CAPACITY ASSURANCE PLAN, SEWER RATE STUDY AND
SEWER SYSTEM REHABILITATION PLAN - BUDGET
AMENDMENT
SUMMARY OF REQUEST:
The proposed City Council action will adopt Budget Amendment 05 -08 for the Sewer System
Master Plan update, Sewer Capacity Assurance Plan, Sewer Rate Study and Sewer System
Rehabilitation Plan in accordance with the General Waste Discharge Requirements for Sewage
Collection Agencies in Orange County, Order No. R8- 2002 -0014.
BACKGROUND:
In April 2002, the Regional Water Quality Control Board (RWQCB), Santa Ana Region, issued
Order No. R8- 2002 -0014, General Waste Discharge Requirements (WDR) for all Sewage
Collection Agencies in Orange County within the Santa Ana Region. This order places
requirements on all wastewater agencies in an attempt to stem the rising trend of beach closures
and impacts of ocean water quality that sewage spills and leaks can cause. These are called
Sanitary Sewer System Overflows (SSO). If these discharges of sewage from any sewage spill or
SSO are not fully contained and cleaned up, and there is a discharge of sewage to surface waters
of the State, or the SSO causes a nuisance, it is a violation of this order, Sections 13260 and
13376 of the California Water Code, and Section 301 of the Clean Water Act. RWQCB can
impose penalties for failure to follow the requirements of this order.
The City's response letter to the Regional Board dated September 14, 2004, which is being
received and filed by separate City Council action, outlines several of the preliminary designs
and planning study documents required by the Board. These documents include Sewer System
Master Plan update, Sewer Capacity Assurance Plan, Sewer Rate Study and Sewer System
Rehabilitation Plan. In addition, the studies will include flow monitoring, updating of the
Capital Improvement Program and updating of the sewer system hydraulic model. The Public
• Works Department has met with the Regional Board representatives and discussed the
requirements. The Department has also completed the scope of work and negotiations with the

City Council approved on -call utility consultant, AKM Consulting Engineers and a budget
amendment from the sewer operations enterprise fund is required.
The City has taken many steps in advance of the Regional Board Order such as developing a
Sewer System Master Plan in 1999, eliminating 2 sewer pump stations, video taping 100% of the
City's sewer system, annual cleaning of the sewer system, reconstruction of several thousand
feet of sewer main and reconstruction of 2 sewer pump stations. In addition, the City has been
compliant with the Order by reducing sewer spills, developing a Sewer Overflow Emergency
Response Plan, developing a Preventative Maintenance Plan, and a new Fats, Oils and Grease
Ordinance. However, in order to meet the requirements of the Board Order, these additional
actions are required.
FISCAL IMPACT:
Since any SSO or failure to submit documents to the Board may violate the terms of the Order,
failure to properly manage and operate the system can result in severe civil monetary fines based
upon the severity of the violation. The cost to implement these sewer system actions is estimated
to be $140,000 for FY 04/05. A Sewer System Master Plan update, Sewer Capacity Assurance
Plan, Sewer Rate Study and Sewer System Rehabilitation Plan are the deliverables. The
proposed budget amendment will decrease the Sewer Operations excess retained earnings by
$140,000. The sewer system is operated by enterprise funds funded by rate - payers and no
general fund impact is associated with this action.
RECOMMENDATION:
It is recommended that the City Council adopt Budget Amendment 05 -08 for the Sewer System
Master Plan update, Sewer Capacity Assurance Plan, Sewer Rate Study and Sewer System
Rehabilitation Plan in accordance with the General Waste Discharge Requirements for Sewage
Collection Agencies in Orange County, Order No. R8- 2002 -0014.
