The City of Seal Beach (City) shall be responsible for vegetation control on Government property located within the fenced area as shown within the hatched area on Exhibit A. 2. The City shall install a new fence along the south boundary line of their property (that portion parallel to Bolsa Avenue and northward, parallel to Gardeners Road). Said new fence shall be installed on top of the retaining wall or on City property. 3. Any damage that occurs to, or maintenance required on the pavement on Government property within the fenced area shall be repaired or replaced by the City. 4. The City shall repair the section of its fence adjacent to Gardeners road and continue to keep in good condition the security fence that separates the Government Property from the City property. 5. The City shall be responsible for all costs related to installation of new fences and gates associated with this license, and described as items numbered & circled 1 through 5, inclusive in the Legend of Exhibit A, attached hereto and made a part hereof. 6. The City shall provide the Naval Activity, Environmental Department (Code N45W) with all necessary documentation to complete the Section 106 of the National Historic Preservation Act process prior to construction. This can include formal documentation of compliance with State preservation laws and regulations. It is estimated to take 3 months to complete the Federal process after the City provided documentation is received by the Navy. 7 The City shall anticipate the need to provide for archeological and Native American monitoring for all construction work conducted under this license agreement.
