SUBJECT: RESOLUTION NO. 5 30 3 ESTABLISHING POLICY DELEGATING
BASIC CLAIM HANDLING TO CITY MANAGER OR DESIGNEE
SUMMARY OF REQUEST: 303 Staff recommends that the City Council adopt Resolution No 303 establishing a policy that
delegates basic claim handling to City Manager or designee.
DISCUSSION:
Since the City of Seal Beach joined the California Joint Powers Insurance Authority (CJPIA), all
processing and resolution of claims (rejection or settlement) has been administered through the Authority
and its claims administrator, Carl Warren & Company. The City Manager's Office through its risk
management program has been responsible for the basic claim handling and internal processing of claims
for the City. The adoption of the attached resolution has been standard practice for cities in the Authority.
The City of Seal Beach, through the adoption of this resolution, will memorialize a standard of practice
and authority that is provided for under California Govemment Code Section 935.4.
FISCAL IMPACT:
No direct fiscal impact.
RECOMMENDATION:
Staff recommends the City Council adopt Resolution No. S')Q) establishing a policy that delegates basic
claim handling of minor claims to City Manager or designee as authorized by Government Code Section
935.4.

RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SEAL BEACH ESTABLISHING A POLICY THAT
DELEGATES BASIC CLAIM HANDLING OF MINOR
CLAIMS TO CITY MANAGER OR DESIGNEE AS
AUTHORIZED BY GOVERNMENT CODE SECTION 935.4
THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE,
DETERMINE AND ORDER AS FOLLOWS:
WHEREAS, Section 935.4 of the Government Code of the State of California provides
that a local public entity may authorize an employee of the local public entity to resolve a claim
against the local public entity; and
WHEREAS, this City has now determined to adopt such a policy;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES
HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
SECTION 1. The City Manager or designee is authorized to take administrative actions
necessary to resolve claims against the City that do not exceed 550,000 pursuant to the
provisions of Government Code Section 935.4.
SECTION 2. This Resolution shall become effective immediately upon its adoption.
The City Clerk shall certify to the passage and adoption of this resolution.
