed prior to the notice of abandonment. 5. Land Use Entitlements. The execution of this Agreement does not in any way obligate CITY to approve any proposed development, or give rise to any vested rights or land use entitlement to APPLICANT, or give rise to any cause of action for damages in the event CITY does not approve any proposed development, or any portion thereof. Proposed Environmental Process: CITY will prepare an Environmental Analysis for the Project in compliance with all requirements of the California Environmental Quality Act, including all required notifications and other legal notices. Based upon a preliminary review, staff feels that a "Mitigated Negative Declaration" may be adequate to fully assess the environmental impacts arising from the Project. However, the City may determine that additional review is necessary, and thus require a focused Environmental Impact Report or an Environmental Impact Report. 6. Interpretation. This Agreement is deemed to have been prepared by all of the parties hereto, and any uncertainty or ambiguity herein shall not be interpreted against the drafter, but rather, if such ambiguity or uncertainty exists, shall be interpreted according to applicable rules of interpretation of contracts under the law of the State of California. 7. Assignment. This Agreement shall not be assignable by APPLICANT in whole or in part without the prior written consent of CITY, which written consent shall not be unreasonably withheld. APPLICANT shall provide to CITY thirty (30) days advanced notice of any such assignment. 8. Notice. Entire Agreement. This Agreement represents the entire integrated agreement between CITY and APPLICANT, and supersedes all prior negotiations, representations or agreements, either written or oral. This Agreement may be amended only by a written instrument signed by both CITY and APPLICANT. 10. Litigation Costs. Should any dispute under this Agreement lead to litigation, the prevailing party shall be entitled to recover from the other party actual attorneys' fees and costs for the prosecution of the action. • 11. Governing Law. This Agreement shall be governed by, and interpreted . according to the laws of the State of California. 12. Authority. The persons signing this Agreement warrant that each of them has the authority to execute this Agreement on behalf of the party on whose behalf said person is purporting to execute this Agreement, and that this Agreement is a binding obligation of said parties. INTRODUCTION AND UNDERSTANDING OF THE PROJECT 1.1 INTRODUCTION 1 RBF Consulting (RBF) has submitted this proposal to prepare a Mitigated Negative Declaration to assess potential impacts and identify mitigation measures for the proposed Accurate Metals Site Residential Project (Project) in Seal Beach. The evaluation and associated work products will be prepared in accordance with the criteria, standards, and provisions of the California Environmental Quality Act (CEQA) of 1970, Section 21000 et. sec. of the State EIR Guidelines (California Administrative Code Section 15000),the City of Seal Beach Environmental Guidelines,and the regulations requirements and procedures of any other responsible public agency with jurisdiction by law. RBF will throughout the document, and where appropriate, relate the proposed Project to the general trends in the 1 City of Seal Beach and the surrounding area. 1.2 UNDERSTANDING OF THE PROJECT n The City of Seal Beach is seeking to retain a consultant to evaluate a proposed residential development located at the northwest corner of the Seal Beach Boulevard and Adolfo Lopez Drive intersection adjacent to the Boeing Space and Communications Group Specific Plan (Boeing Specific Plan)area. The +/-4.5-acre site consists primarily of the Accurate Metals property adjacent to the southeastern portion of the Boeing property. El The work program for the environmental clearance will include review of reference information provided by the applicant, which is anticipated to include a traffic study, geotechnical report, Phase I Environmental Site Assessment, and visual simulations. RBF I will conduct a peer review of all technical reports and incorporate the finalized studies into the analysis. J The RBF Project Team will take a proactive role in the Project evaluation. The environmental constraints and issues must be carefully considered, with mitigation and threshold criteria established to reduce impacts. RBF will adhere to scheduling for the 11 Project and will accelerate the analysis process when feasible. The RBF Project Team will Jalso be looked upon as an integral participant in the Project review and will participate in meeting with staff and at public hearings. SCOPE OF WORK The following Scope of Work has been prepared pursuant to the information received from the Applicant and City. The cost estimate,which is itemized according to task and issue, is included in Section X (Budget). 1.0 PROJECT SCOPING AND PROJECT DESCRIPTION :J Our work program will be initiated with the kick-off meeting/discussion,which will define the parameters of the analysis, scheduling, and understanding of the Project. Project research will include coordination with the City to acquire relevant environmental data, previous studies for the area and other available files, exhibits, maps, and reference documents. The initial investigation will include a site visit, review of existing land uses and environmental conditions, and a photographic recording of on-site and surrounding uses. `,1 3.0 FOCUSED STUDY _ Focused studies for biological and cultural resources have been included in RBF's scope of work as supporting documentation for the Initial Study. �I 3.1 BIOLOGICAL RESOURCES J RBF has retained BonTerra Consulting (BonTerra) to perform a biological i constraints survey with vegetation mapping for the Project site. BonTerra's scope of work will consist of the following tasks: fi Literature Review. A literature review will be conducted to determine which species have been identified as special status by State, Federal, and local resources agencies and organizations,and have the potential to occur within the Project site or I immediate vicinity. Sources to be reviewed include: -J ÷ Special status species lists from the California Department of Fish and Game (CDFG), U.S. Fish and Wildlife Services (USFWS), and California Native 3 Plant Society (CNPS); Database searches of the California Natural Diversity Database (CNDDB) Iand the Electronic Inventory of the CNPS; 10-104778 • 2 • December 12, 2005 J I • • I y E ar; City of Seal Beach x� �;i Proposal for the Accurate Metals Site Residential Project i�d Mitigated Negative Declaration 1 + The most recent Federal Register listing package and critical habitat determination for each Federally listed Endangered or Threatened species potentially occurring within the Project site; The CDFG Annual Report on the status of California's listed Threatened and _ Endangered plants and wildlife; and :• Other biological studies conducted in the vicinity of the Project site. Biological Surveys and Vegetation Mapping. A field survey will be conducted to map the vegetation types on the Project site. In addition, a general walkover survey will be conducted to document the existing wildlife use of the Project site. A description 'J of the existing quality and species composition of the vegetation types/wildlife habitat on the Project site will be compiled based on observations and field notes taken during the survey. The documentation of the above survey effort will make recommendations as to which additional surveys are required based on the concerns of State and Federal resource, agencies, and the suitability of onsite habitat for 'I sensitive animal species. Documentation. A letter report documenting the general biological resources on the } Project site will be prepared based on the results of the above tasks. The report will J describe: (1)the methodology used to conduct the biological survey; (2)the existing vegetation types (including a vegetation map) and associated wildlife resources on r the Project site; (3) the potential of the Project site to support special status biological resources; and (4) potential biological constraints from Project development. In the event that no special status biological resources are identified, the report should provide adequate supporting documentation for a preliminary CEQA analysis. 3.2 CULTURAL RESOURCES RBF has retained EDAW, Inc. to perform a cultural study for the Project site. The investigation will first review existing data to assess the relationship of the parcel to ii known locations of cultural sites in the vicinity. This effort will include a records search at the South Coastal Information Center at California State University, Fullerton,for all areas within one-half mile of the project area. Because the location } of CA-ORA-265 is of special concern, early maps showing the location of this site will J be re-scaled and overlain onto maps of the project area. Based on these data and the current contours of cut and fill within the parcel, areas with potential to contain intact cultural deposits will be identified. The Traffic Study will be critiqued and any follow-up revisions or new information will be evaluated. Li 4.4 VIEW SIMULATION REVIEW RBF has retained Richard Johnston to conduct a peer review of the view simulations produced by the applicant's consultant. This Scope of Work assumes review of three separate view simulations. Mr. Johnston's scope of work is as follows: JInformation Gathering. A meeting will be held to determine data assumptions and . . methodology, which was used to create the visual simulations prepared by the Iapplicant's consultant. The approximately 4.47-acre Project site is included within the Boeing Specific Plan area,adjacent to the existing Boeing facilities. The Project includes a 110-room hotel, 7,800 square feet of retail shops, and approximately 11,473 square feet of fast-food/in-line food service uses. Implementation of the _ proposed Project required amendments to the Boeing Specific Plan regarding building height and also building setback distances from Seal Beach Boulevard. Boeing Specific Plan EIR City of Seal Beach RBF prepared the EIR for a 107-acre Specific Plan area between Westminster Avenue and Seal Beach Boulevard. The Project involves a mixed-use business park development that would be compatible with existing Boeing facilities and operations at the site. The proposed building/expansion would result in a total of 2,210,500 square feet of floor area, representing a net increase of 1,060,500 square feet over the existing floor area. Key issues reviewed include local and regional traffic impacts(evaluations conducted by Linscott, Law&Greenspan),affects to nearby residents at Leisure World and the Island Village residential community in Long Beach (adjacent to the site), coastal access considerations and water quality/habitat affects on- and off-site. 5 Sandhurst Estates Tentative Tract Map 32304 Mitigated Negative Declaration City of Indio -y RBF prepared a Mitigated Negative Declaration for the Sandhurst Estates Tentative Tract Map 32304. The approximately 40-acre Project involved an amendment to the General Plan Land Use element to relocate the high school designation from the site in order to be developed with 123 single-family residential lots. The proposed Project was composed of approximately 27.59 net acres of residential lots, 2.64 net acres of public street, 0.41 acre park, 0.98 net acre of drainage facilities 3 and 0.53 net acre of landscape easement. The Village at South Gate Mitigated Negative Declaration City of South Gate RBF prepared a Mitigated Negative Declaration for The Village at South Gate, a moderate-income multi-family and single-family senior residential development. The Project included 250 multi-family residential units and 27 single-family homes. The multi-family senior residential portion of the Project was composed of six buildings. Of the 250 senior residential units 209 were one-bedroom and 41 were two-bedroom, while the single-family homes were two stores with a two car garage. 1 The senior residential area includes a 2,500 square-foot recreation facility, a landscaped courtyard, a garden area and a parking structure. The interchange and overcrossing improvements would serve to eliminate an existing "bottleneck" at the Seal Beach Boulevard Overcrossing. The Initial Study included an extensive noise analysis to determine potential impacts to the surrounding residential areas and recommend mitigation to reduce noise associated with the project. Long Point Resort Project EIR City of Rancho Palos Verdes RBF prepared a Program/Project EIR on behalf of the City of Rancho Palos Verdes for the Long Point Resort project. The proposal includes development of a full-service hotel providing approximately 582 guestrooms, restaurants/bars, and meeting/function spaces. Also proposed are approximately 31.6 acres of conserved/enhanced habitat and approximately 81 acres of public open space/recreation facilities including public parking,shoreline access ramps,public parks/overlooks, public walking/hiking trails, a public golf practice facility and a 9-hole public-use golf course. I The Final EIR was approved and certified by the Rancho Palos Verdes City Council. The Biological Resources Section was updated to include spring survey data for several sensitive species and was re-circulated for additional public review (30 days). Finally, the project involved extensive controversy and criticism from the community. RBF=s role,on behalf of the City, has been to assure that a proper and complete environmental review process has been conducted and to fully respond to environmental concerns of agencies and area residents. The Ritz Carlton Resort Specific Plan/EIR ,_ City of Rancho Palos Verdes I .— The Ritz Carlton Resort scope included the preparation of a Specific Plan and EIR for 340-acres of coastal property located within the City of Rancho Palos Verdes adjacent to the San Pedro/Rancho Palos Verdes corporate boundary. The project proposed construction of a 450-room Ritz Carlton Resort, 18-hole championship golf course, 128 single-family custom estate lots, a commercial village and a variety of public amenities. RBF prepared land use/site plan programs, a visual analysis document,graphic designs/illustratives (i.e., resort conceptual landscape plan), Conditional Use Permit(CUP) package and the Specific Plan document including development standards and design guidelines. RBF worked closely with the City of Rancho Palos Verdes to achieve a grading I design which preserved all existing ocean views, as well as provided extensive public coastal access along the bluff top. Major issues addressed during the course of the project design included geological stability, views, biological resources and land use constraints associated with development within the Coastal Zone. r Ocean Trails, Subregions 7 and 8 City of Rancho-Palos Verdes - - RBF was involved in the preparation of environmental documentation associated with the proposed Ritz Carlton Hotel within the City of Rancho Palos Verdes. Due to economic changes at that time, the project was revised to include residential and golf uses only, known as the Ocean Trails project. On August 12, 1992, the California Coastal Commission (CCC)felt that the previously approved development required additional public access and remanded the project back to the City for redesign and resolution of concerns. ;� In response to the CCC requests,an Addendum EIR,dated October30, 1992,was prepared by RBF to address a reduction in residential and golf area within the project. The Owners ,J remained the project AOcean Trails@ as the project included improved public access to coastal resources. This Addendum BR was certified by the City on December 7, 1992. The project as approved on the same date. Addendum EIR No. 2, October 1993. On July 6, 1993, the Superior Court of California, County of Los Angeles, found that the City had not made findings required by Govemment Code Section 65590 in approving the Ocean Trails plan. Section 65590, subdivision (d)of the Govemment Code states, ANew housing developments constructed within the coastal zone shall,where feasible, provide housing units for persons and families of low or moderate income,as defined in Section 50093 of the Health and Safety Code. Where it is not feasible to provide these housing units in a proposed new housing development, the local government shall require the developer to provide such housing, if feasible to do so, at another location within the same city or county, either within the coastal zone or within three 1 miles thereof.@ The second Addendum EIR was prepared by RBF,which was approved by J the City on October 5, 1993, addressing the concems of the Court by revising the approved Ocean Trails plan to include low income housing units. 1 ❖ Addendum SR No.3, September 1994. Extended discussion with USFWS and CDFG as well as additional geotechnical analyses resulted in modifications to the proposed project, resulting in a reduction of four residential home sites and the expansion of public facilities and habitat areas, as well as relocation of certain trail segments. The third Addendum EIR addresses these refinements to the approved Ocean Trails plan, and was approved by the City Council on September 6, 1994. _ :• OtherEnvironmental Documents. In addition to preparing CEQA related documents,RBF assisted the U.S. Fish and Wildlife Service in the preparation of a Habitat Conservation Plan (HCP) and related Environmental Assessment (EA). Portuguese Bend City of Rancho Palos Verdes `1 RBF provided preliminary planning and environmental consulting services associated with the proposed Portuguese Bend Landslide Remediation Project being pursued by PVPB, LLC. The project proposed the exclusion of a 427-acre site, measuring roughly nine miles by five miles,from — the City of Rancho Palos Verdes Landslide Moratorium Area and included the construction of 12 single-family residential lots, an 18-hole championship golf course, including clubhouse, practice area and maintenance facility, and dedicated open space. No change to the College's existing academic operation/student enrollment limit is proposed. The Project involves demolition of approximately 13,742 square feet(SF)of existing floor area (FA)and the construction of 143,210 SF of new FA (including a 9,060-SF expansion to existing buildings). The proposed buildings/expansions would total of 221,736 SF of FA, representing a net increase of 129,468 SF over existing FA(92,268 SF). RBF completed the Administrative Draft EIR in the Fall of 2002, at which time concerns for the proximity of South Shore landslide area to the College were identified. Further geologic review has been conducted and the EIR is pending modifications to the design of the project. Robinson Ranch North Environmental Impact Report City of Yucaipa URBF prepared the Environmental Impact Report for Robinson Ranch North. The project consists of - - _ 159 acres located north of Interstate 10 and east of Oak Glen Road in Yucaipa. It is comprised of two separate development plans: a Preliminary Development Plan (PDP) on 159 acres, which ,— requires a General Plan Amendment to adopt the proposed Land Use Plan; and a Final Development Plan (FDP)on 90 acres at the westem portion of the project area,which includes Oak .ri Ridge Village, a 695,000 sq.ft. commercial center. The remaining 69 acres,the Wildwood Center, is comprised of 24 single-family residential units on 6 acres and 216 multiple-family units on 27 acres, general commercial uses on 24 acres, and 12 acres of natural open space. The General Plan designates the sites as within the Planned Development (PD) Land Use District. The project proposes an amendment to the General Plan to adopt a Land Use Plan for 114 acres of commercial uses and 240 residential dwelling units. The PD Land Use District designation would be retained on both sites: The project was highly controversial,which was exemplified by the over400 residents who attended the EIR Certification Hearing. Key areas of concern raised by area residents and reviewing 1 agencies included project=s consistency with City regulations for hillside development, impacts J associated with flood zones for Yucaipa Creek, consistency with seismic safety requirements,area- wide traffic impacts, compatibility with neighboring land uses and alternatives. The EIR provided an j in-depth review of all subject areas of concern and concluded the need for a Statement of Overriding Considerations for land use, air quality and noise. The work program included a peer review of several applicant generated studies by the RBF team. jA Northern Foothills Implementation Program EIR City of San Dimas } RBF completed the Final Program EIR for this 3,000-acre project area in the San Gabriel Mountain 1 foothills. The overall objective of the project was to fit future projects into the hillside setting, rather than altering the hillside to fit the projects. This was an important objective given that topographic elevations in the project area range from 1,000 to 3,200 feet above sea level and that the area is characterized by steep terrain, narrow canyons and broad ridgelines. The overall average slope of the area is 52 percent. Significant environmental issues analyzed in the Program EIR included :i access/circulation,fire protection services, landform alteration, biological resources, hydrology and _ drainage, geology and seismicity, and land use and relevant planning. A unique feature of the project was the development of mitigation measures that served as development standards and many were included as such in the Specific Plan. In addition, the Program EIR was completed ,__} within seven months to meet the City=s deadline of completion of the GPA, Zone Change/Specific Plan and Program EIR prior to July 1999 expiration of the City=s moratorium on development in the northern foothills area. `J Subsequent to City Council certification of the Final EIR, one of the property owners within the project area challenged the adequacy of the EIR; however, the court ruled that the EIR was legally iladequate. North Village 1999 Specific Plan Amendment Program ER '1 Town of Mammoth Lakes The approved North Village Specific Plan (1991)involves development of a destination resort facility including lodging, commercial and residential uses on 64.1 acres. The proposed amendment includes circulation and parking modifications, changes to height limitations and setbacks,changes in development standards,establishment of design guidelines, modifications to public facilities and housing requirement changes. This coupled with the elapsed time since the 1991 certification of the original North Village Specific Plan EIR warranted further review through an updated Program EIR. In addition, the evaluation will include the development application for Phase 1 of the Specific Plan. Key issues have included traffic generations,aesthetics, noise and water qualitywhich also included a review of compliance with the Lahontan Regional Water Quality Control Board. L-- Birch Hills Specific Plan EIR City of Brea RBF prepared the EIR for this 152.9-acre site, which includes Birch Hills Golf Course and a former Unocal chemical plant (which utilized ammonia, natural gas and nitrates in the manufacturing of J fertilizers). The proposed Birch Hills Specific Plan would establish a multi-use development of residential, general commercial and recreational land uses. The plan proposes a total of 475 residential units,which includes affordable housing units to meet City requirements. Development of the low-density residential area and 7.5-acre community park required relocation of Birch Hills Golf Course. It was a highly controversial development adjacent to established residential i neighborhoods, due in part to the proposed residential densities, commercial uses and loss of 1 mature trees. The Final EIR and project approval process was successful, with only moderate public comments on the Draft ER, primarily due to extensive public scoping and thorough analysis of the issues in the Draft EIR. The project required substantial infrastructure improvements, J including realignment and covering of the Loftus Channel, half-width improvements to Imperial Highway(an Orange CountyASmart Street@ and a Caltrans facility), and regional riding and hiking trails that traversed the site. APPLICANT proposes to construct approximately 87 residential units (the "Project "). Proposed Environmental Evaluation Process: The Project Application shall receive an Environmental Analysis pursuant to the California Environmental Quality Act ( "CEQA," Public Resources Code Sec. 21000, et seq.). CITY will prepare an Environmental Analysis for the Project in compliance with all requirements of the California Environmental Quality Act, including all required notifications and other legal notices. It is anticipated that a "Mitigated Negative Declaration" will be an adequate environmental review document. This section provides a detailed narrative of the proposed work effort City staff will complete to provide CEQA compliance for the project. 1. Kick - Off Meeting Upon execution of the reimbursement agreement for this project, City Staff will meet with the project consultants to obtain a complete project description and finalize a project schedule and approach for preparation of the Initial Study/Mitigated Negative Declaration (IS/MND). At this meeting City staff will obtain copies of any remaining requested materials and information listed later in this scope of work and gather any other information available from the project consultants that will be useful in the preparation of the IS/MND. 2. Preparation of Technical Studies & Alternatives / Agency Consultations 8 1 i Don Wilson Builder, Reimbursement Agreement with City of Seal Beach re: Accurate Metals Site Project February 2, 2006 City staff will provide a thorough review of existing project documentation and identify any additional information needed to make these studies complete. City staff will conduct consultations with affected agencies including the California Coastal Commission, the Army Corps of Engineers, the Regional Water Quality Control Board, and the Orange County Flood Control District. Information gathered from these consultations will be used for issue identification and analysis in the IS/MND document. The extent of analysis requirements of the Coastal Commission and resource agencies can sometimes be difficult to predict. If alternatives are requested by the Coastal Commission or other resource agencies during the public comment period on the IS/MND, City staff may identify the need for an augmented scope of work, including retention of additional private consultant services. 3. Preparation of Draft Initial Study / Mitigated Negative Declaration Once the executed reimbursement agreement has been received by the City, City staff will begin preparation of the draft IS/MND. Based upon the City's experience preparing IS/MNDs for similar projects and review of the proposed project, the following environmental issues are proposed to be addressed: a. Introduction: This section will provide a brief description of the project and the purpose of the Initial Study/Mitigated Negative Declaration. Key sections of the Introduction are: • Statutory Authority: This section will cite the sections of CEQA that allow the preparation of an IS/MND and the applicable sections of CEQA with which the Initial Study and Mitigated Negative Declaration must comply. • Issues to be Addressed: This section will list the issues to be addressed in the Mitigated Negative Declaration based on the completion of the Initial Study checklist. • Organizations Affiliated with the Project: The City of Seal Beach, as the Lead Agency, names, addresses, telephone numbers and contact persons will be listed in this section. b. Project Description: A complete and detailed project description will be provided. The information for the project description will be provided by the project consultants. Key sections of the Project Description are: • Project Location and Boundaries: This section will provide a description of the project area both narratively and graphically. These graphics are to be provided by the project consultants. • Environmental Setting: This section will describe the local setting of the project site as well as the general surrounding area. Included in this description will be a general overview of the City of Seal Beach, its population, geographic location, and existing land uses in the project area. • The Intended Use of the Mitigated Negative Declaration: This section will list and describe in detail the intended use of the IS/MND. c. Environmental Setting, Potential Project Impacts, and Mitigation Measures: Each environmental discipline listed below will consist of an environmental setting, potential project impact(s), and mitigation measures that serve to reduce impacts to a less than significant level. Mitigation measures may consist of the following: • Project Design Features (PDFs), which are measures that are incorporated into the design of the project to mitigate potential impacts; • Standard Conditions of Approval (SCAs) which are requirements imposed by the state, the county, or the City of Seal Beach to avoid or reduce potential impacts; and • Mitigation Measures, which are measures specifically crafted during the CEQA process to avoid potential impacts or reduce them to less than significant levels. The project impacts section will state threshold criteria that will be used to evaluate significant environmental effects with development of the project. City staff will develop threshold criteria for each environmental discipline for incorporation into the IS/MND. The following environmental disciplines are anticipated to be addressed in the IS/MND for this project: • Land Use: The setting section will describe the existing land use on the site as well as the surrounding land uses. The IS/MND will evaluate the consistency of the project with the existing General Plan and conformity with zoning designations for the site. The project consultants will provide surface level photographs of the existing land uses adjacent to and surrounding the site. As the project is located in the Coastal Zone, the IS/MND will provide a consistency analysis for policies contained within Chapter 3 of the Coastal Act. City staff will consult early on with Coastal Commission staff regarding issue identification and project compliance. 10 • • Don Wilson Builder, Reimbursement Agreement with City of Seal Beach re: Accurate Metals Site Project February 2, 2006 Although not part of this scope of work, the project will require a Coastal Development Permit from the California Coastal Commission prior to construction. The IS/MND will include a detailed discussion of the compatibility of the project with the adjacent existing and planned surrounding land uses. A thorough discussion and evaluation of potential land use impacts that may occur with development of the project will be provided. Mitigation measures will be presented accordingly to mitigate potential significant land use impacts as required by CEQA. • Population and Housing: This section will describe the existing population and housing numbers in the City of Seal Beach based on current data from the State Department of Finance and the Southern California Association of Governments (SCAG). • Soils and Geology: Minimal landform activity is included as part of the proposed project. The ISIMND will describe the geologic setting based upon any preliminary geotechnical reports provided by the project consultants. This report will provide the basis for the analysis of geologic, seismic and landform alteration impacts related to the proposed project. • Based on the potential geotechnical constraints identified in the preliminary geotechnical report, the ISIMND will specifically focus on geotechnical constraints such as existing undocumented fills, the off-site removal of unsuitable material, the dewatering of excavations, liquefaction potential, the close proximity of existing residential structures and pipelines, and the corrosive nature of the existing soils. When required to comply with CEQA, the IS/MND will list mitigation measures to mitigate potential geotechnical impacts. • Hydrology/Water Quality: The Hydrology section will identify the existing drainage facilities that currently serve the project site and the adequacy of those facilities to serve the proposed development, and will be based upon information provided by the project consultants. This section will also identify upgrades or improvements that will be required to the existing storm drain system, if any. For inclusion in the IS/MND, the project consultants will submit an evaluation or calculation of storm runoff and an evaluation of storm drain system requirements, and appropriate mitigation measures. 11 • Don Wilson Builder, Reimbursement Agreement with City of Seal Beach re: Accurate Metals Site Project February 2, 2006 The Hydrology section will also discuss erosion control measures that will be incorporated into the project during construction and after construction to reduce surface water runoff and erosion. Compliance with current • National Pollutant Discharge Elimination System (NPDES) standards will be required. The project consultants will assist in preparing project specific Best Management Practices (BMPs) to address potential stormwater pollutants in coordination with the U.S. Army Corps of Engineers, the Santa Ana Regional Water Quality Control Board, and the Coastal Commission. If potential hydrology /water quality impacts are . identified, mitigation measures will be proposed by the project consultants to reduce impacts. City staff will prepare final mitigation measures that will be listed in the IS/MND. • Traffic and Circulation: Project consultants will submit an analysis of project access and construction- related traffic, and such analysis will describe potential project impacts and suggested mitigation measures. Mitigation measures will be recommended when required to reduce traffic impacts to acceptable levels by the project consultants. City staff will prepare fmal mitigation measures that will be listed in the IS/MND. • Air Quality: Based upon the information provided by the project . consultants, potential air quality impacts will be identified and analyzed for the project. City staff will review reports prepared by the project consultants that will analyze the project for consistency with City and Southern California Air Quality Management District (SCAQMD) regulations and policies. In addition, short-term air quality impacts will be evaluated for construction- related activities. If needed, mitigation measures to reduce any air quality exceedances determined to be above the applicable de minimus level will be proposed by the project consultants. City staff will prepare fmal mitigation measures that will be listed in the IS/MND. • Noise: Based upon data provided by the project consultants, potential noise impacts will be identified. In addition, short-term construction noise impacts will also be addressed. Any identified noise impacts will be analyzed for consistency with policies and regulations contained in the City's Noise Ordinance and General Plan Noise Element. As needed, mitigation strategies will be identified for the control of noise levels within the project site. The impact section will address the potential aesthetics impacts associated with implementation of the project, including analysis of views of the project from the adjacent industrial business park and from and Seal Beach Boulevard. City staff will rely upon project exhibits, diagrams, site cross - sections, and photo simulations provided by the project consultant. Potential light and glare impacts will be analyzed, as needed. The Aesthetics section will evaluate the proposed project for consistency with the City's policies for visual resources. When potential aesthetics - - impacts are identified, mitigation measures will be provided to reduce potential adverse aesthetics impacts to a level of insignificance. City staff will prepare fmal mitigation measures that will be listed in the IS/MND. • Public Services and Utilities: The Public Services and Utilities sections will identify the existing public services and utilities that serve the site and • whether the project will impact existing levels of service. When required by CEQA, measures will be provided to reduce potential public service and utility impacts to a level of insignificance. • Biology: This section will discuss any existing biological conditions and analyze potential project impacts on biological resources, based on reports prepared by the project consultants. Preliminarily, no biological resources have been identified on the site or in the immediate vicinity. The IS/MND will discuss any potential biological resources impacts due to the implementation of the project and will provide biological mitigation measures as required under CEQA. • Hazards and Hazardous Materials: This section will discuss any known hazards or hazardous materials that exist on the site, based on information provided by the project consultants, as well as identify potential hazards or hazardous materials related to the implementation and operations of the 13 • • Don Wilson Builder, Reimbursement Agreement with City of Seal Beach re: Accurate Metals Site Project February 2, 2006 proposed project. City staff will incorporate information from existing sources and include mitigation measures where required by CEQA to mitigate any potential hazardous impacts identified with the project. • Cultural Resources: Potential project impacts will be evaluated in the IS/MND utilizing reports prepared by the City cultural resources consultant, EDAW. If any significant impacts are identified, mitigation measures will be provided where required by CEQA. 4. Screen Check Mitigated Negative Declaration Once the Draft Mitigated Negative Declaration is completed, City staff will submit five (5) screen check copies to the project proponent for review and comment. After City staff has completed its review of any suggested revisions, City staff will meet to discuss any comments or changes proposed. City staff will retain the sole discretion as to whether any proposed - revisions will be incorporated into the Draft Initial Study/Mitigated - - Negative Declaration. 5. Circulate Draft Mitigated Negative Declaration / Notice of Completion City staff will provide five (5) copies of IS/MND to the project proponent. City staff will . send the Draft IS/MND by certified mail to all agencies and individuals on the contact list, including the State Clearinghouse. While preparing the IS/MND, City staff will prepare a list of agencies and individuals that will receive a copy of all CEQA documents during the MND review and certification process. The contact list will include agencies and individuals that must be contacted in accordance with CEQA, as well as other agencies, groups or individuals City staff believes should be contacted. In conjunction with mailing the Draft Mitigated Negative Declaration City staff will complete a Notice of Completion (NOC) and file the NOC with the appropriate agencies. 6. Prepare Response to Comments and Final Mitigated Negative Declaration After the required 30 -day public review period of the Draft Mitigated Negative Declaration has ended City staff will provide a written response to all written comments received by the City. The responses will be in the form of a Response to Comments section either separately or as part of the Draft Mitigated Negative Declaration. The Response to Comments section in conjunction with the Draft Mitigated Negative Declaration will comprise the Final Mitigated Negative Declaration. 14 • • Don Wilson Builder, Reimbursement Agreement with City of Seal Beach re: Accurate Metals Site Project February 2, 2006 Once the Response to Comments document is completed, City staff will mail a copy of the Response to Comments to all agencies and/or individuals that submitted written comments to the Draft Mitigated Negative Declaration. The responses will be sent by certified mail at least ten days prior to the City taking an action to certify the Final Mitigated Negative Declaration. After the Final Mitigated Negative Declaration is approved, City staff will provide five (5) copies of the Final Mitigated Negative Declaration, including appendices, exhibits and responses to comments to the project proponent. 7. Attend Project Meetings City staff will attend project meetings with the project consultant team as determined necessary during preparation of the Mitigated Negative Declaration in addition to the identified kick -off meeting. This includes staff meetings to review comments on the screencheck Mitigated Negative Declaration and responses to comments on the publicly distributed document: All meetings will be billed at our standard billing rates upon - the personnel from the City in attendance. 8. Public Meetings City staff will attend all public meetings necessary to fully consider this project . throughout the City entitlement process. All meetings will be billed at our standard billing rates based upon the personnel from the City in attendance 9. Notice of Determination Once the Final Mitigated Negative Declaration is adopted by the City, City staff will file a Notice of Determination (NOD) with the appropriate agencies as required by CEQA. As no biological resources have been preliminarily identified for the site, it is not anticipated that the review fee imposed by the California Department of Fish and Game will be required. If that becomes necessary, the project proponent is responsible to pay the City that fee. 10. Mitigation Monitoring and Reporting Plan City staff will prepare a Mitigation Monitoring and Reporting Plan (MMRP) as required by CEQA for those measures listed in the Mitigated Negative Declaration to mitigate potential significant impacts. Needed Information To prepare the environmental documentation for the proposed project, the following materials and information are needed: ❑ Complete Project Application, including property owner affidavit, site plans, structure elevations, and other appropriate information to fully describe the proposed project. This shall include a detailed summary of the differences of existing and proposed facilities. ❑ View simulation of proposed facility from Adolfo Lopez Drive and Seal Beach Boulevard at locations to be determined by City staff. ❑ Preliminary Geotechnical Report Cl Preliminary Hydrology Studies and Storm Drain Improvement Plans Cl • Pielixiiinary Grading Plan ❑ Air Quality analysis in compliance with SCAQMD CEQA Handbook standards ❑ Existing and proposed Utility Plans ❑ Water Quality Plans for Construction and Operational Activities (Preliminary SWPPP) ❑ Traffic evaluation letter report — construction and operation phases analysis. ❑ Phase I Site Assessment or hazardous materials /substances investigation reports. 12. Format of Documents /Submitted Materials All written documentation submitted to the City will also be submitted via electronic media. Submitted materials will use Word 2000 as the word processing program and Excel 2000 as the spreadsheet program.
