ROLL CALL Present: Mayor Laszlo Counci1members Kredell, Supple, Vanderstaay Absent: Councilman Seitz Also present: Mr. Parker, City Manager Mr. Stepanicich, Assistant City Attorney Mr. Johnson, City Engineer/Director of Public Works Chief Picascia, Police Department Mr. Joseph, Assistant City Manager Mrs. Yeo, City Clerk WAIVER OF FULL READING Vanderstaay moved, second by Supple, to waive reading in full of all ordinances and resolutions, and that consent to the waiver of reading shall be deemed to be given by all Council members after reading of the title unless specific request is made at that time for the reading of such ordinance or resolution, AYES: Krede11, Laszlo, Supple, Vanderstaay NOES: None ABSENT: Seitz Motion carried ORDINANCE NUMBER 1100 - NOISE CONTROL ORDINANCE Ordinance Number 1100 was presented to Council for second reading 8-10-81 entitled "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, ADDING CHAPTER 13D TO THE SEAL BEACH MUNICIPAL CODE, PRO- VIDING FOR NOISE CONTROL WITHIN THE CITY." By unanimous consent, full reading of Ordinance Number 1100 was waived. Supple moved, second by Vanderstaay, to adopt Ordinance Number 1100 as presented. AYES: Kredel1, Laszlo, Supple, Vanderstaay NOES: None ABSENT: Seitz Motion carried ORDINANCE NUMBER 1101 - AMENDING ZONING ORDINANCE - HISTORIC STRUCTURES Ordinance Number 1101 was presented to Council for second reading entitled "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, AMENDING CHAPTER 28 OF THE SEAL BEACH CITY CODE BY ADDING SECTION 28-238.1 and SECTION 28-2403,1 PERTAINING TO HISTORIC STRUC- TURES." By unanimous consent, full reading of Ordinance Number 1101 was waived. Vanderstaay moved, second by Kredell, to adopt Ordinance Number 1101 as presented. AYES: Krede11, Laszlo, Supple, Vanderstaay NOES: None ABSENT: Motion carried Seitz RESOLUTION NUMBER 3089 - HONORING POLICE DEPARTMENT MEMBERS - 1981 POLICE OLYMPICS Resolution Number 3089 was presented to Council and read in full by Mayor Laszlo entitled "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, HONORING AND COMMENDING MEMBERS OF THE SEAL BEACH POLICE DEPARTMENT WHO PARTICIPATED IN THE 1981 POLICE OLYMPICS." Kredell moved, second by Vanderstaay, to adopt Resolution Number 3089 as presented. Approved the minutes of the regular meeting of July 27, 1981. E. Approved regular demands numbered 41105 through 41099 in the amount of $175,542.98; payroll of July 30, 1981 plus demands numbered 33079 through 33082 in the amount of $155,609.94 as approved by the Finance Committee and that wa=ants be drawn on the Treasury for the same. F. Terminated the Agreement dated October 1977 between the cities of Huntington Beach and Seal Beach and the County of Orange for restoration of the Sunset Beach Water Tower. G. Approved payment of the claim of Mark William Nelson for property loss in the amount of $118 upon receipt of the appropriate Release from Claim. H. Approved payment of the claim of State Farm Mutual Automobile Insurance Company on behalf of Lyle Wright for automobile damage in the amount of $244.03 upon receipt of appropriate Release of Claim. I. Denied the claim of Mike Scott Rutherford for auto- mobile damages and referred same to the city's insurance adjuster. J. Denied the claim of Russell Hoover for automobile damages and referred same to the city's insurance adjuster. K. Denied the claim of Nancy A. Notermann for bodily injury and referred same to the city's insurance adjuster. L. Waived the fee for use of the Senior Citizens Room of the Mary Wilson Library by the Friends of the Library for a book sale. Kredell, Laszlo, Supple, Vanderstaay None I I I Seitz Motion carried 8-10-81 Items Removed From the Consent Calendar ITEM "M" - GRANT APPLICATION - ROBERTI/Z' BERG OPEN SPACE AND RECREATION PROGRAM GRANT Councilman Kredell requested that the grant application be amended to refer to "ball fields" rather than "softball fields" and moved to authorize International Systems, Inc. to prepare the grant application for the Roberti/Z'Berg Open Space and Recreation Program Grant. Councilmember Vanderstaay seconded the motion. AYES: Krede11, Laszlo, Supple, Vanderstaay NOES: None ABSENT: Seitz Motion carried ITEM "N" - SALARY RANGE - CHIEF BUILDING INSPECTOR Councilman Kredell asked if approval of the increased salary range for the Chief Building Official would effect other employee salaries. The City Manager stated it would not. Kredel1 moved, second by Vanderstaay, to adopt the proposed salary range for the position of Chief Building Official. AYES: Kredell, Laszlo, Supple, Vanderstaay NOES: None ABSENT: Sei tz Motion carried COUNCIL REQUESTS OF CITY MANAGER and REPORTS Councilman Kredel1 inquired about legality of selling trailers in the Trailer Park. The City Manager stated he had not received a legal opinion as yet. Mayor Laszlo suggested that the Council consider retaining an independent consultant to analyze the proposed Hellman property development plan to insure that the best interests of the City have been addressed, and that the analysis address the type and highest number of units, road design and location, open space and recreation element, impact on existing commercial zones and/or the need for additional commercial zones, and future use and zoning of the existing oil extraction land. The City Manager stated the Tenta- tive Tract Maps are anticipated within sixty days and if the Council determines to obtain an outside consultant, review of the project would be appropriate at that time, and requested Council direction by the next meeting. Councilman Supple requested that the minutes I I I 8-10-81 I clearly reflect Mayor Laszlo's recommendation for the benefit of the Councilman absent from this meeting. Mayor Laszlo requested a report on regulations and legal procedures governing the sale of trailers in the Trailer Park. Councilman Kredell requested information regarding the status of the 1500 square foot unit being constructed in the Trailer Park and authority for its construction. Councilman Kredell referred to contribution of fees for construction and maintenance of recreational facilities in the communities of Mission Viejo and Irvine and suggested a similar procedure be considered for the Hellman development. WRITTEN COMMUNICATIONS Mrs. Joyce Risner, 845 Driftwood Avenue, requested her communication to the Council be included in the minutes as a matter of record. Supple moved, second by Laszlo, to direct the City Clerk to include the communication in the minutes verbatim. AYES: Kredel1, Laszlo, Supple, Vanderstaay NOES: None ABSENT: Seitz Motion carried Mrs. Risner read her communication in full as follows: "Honorable Mayor and City Council City of Seal Beach I I Your Honorable Body has made substantial and successful efforts over the past several years in providing mechanisms for public input by the establishment of various standing Boards and Committees as well as ad hoc groups in addition to the Commissions established in the City Charter. However, even with your efforts, it has recently been noted that to achieve the wide distribution of positions, as originally conceived, modifications in the appointment proceeduresare most desirable. For example, it is noted that 12 positions in the foot-noted groups were made to three individuals. Specifically, one individual was appointed to six positions; one individual holds three positions including membership on two Charter created Commissions. A new and additional 8-10-81 committee would include one or more of these individuals and further accentuate the present multiple condition if the procedure proposed for creation of the Advisory Committee of the Historical Element be adopted. This situation has probably occurred because of what I believe to be a defect in the appointment mechanism. Few could logically argue that multiple memberships as noted above are the mose desirable in terms of obtaining a wide distribution of citizen input and partici- pation or that the town is so devoid of interested and capable citizens that such multiple memberships are necessary or desirable. Conversely, multiple memberships could lead to citizen perceptions of cronyism and local government by clique which I believe your Honorable Body would agree is most undesirable. To assist in correcting the apparent deficiency in procedures and to improve the opportunities for citizen participation and input, I am recommending that your Honorable Body favorably consider and approve the following actions: 1. Adopt an ordinance limiting membership of an individual to one committee, board, or commission at a time; Acceptance of an appointment to a second committee or commission would be an automatic resignation from all prior appointments. It would be desirable for this rule to apply to all current appointees. 2. Adopt an ordinance requiring a public announcement on both the Council agenda and during Council meetings, of any and all vacancies and/or end of terms for two successive council meetings prior to any appointment or reappointment to a commission, board, or committee. All such announcements should include an invitation for interested citizens to apply. To achieve maximum results, a small advertisement and/or news story should also be placed in a local adjudicated newspaper. The Coordinating Council of Seal Beach could also be informed since this organization is composed of all service groups. Each Council District representative can then review applications and select their respective nominee for full Council approval. I believe the above recommendations would substantially enhance your I I I 8-10-81 efforts to achieve and assure a wide distribution of citizen input. Your approval of the recommendations would be a true and significant effort to improve the appointment mechanism and encourage citywide participatory democracy. I (signed) Joyce A. Councilman Supple suggested that prior to taking any formal action Council be provided with a list of all current appointive committees showing the number of members, length of terms, present appointees and appointment termination date, and that this matter be discussed when a full Council is present. It was the order of the Chair with consent of the Council to postpone this item until September. The City Manager stated he was in receipt of a communication from I Virginia Strain, member of the Sunset Beach Water Tower Architectural Review Committee, recommending that Mr. William H, Taylor, President of the Sunset Beach Community Association, be appointed to the Water Tower Committee. It was the order of the Chair with consent of the Council to receive and file the communication. 8-10-81 ORAL COMMUNICATIONS Mayor Laszlo declared oral communications open from the audience. Mr. Tom Blackman, 421 Beryl Cove Way, expressed support for the upcoming Westminster Avenue widening project, and requested that landscaping be improved and debris be removed from the area adjacent to the sidewalk on the north side of Pacific Coast Highway. Councilman Kredell suggested that the median islands on First Street be land- scaped; the City Engineer reported no landscaping project is currently being considered for that area and that no funds are available at this time, The City Engineer stated he would prepare a report estimating the costs to landscape the First Street medians. There were no other oral communications; Mayor Laszlo declared oral communications closed.
