ORDINANCE NO. 1601 - AMENDING TITLE 9
(PUBLIC PROPERTY, PUBLIC WORKS AND
BUILDING REGULATIONS) CHAPTER 9.65
(RECYCLING AND DIVERSION OF
CONSTRUCTION AND DEMOLITION WASTE) TO
EXTEND THE DEADLINE TO REQUEST A FEE
REFUND
SUMMARY OF REQUEST:
Waive further reading and adopt Ordinance No. 1601, amending the City's
Recycling and Waste Diversion Ordinance by extending the deadline to request a
refund from 30 days to 180 days.
BACKGROUND:
The City Council considered this matter on November 8, 2010 and introduced the
subject ordinance. It is now appropriate to adopt the subject ordinance. (Copies
of Ordinance. No. 1601 to be adopted are available for review in the libraries and
the City Clerk's Office).
Staff would like to highlight the fact that there are current construction projects
underway that will benefit from this change in the Ordinance. There are projects
in the pipeline that will be able to request a refund because the deadline has
been extended that would not be eligible for a refund without this extension. As
noted previously these projects have fully complied with the Ordinance, except
for the fact that the refund was not requested within 30 days.
FISCAL IMPACT:
No impact at this time.

AN ORDINANCE OF THE CITY OF SEAL BEACH
AMENDING TITLE 9 (PUBLIC PROPERTY, PUBLIC
WORKS AND BUILDING REGULATIONS) CHAPTER
9.65 (RECYCLING AND DIVERSION OF
CONSTRUCTION AND DEMOLITION WASTE) TO
EXTEND THE DEADLINE TO REQUEST A FEE
REFUND
ORDINANCE NUMBER 1601
AN ORDINANCE OF THE CITY OF SEAL BEACH AMENDING
TITLE 9 (PUBLIC PROPERTY, PUBLIC WORKS AND BUILDING
REGULATIONS) CHAPTER 9.65 (RECYCLING AND DIVERSION
OF CONSTRUCTION AND DEMOLITION WASTE) TO EXTEND
THE DEADLINE TO REQUEST A FEE REFUND
THE SEAL BEACH CITY COUNCIL DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1. Title 9 (Public Property, Public Works and Building Regulations)
Chapter 9.65 (Recycling and Diversion of Construction and Demolition Waste)
Section 9..65.055.A. (Reporting) of the Seal Beach Municipal Code is hereby
amended as follows:

" §9.65.055 Reporting.
A. Within 180 days following the completion of the demolition phase of a
Covered Project, and again within 180 days following the completion of the
construction and /or renovation phase of a Covered Project, the Applicant shall,
as a condition precedent to receiving a refund of the Waste Diversion Fee
Deposit set forth in Section 9.65.045, submit documentation demonstrating to the
satisfaction of the Building Official compliance with both the diversion
requirements set forth in Section 9.65.010, and the approved WMP for the
project."
SECTION 2. The City Clerk shall certify to the adoption of this Ordinance and
shall cause the same to be published in the manner prescribed by law.
PASSED, APPROVED AND ADOPTED by the City Council of the City of Seal
Beach at a regular meeting held on the 13th day of December 2010.
