ROLL CALL Present: Mayor ProTempore Brownell Councilmembers Laszlo, Risner, Vanderstaay Absent: Mayor Grgas Also present: Mrs. Yeo, City Clerk Risner moved, second by Vanderstaay, to adjourn the meeting to the City Hall Conference Room at 7:03 p.m., due to a conflict of Council Chamber use. AYES: NOES: ABSENT: Brownell, Laszlo, Risner, Vanderstaay None Grgas Motion carried I The meeting reconvened in the City Hall Conference Room at 7:10 p.m. CERTIFICATION OF NOMINEES - MARCH 27, 1984 ELECTION The City Clerk reported that a new provision of the California Elections Code, Section 22843.5, requires the City Clerk to certify to the legislative body nomination facts in a case where there is no one or only one nominee to an elective municipal office as of 5:00 p.m. on the 1-24-84 63rd day prior to the election (January 24th). The City Clerk presented a Certification of Nominees to the City Council in accordance with Section 22843.5 of the California Elections Code as follows: CITY CLERK CERTIFICATION UNDER ELECTIONS CODE SECTION 22843.5 I I, Joanne M. Yeo, City Clerk of the City of Seal Beach, California, do hereby certify as follows: (1) Only one person has filed nominating papers for the office of City Clerk; (2) No other City officers will be elected on a City- wide basis at the 1984 Primary Municipal Election; (3) No City measure has qualified for submission to the voters at the 1984 Primary Municipal Election. Under Section 22843.5 of the Elections Code, by February 6, 1984, the City Council may appoint to the Office of City Clerk, for a four (4) year term, the one person who has filed nominating papers. In the event such appointment is not made by February 6, 1984, an election will be held for the Office of City Clerk on March 27, 1984. DATED: January 24, 1984 (signed) Joanne M. Yeo City Clerk City of Seal Beach I The City Clerk reported that subsequent to certification of the nomination facts to the City Council, said Notice will be publiShed as required by law, and that the Council may, prior to the 50th day before the scheduled election (February 6th), take action pursuant to Section 22843.5. The Clerk noted that should an appointment be made in lieu of the election, the person appointed shall qualify and take office and serve exactly as if elected at the municipal election for the office. In addition, the law provides that the Clerk shall not accept any statement of write- in candidacy after 5:00 p.m. on the 50th day prior to said election. Risner moved, second by Vanderstaay, to acknowledge receipt of the Certification of Nomination Facts as presented by the City Clerk. ROLL CALL Present: Mayor Grgas Counci1members Brownell, Laszlo, Risner, Vanderstaay Absent: None Also present: Mrs. Yeo, City Clerk APPOINTMENT - MUNICIPAL ELECTIVE OFFICE The City Clerk briefly reviewed the provisions of the new California Elections Code Section 22843.5, which allows the legislative body to take one of the fOllowing actions in a case where there is no one or only one nominee to an elective municipal office: I 1) Appoint to the office the person who has been nominated; 2) Appoint to the office any eligible elector if no one has been nominated; or 3) Hold the election if either no one or only one person has been nominated. The City Clerk noted that the Certification of Nomination Facts had been presented to the City Council on TueSday, January 24, 1984 at 7:00 p.m., and subsequently the Certification was published as required by 22843.5 on January 25, 1984.
