The City Council of the City of Seal Beach met in regular session
at 7:15 p.m. with Mayor Laszlo calling the meeting to order with
the Salute to the Flag.

WAIVER OF FULL READING
Kredell moved, second by Vanderstaay, to waive the reading in full of

PROCLAMATION
Mayor Laszlo proclaimed the month of March, 1982 as "Red Cross Month".
PRESENTATION - TELEPROMPTER, INC.
Mr. Chin, Teleprompter, Inc., presented checks to the City in the amount
of $750,000 as advance payment of franchise fees and $140,000 in lieu of
certain cable equipment pursuant to the cable television franchise
agreement with Mayor Laszlo and members of the Council accepting on

behalf of the City.
City Engineer, Mr. Johnson, reported that pursuant to CoUncil authori-
zation,the engineering firm of Moffatt & Nichol have completed their
study of the sand erosion in the Surfs ide area and introduced Dr. J.
Walker of Moffatt & Nichol. Dr. Walker presented a summary review of
their study and stated they had addressed the continuing erosion

process of the Surfs ide beach and explored long term and emergency
shore protection measures. Dr. Walker stated that the next Corp of
Engineers sponsored nourishment program is not scheduled until 1983,
noting that the beach front homes will be in jeopardy by the next winter
season. Dr. Walker stated the most immediate solution would be the
replacement of beach sand and suggested transportation of sand from an
area approximately 1000 feet downcoast referred to as the "bulge" or
from the Anaheim Bay area. Dr. Walker described other alternatives
such as construction of a sheet pile seawall, a perpendicular groin,
100 to 300 foot breakwater parallel to the wave action, a spur on the
Anaheim Bay south getty or installation of longard tubes and provided
an estimated cost of each. Dr. Walker also recommended that the Corp
of Engineers be approached to step up their sand nourishment program.
Lengthy discussion followed regarding the responsibility of the
federal government to resolve the erosion problem, availability and
location of replacement sand, the possibility of implementing a legal
action against the federal government and the legality of expending
city funds in the private community of Surfside. The City Engineer
reported that he had been informed the Navy has moved up their
scheduled dredging of Anaheim Bay to September of this year which
would generate sand for some replenishment of the Surfs ide and main
beach areas as well as the Weapons Station beach and provide a partial
short term solution. The City Engineer stated that should the Council
determine to consider pursuing one of the proposed protective measures
as set forth in the study, a revetment being the most feasible, the
next step would be to pursue any available fUnding, noting that the
City's congressional representatives are aware of the problem. The
City Attorney cautioned against the use of public funds to correct a
problem not created by the City and which would be to the benefit of
private properties and recommended funding be pursued from the appro-
priate agencies. The difficulty in obtaining a long term commitment
for federal assistance without a contractual agreement was mentioned.
The City Manager reviewed the potential legal ramifications with the
expenditure of public funds to construct any type of shoreline

protection and suggested that an assessment district could be formed
to finance a protective project initiated by the Colony and that
efforts could continue to pursue increased participation by the State
and Federal governments. Mr. Joe Rullo, President of the Surfside
Board of Directors, agreed that construction of a revetment would
provide greater protection, however stated an increased nourishment
program is the best solution, suggesting every three years or more
sand of the proper quality every five years, and that the City join
in any legal action against the Federal Government if such action is
deemed necessary. The City Manager suggested that the staff investigate
the availability of all State and Federal funding, alternative means
of financing, obtain a statement from the Corps of Engineers regarding
their financial resources and replenishment time frame, and that the
City Attorney investigate the parameters of legal action against the
Federal government and that this information be brought back to the
Council for consideration. No formal action was taken on this item.
ORDINANCE NUMBER 1112 - VACANT LAND LIMITATIONS
Ordinance Number 1112 was presented to Council for second reading
entitled "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH,
CALIFORNIA, AMENDING CHAPTER 28 OF THE SEAL BEACH MUNICIPAL CODE BY
ADDING SECTION 28- 310, VACANT LAND LIMITATIONS." By unanimous consent,
full reading of Ordinance Number 1112 was waived. Kredell moved,
second by Vanderstaay, to adopt Ordinance Number 1112 as presented.

RESOLUTION NUMBER 3137 - HONORING MARY COLMAR - LIBRARIAN
Resolution Number 3137 was presented to Council entitled "A RESOLUTION
OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, HONORING
MARY COLMAR ON HER RETIREMENT AS LIBRARIAN OF THE MARY WILSON LIBRARY."
By unanimous consent, full reading of Resolution Number 3137 was
waived. Kredell moved, second by Vanderstaay, to adopt Resolution
Number 3137 as presented.

RESOLUTION NUMBER 3138 - AUTHORIZING PURCHASE OF CERTAIN ITEMS BY
DEPARTMENT OF GENERAL SERVICES
Resolution Number 3138 was presented to Council entitled "A RESOLUTION
OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, AUTHORIZING
THE DEPARTMENT OF GENERAL SERVICES OF THE STATE OF CALIFORNIA TO
PURCHASE CERTAIN ITEMS." By unanimous consent, full reading of Resolution
Number 3138 was waived. The City Manager clarified that the resolution
authorizes the purchase of four police vehicles for the Seal Beach
Police Department by and through the State of California Department
of General Services. Kredell moved, second by Supple, to adopt
Resolution Number 3138 as presented.

CONSENT CALENDAR
Kredell moved, second by Vanderstaay, to approve the recommended action
for items on the Consent Calendar as presented.
F. Approved the minutes of the regular meeting of
February 22, 1982 as presented.
G. Approved regular demands numbered 43256 through
43433 in the amount of $241,549.71; payroll of
February 23, 1982 plus demands numbered 33249
through 33261 in the amount of $149,609.83 as

approved by the Finance Committee and that
warrants be drawn on the Treasury for the same.
H.
Authorized the payment of claim submitted by
Richard Carlson for property damages in the
amount of $1154.00 upon receipt of the
appropriate release by claimant.

I. Approved the plans and specifications for
construction of perimeter fence and gates
at the Armed Forces Reserve Center Park and
authorized'the City Manager to call for bids.
J. Approved the settlement agreement between the
cities of Huntington Beach and Seal Beach
relating to the Sunset Beach Water Tower and
authorized the Mayor to execute the agreement
on behalf of the City of Seal Beach.

REPORT - CITIZEN PARTICIPATION COMMITTEE
The City Manager reviewed the proposed guidelines for a Citizen
Participation Committee that would suggest and review projects
proposed for Community Development Block Grant funding in the
target area. The City Council recommended that appointments to
the Committee be postponed until after the new Council is seated.
The City Manager stated a resolution would be prepared for Council
consideration at next meeting establishing the Committee guidelines
and concurred that appointments could be postponed until a later
date.
PURCHASE - STREET SWEEPER
The City Engineer reported that staff had received numerous demon-
strations of both three and four wheel street sweepers and that
several cities had been contacted to obtain operation and maintenance
information for each sweeper type. Mr. Johnson stated that the
original intent was to purchase a three wheel sweeper, however it
has been determined that the overall height of the three wheel sweeper
would not allow sweeping on numerous city streets due to interference
with large street trees and further, that the $61,000 appropriated
by the City Council for purchase of a sweeper is not sufficient to
purchase a new four wheel sweeper. The City Engineer reported that a
used 1981 model Mobile demonstrator sweeper had been located having

mileage of 895 and 32 actual sweeping hours, and is available with a
new sweeper six month warranty for $56,000 or less, including sales
tax, and recommended the purchase of the demonstrator sweeper. Councilman
Supple expressed his opposition to the purchase of used equipment if
it is possible to obtain new equipment for little difference in cost.
Discussion continued. Kredell moved, second by Vanderstaay, to
authorize the City Manager to purchase the 1981 Mobile TE-3 Sweeper
at a price not to exceed $56,500.

ORAL COMMUNICATIONS
Mayor Laszlo declared oral communications open. Councilman Kredell
referred to the parking of oversized vehicles and requested citing
for violations. The Police Chief stated the new oversized vehicle
parking ordinance will be in effect the end of March allowing citation
of violators at that time. Mayor Laszlo reported on a recent West
Orange County cities meeting at which it was the consensus of those
cities that a representative of each meet with legislators in
Sacramento on March 17th to discuss and voice objection to the
anticipated cut in State bailout monies to cities.
Kredell moved, second by Laszlo, to authorize the attendance of
Councilmember Vanderstaay at the March 17th meeting in Sacramento.
