AGREEMENT
THIS AGREEMENT made and entered into this 1(
day of,Aa y, 1975, by and between the CITY OF HUNTINGTON BEACH,
a municipal corporation, and°the CITY OF SEAL BEACH, a municipal
corporation.
W I T N E S S E T H:
WHEREAS, the City of Seal Beach is responsible for
emergency services in the Sunset Aquatic Park area and
Ingress and egress to the Sunset Aquatic Park area
are available only through the city of Huntington Beach and not
available through Seal Beach; and
The Cities of Huntington Beach and Seal Beach have
previously entered into an agreement for a mutual response for
fire protection purposes within the corporate limits of each
other's city; and
The City of Huntington Beach's police and fire units
are in the closest proximity to the Sunset Aquatic Park area
and presently respond to a majority of the emergency calls in
that area,
NOW, THEREFORE, in consideration of the covenants
contained herein, the parties mutually agree as follows:
1. The City of Huntington Beach will respond to all
emergency calls in the Sunset Aquatic Park area.
2. The. City of Seal Beach will reimburse the City

vided further that the payment for any fiscal year shall not
exceed the revenue accruing to the City of Seal Beach from that
portion of Sunset Aquatic Park annexed to the City of Seal Beach
during calendar year 1975. During July of each year, commencing
in July of. 1976, the City Council of Huntington Beach hall pass
a resolution reflecting costs incurred by the City of untington
Beach during the preceding fiscal year, and payment sh -11 be
made by the City of Seal Beach within sixty (60) days •hereafter.
3. This Agreement shall remain in full fore and
effect from and after the date of execution until termination by
either of the parties hereto by written notice to the ether party,
said notice given not less than ninety (90) days prior to the date
of termination.

IN RE: SELECT ARCHITECT - ENGINEER FIRM STRUCTURAL FIRE STATION
ORANGE COUNTY AIRPORT RON YEO
On motion of Supervisor Riley, duly seconded and unanimously
carried, the firm of Ron Yeo is selected as Architect - Engineer to design
the structural fire station at the Orange County Airport to replace the
old Station No. 27. The Assistant Director of GSA /Facilities and Real
Property is authorized to negotiate an agreement with the architect and
submit it to the Board of Supervisors for its approval and execution.
IN RE: AGREEMENT HARBOR. PATROL SERVICES CITY OF SEAL BEACH
On motion of Supervisor Schmiz, duly seconded and unanimously
carried, the Chairman and the Clerk are authorized to sign the Agreement
dated February 28, 1978, between the Orange County Harbors, Beaches and
Parks District and the City of Seal Beach, clarifying responsibilities for
public safety services in Anaheim. Bay /Sunset Harbor, as recommended by the
Director of EMA. _

2 THIS AGREEMENT is made and entered into by and between the CITY OF SEAL
3 BEACH, a municipal corporation hereinafter referred to as "CITY," and the ORANGE
4 COUNTY HARBORS,. BEACHES AND PARKS DISTRICT hereinafter referred to as "DISTRICT."
5 WHEREAS, CITY and DISTRICT, through their various departments and agents
6 are responsible for the administration, operation, and maintenance of portion. of
7 that area shown as Anaheim Bay as.illustratec1 on the attached Exhibit i including
8 county's SUNSET AQUATIC PARK; said Anaheim Bay hereinafter referred to as "HARBOR,"
9 and
10 WHEREAS, there is a mutual interest by each party in establishing guide -
11 lines which will clarify the mutually agreed upon duties of each party with reference
12 to HARBOR;
13 NOW, THEREFORE, for and in consideration of the covenants herein con -
14 tained to be mutually performed by the parties hereto, said parties agree as follows:
15 I. WATER DEBRIS AND DREDGING.
16 A. CITY shall be responsible for the regulation and control of all
17 discharges into the HARBOR originating from land sources within the limits of CITY.
18 B. CITY shall be responsible for the removal of refuse and debris
19 deposited on the shores of the HARBOR and floating debris in navigable waters of
20 HARBOR not owned or leased by DISTRICT.
21 C. DISTRICT shall be responsible for removal of hazards to navigation
22 floating in navigable waters of HARBOR or which are on the shore in public areas
23 of the DISTRICT's fee owned or leased property,.
24 D. CITY shall not issue permits or approve of dredging or excava-
25 tion in or under HARBOR waters, whether in public or private property, unless the
26 applicant has submitted an Environmental Impact Report or a request for an Environ-
27 mental Impact Exemption and said report or exemption has been reviewed and approved

1 E. DISTRICT assumes no responsibility for maintenance dredging,
2 for any purpose, of any submerged lands within CITY's incorporated limits except
3 for those lands owned or leased by DISTRICT for public recreational use.
4 II. NAVIGATION
5 A. CITY shall, as part of its zoning regulations, establish pier
6 head and bulkhead lines for private properties within CITY'S jurisdiction in HARBOR,
7 with concurrence of DISTRICT's Director, Environmental Management Agency, and
•
8 regulatory agencies as is appropriate. •
•
9 • B. No modification in harbor lines or navigable channels of HARBOR
10 will be made or recommended to the U.S. Army Corps of Engineers except by joint
11 recommendation by the City Council of CITY and the Board of Supervisors of DISTRICT.
12 C. CITY shall, in permitting any development; dredging or construc
13. tion within the navigable waters.of CITY, require the establishment of an appropriate
14 mechanism, which shall be enforced by CITY, to require the developer or occupant
15 of said improvements to provide for maintenance thereof at no expense to DISTRICT,
16 III. ANCHORAGES, MOORINGS, PIERS, DOCKS, BULIaHEADS, AND GROINS
17 - A. CITY shall be responsible for a(Iministrat:i.on of permits for •
18 the construction of shore- connected structures (slips and piers) and sea
19 walls within CITY', incorporated limits, with the exception of those structures
20 on County or DISTRICT fee or lease property.
21 B. CITY shall notify DISTRICT of all permits issued for con -
22 struction within HARBOR waters of CITY and shall require permittee to coordinate
23 said work with DISTRICT Harbor Patrol.
24 IV. PUBLIC SAFETY
25 A. CITY shall have the responsibility and authority for law
26 enforcement activity in that portion of SUNSET AQUATIC PARK which lies within
27 the CITY's jusrisdiction, with the following exceptions:
28 • 1. DISTRICT shall and CITY may enforce boating regulations

1 contained in the Harbors and Navigation Code of the State of California.
2 2. CITY authorizes DISTRICT and DISTRICT agrees to enforce
3 all those ordinances contained in Title 2, Division 2, Articles 4, 5, 6, 8,
4 and 11 of the Codified Ordinances of the County of Orange, California.
5 3. In the event that the Police Department of CITY requests
6 assistance in its law enforcement operations within SUNSET AQUATIC PARK, DISTRICT
7 - Harbor Patrol personnel shall render aid to the extent of their authority, and
8 provided such aid does not interfere with other DISTRICT responsibilities. In
9 the event the DISTRICT personnel request aid in its law enforcement operations
10 within SUNSET AQUATIC PARK, CITY shall render aid to the extent that such aid
11 does not interfere with other CITY responsibilities.
12 4. DISTRICT Harbor Patrol personnel shall promptly notify
13 Police Department of CITY of observed or reported infractions of laws other
14 than-state and local boating laws and shall stand by to assist the department_
15 in its response to such notifications in accordance with Section IV, Paragraph A-3
16 of this Agreement. Notifications are not to include the minor infractions such
17 as speeding vessels, no life preservers, no CF numbers, etc.
18 5. The Police Department: of CITY shall furnish DISTRICT
19 Harbor Patrol with copies of all reports dealing with property loss and vandalism
20 which occurs on HARBOR waters.
21 6. Police Department of CITY shall notify DISTRICT Harbor
22 Patrol immediately of any suspected or actual criminal activity, police surveillance,
23 or similar activity occurring on or adjacent to HARBOR waters,
24 7. CITY shall provide DISTRICT Harbor Patrol with copies
25 of lost and found property reports. DISTRICT Harbor Patrol may retain and release
26 lost property to the owner or as authorized by CITY.
27 8. Where criminal activity is suspected to have occurred
28 within CITY boundaries, all investigative efforts will be by the Police Department

1 of the CITY.
2 B. CITY shall have the responsibility and authority for fire
3 protection and medical emergencies in SUNSET AQUATIC PARK, with the following .
4 exceptions:' •
5 1. DISTRICT shall be responsible for providing fire
6 fighting and medical aid services on navigable waters within the'HARBOR.
7 • 2. DISTRICT Harbor Patrol shall respond to all fires,
8 offshore along bulkheads, and along the shok in those cases where its equipment.
9 can be utilized. In the event of fires in boats off - shore, DISTRICT Harbor Patrol_
10 shall have the responsibility for fire fighting operations. CITY shall notify
11 DISTRICT Harbor Patrol of reports of fires along shore or off-shore.
12 3. CITY shall establish and shall enforce regulations for
13 fire prevention on shore - connected facilities. DISTRICT Harbor Patrol shall,
14 with reference to off -shore boats, enforce those fire prevention regulations
15 which have been established by the U.S. Coast Guard and by County Ordinance.
16 Whenever a water- oriented or waterfront emergency is reported to the CITY or
17 the DISTRICT Harbor Patrol, such as a drowning, heart attack, or other emergency
18 medical situation, that agency shall immediately notify the other agency and-both
19 agencies shall respond to provide aid as necessary in accordance wth Section IV,
20 Paragraph A -3 of this Agreement. •
21 • 4. CITY shall accept DISTRICT Harbor Patrol forms and pro -
22 cedures for making reports, copies of which shall be made available to CITY
23 upon request.
24 C. Marine safety is a mutual responsibility of CITY and DISTRICT.
25 While DISTRICT's primary function includes boating safety within the HARBOR and
26 CITY's primary function includes safety of beach and waterfront users within the
27 CITY limits, both jurisdictions shall observe the rule of response by the closest:
28 and most available personnel and equipment and shall reinforce each other's rescue

2 V. GENERAL ADMINISTRATION, OPERATIONS, STANDARDS, AND PROCEDURES
3 A. As general operating procedures must be constantly updated
4 for maximum efficiency, such operating procedures will be shown in the attached
5 Appendix.L By mutual consent, CITY manager and DISTRICT Director, Envi.ronmental.
6 Management Agency, may modify specific operating procedures and standards outlined
7 in the attached Appendix. The CITY manager and DISTRICT Director, Environmental.
8 Management Agency, have the authorization to carry out the terms of this Agreement.
9 so long as they are in accordance with the intent of the Agreement.
10 B. The Appendix shall not be considered a part of this Agreement,
11 as it is subject to administrative modifications.
12 VI. TERM
13 This Agreement shall become effective immediately upon execution by
14 both parties and remain in force and effect until either party notifies the other
15 of termination in writing at least ninety (90) days prior to the denir.e_d termination
16 date.
17 VII. HOLD. HARMLESS
18 CITY agrees to indemnify and hold DISTRICT harmless from any loss,
19 liability, claim, suit or judgment resulting from work or acts done or omitted
20 by CITY in carrying out this Agreement. DISTRICT agrees to indemnify and hold CITY
21 harmless from any loss, liability, claim, suit or judgment resulting from work or
22 acts done or omitted by DISTRICT in carrying out this Agreement. These provisions
23 are included in accordance with Government Code Section 895.4 and are applicable
24 to all parties hereto,
25 VIII. MODIFICATION
26 This Agreement may be modified, altered, amended, or revoked provided
27 that a written instrument containing such modifications, alterations, amendments,
28 or .revocations be executed by the parties hereto.

APPENDIX
1 This appendix applies only to those areas in HARBOR which are within CITY' s
2 limits,
3 I, LAW ENFORCEMENT - OBJECTIVES
4 DISTRICT
5 1. To respond one , and preferably two, fully sworn and trained Sheriff' s
6 Deputies by boat to arrive at all water-originated (boar or land) law enforcement
7 incidents in HARBOR within incorporated limits of CITY,
8 DISTRICT, CITY
9 2. To continuously provide and operate communicr:Lions receiving and trans-
10 mitting equipment as follows:
11 a. Two lines of telephone
12 b. One channel of radio frequency (45.92) (Lifeguard frequency)
13 DISTRICT, CITY
14 3. To enforce all laws as prescribed in the Agreement..
15 4. To perform and report all incidents and activities as prescribed in
16
Agreement,
17 DISTRICT
18 5. General. Administration, operations , standards and procedures -
19 a. DISTRICT will hold all found and unclaimed items encountered within
20 CITY' s incorporated limits for twenty (20) calendar dsyn ,. At the end of this
21 period , CITY Police Department will remove such property to CITY facilities , where
22 it will be held for identification or auction. When items are picked up from
23 DISTRICT by CITY, CITY shall provide an itemized receipt. Upon the disposal of.
24 unclaimed vessels , CITY will pay DISTRICT the rate erLabiished by the County
25 Auditor-Controller for vessel storage when DISTRICT stores such vessels after
26 notifying CITY of availability of vessel for pickup by CITY,.
27 b. Special event permits for water-oriented activity within CITY' s
28 incorporated limits within HARBOR will be administered by the DISTRICT as

1 designee of the U. S. Coast Guard , with the understanding that any such activity
2 that may affect land area adjacent to the navigable waters of HARBOR may require
3 a permit administered by CITY. Both parties to this Agreement agree to immediately
4 provide copies of said permit to the other party.

6 6. To take all crime reports for felony incidents which occur within CITY' c
7 limits within HARBOR,
8 II, FIRE PROTECTION AND MEDICAL AID — OBJECTIVES
9 DISTRICT
10 1. To respond with one, and preferably two, fully teained firefighting
11 and emergency first aid personnel by boat and arrive at all water—oriented boat
12 or structure fires or medical aid incidents.
13 CITY
14 2. To respond a standard fire department assignment by land and arrive
15 at the closest land boarding point to all water—oriented (boat or structure)
16 firefighting or medical aid incidents.
17 DISTRICT
18 3. To continuously provide and operate boat communications receiving and
19 transmitting equipment as follows :
20 a. One channel of radio ( frequency 46.06)
21 DISTRICT
22 4. To maintain and operate a fire boat with standard equipment as publiched
23 by DISTRICT.
24 DISTRICT, CITY
25 5. To follow standard firefighting and medical aid procedures.
26 6. To report all incidents and perform all activities as included . in the

27 5 . GENERAL ADMINISTRATION, OPERATIONS , STANDARDS , AND
28 PROCEDURES .
29 A. As general operating procedures must be constantly
30 updated for maximum efficiency, such operating procedures will be
31 shown in the attached Appendix. By mutual consent, the adminis-
32 trators of the affected operating agencies may modify specific

1 operating procedures and standards outlined in the attached
2 Appendix. The affected administrators have the authorization to
3 carry out this Agreement so long as they are in accordance with
4 Ithe intent of the Agreement.
5 B. The Appendix shall not be considered a part of
6 this Agreement, as it is subject to administrative modifications.
7 I 6. TERM.
8 I This Agreement shall become effective immediately upon
9 I execution and remain in force and effect until either party
10 notifies the other of termination in writing at least ninety (90)
11 days prior to the desired termination date.
12 7. HOLD HARMLESS .
13 CITY agrees to idenmnify and hold SHERIF harmless from any
14 loss, liability, claim, suitor judgment resulting from work or
15 acts done or omitted by CITY in carrying out this Agreement.
16 SHERIFF agrees to indemnify and hold CITY harmless from any loss ,
17 liability, claim, suit or judgment resulting from work or acts
18 done or omitted by SHERIFF in carrying out this Agreement. These
19 provisions are included in accordance with Government Code Section
20 895.4 and are applicable to all parties hereto.
21 8 . MODIFICATION. '
22 This Agreement may be modified, altered, amended, or
23 revoked provided that a written instrument containing such modi-
24 fications , alterations , amendments , or revocations be executed by
25 the parties hereto.
26 IN WITNESS WHEREOF, the parties hereto have executed
27 this Agreement on the dates set opposite their respective
28 signatures .

1 APPENDIX
2 I. LAW ENFORCEMENT - OBJECTIVES
3 SHERIFF •
4 1. To respond one, and preferably two, fully sworn
5 and trained Sheriff's Deputy by boat to arrive at all
water-originated (boat or land) law enforcement incidences
6 in SUNSET BAY.

5. General administration, operations , standards and
18 procedures -
19 A. SHERIFF will hold all found and unclaimed
20 items for twenty (20) calendar days . At the end of
this period, CITY police department will remove such
21 property to CITY facilities , where it will be held for
identification or auction. When items are picked up
22 from SHERIFF by CITY, CITY shall provide an itemized
receipt. Upon the disposal of unclaimed vessels , CITY
23 will pay SHERIFF the rate established by the County
24 Auditor-Controller for vessel storage when SHERIFF
stores such vessels after notifying CITY of availability
25 of vessel for pickup by CITY.
26 B. Special event permits for water-oriented
activity will be administered by the Sheriff-Coroner
27 and Harbor Department Commander as designee of the
U. S. Coast Guard, with the understanding that any
such activity that may affect land area adjacent to
29 the navigable waters of SUNSET BAY may require a
permit administered by CITY. Both parties to this
80 Agreement agree to immediately provide copies of
said permit to the other party.

1 I. FIRE PROTECTION AND MEDICA•AID - OBJECTIVES
2 SHERIFF •

3 1. To respond with one, and preferably two, fully
4 trained firefighting and emergency first aid personnel
(preferably EMT-1) by boat and arrive at all water-oriented
5 boat or structure fires or medical aid incidents .

7 2. To respond a standard fire department assignment
8 by land and arrive at the closest land boarding point to all
water-oriented (boat or structure) firefighting or medical
9 aid incidents .

11 3. To continuously provide and operate boat
12 communications receiving and transmitting equipment as
