PROJECT:
Project Overview:
The project proposes to renovate an existing pump station to accommodate the 25 -year stor>n event
and reduce flooding risks to existing development. The project will add two electric pumps directly
adjacent to the existing pump facilities on the east side. Inlet to the new pump facility is provided
through a 10 -foot wide and 5 -foot high box culvert from the wet well area of the existing pump
station. A 208 square -foot building will house the new pumps above an added wet well. A single
48 -inch diameter discharge pipe will be added to convey flows to the San Gabriel River. In
addition, a low flow diversion system will be constructed to convey dry weather flows to the
existing sewer system. The project is located between the southeasterly levee of the San Gabriel
River and First Street, northeasterly of Welcome Lane, in the City of Seal Beach.

Summary of Negative Declaration Preparation and Public Review Process:
The Negative Declaration for the West End Pump Station Reconstruction Project has been prepared
by a city- selected consultant, Culbertson Adams & Associates, and has completed the required 30-
day time period for receipt of comments. Comments were received by the City from March 12 to
April 12, 2004, in accordance with the provisions of the California Environmental Quality Act. A
copy of the subject document is provided as Attachment 2 for the information of the City Council.
The Initial Study, proposed Negative Declaration, and required public notices are on file at the
Department of Development Services.

CEQA Section 21091(d)(1) requires that the City, as lead agency, must consider any comments on
the proposed Mitigated Negative Declaration that are received _ during the public review and
comment period. Pursuant to CEQA, the lead Agency is only obligated to respond to comments on
an Environmental Impact Report, not for a proposed Mitigated Negative Declaration. However, the
City does prepare written responses voluntarily in order to acknowledge public input and fully
address any issues raised. The "Responses to Comments" document is provided as Attachment 6 to
this Staff Report.
Staff Recommendations regarding Negative Declaration — West End Pump Station Reconstruction
Project:
The required environmental review process has been completed and the analysis has indicated that
the proposed project will not have any significant effects on the environment if the mitigation
measures proposed in the IS /MND document are implemented.
The California Environmental Quality Act (CEQA) requires that all public agencies establish
monitoring and/or reporting procedures for mitigation measures (MMs) adopted as conditions of
approval in order to mitigate or avoid significant project impacts. Specifically, Section
21081.6(a)(1) states:

"The public agency shall adopt a reporting or monitoring program for the changes
made to the project or conditions of project approval, adopted in order to mitigate
or avoid significant effects on the environment. The reporting or monitoring
program shall be designed to ensure compliance during project implementation."
A Mitigation Monitoring and Reporting Program has been prepared in compliance with the
requirements of CEQA, and includes all mitigation measures from the Final Initial Study /Mitigated
Negative Declaration addressing the West End Pump Station Reconstruction Project. The
Mitigation Monitoring and Reporting Program also identifies the required timing and responsible
parties for implementation and monitoring. The mitigation measures have been sorted by topical
area in the order presented in the IS /MND. A copy of the Mitigation Monitoring and Reporting
Program is provided as Attachment 5 for the information of the City Council.
Staff recommends the City Council adopt a resolution that will memorialize the following
determinations of the Council:
The City Council hereby affirms that it independently reviewed and analyzed proposed
Negative Declaration prior to acting on the project and finds as follows:
tJ Negative Declaration - West End Pump Station Reconstruction Project was prepared by
a city - selected consultant and the final document was approved by City Staff and
therefore reflects the independent judgment of the City;
U There is no substantial evidence in the record that would support a fair argument that
approval of the project might have a significant environmental impact;
El Adoption of the proposed "Mitigation Monitoring and Reporting Program ", dated June
2004, as conditions of approval for the proposed project will mitigate or avoid
significant project impacts.
U Approval of this project involves no potential for adverse effects, either individually or
cumulatively, on wildlife resources and will not have an adverse impact on fish and
wildlife. The project consists of the renovation of an existing pump station to
accommodate the 25 -year storm event and reduce . flooding risks to existing
development at an existing pump station facility location with no existing vegetation or
wildlife, and has no impact on wildlife resources, since there are no identified wildlife
resources are on or adjacent to the site. The City Council directs the Director of
Development Services to file the appropriate De Minimis Impact Finding for the
California Department of Fish and Game Certificate of Fee Exemption.
The City Council approves the "Notice of Determination" and "California Department of
Fish and Game Certificate of Fee Exemption" and instructs the Director of Development

Services to execute and file these documents in accordance with the provisions of CEQA.
Copies of these documents are provided as Attachments 3 and 4, respectively.
FISCAL IMPACT
None. This project is budgeted within the Capital Improvement Program budget of the City.
Approval the recommended Negative Declaration will allow this project to proceed to preparation
of final construction plans and specifications and eventual construction.
RECOMMENDATION

Project Description
This is to advise that the City of Seal Beach (Lead Agency) has approved the above -
described project on June 14, 2004 and has made the following determinations
regarding this project:
1. The project will X not have a significant effect on the environment.
2. Mitigation measures X were were not made a condition of approval of
the project.
3. X A Negative Declaration was prepared for this project pursuant to the
provisions of CEQA. A copy of the Negative Declaration and record of project
approval may be examined at: City of Seal Beach, 211 Eighth Street, Seal
Beach, CA 90740.
An Environmental Impact Report was prepared for this project pursuant to the
provisions of CEQA, and was reviewed and considered by the decision making body
prior to its decision on the project. The Environmental Impact Report and record of
project approval, including comments and responses, is available to the public at: City
of Seal Beach, 211 Eighth Street, Seal Beach, CA 90740.
The City found that environmental effects of the project could be mitigated by
modifications to the project which are within the responsibility and jurisdiction of another
public agency.
Specific economic, social, and other considerations make infeasible the
mitigation measures or project alternatives identified in the Final Environmental Impact
Report.

Project Description:
The project proposes to renovate an existing pump station to accommodate the 25 -year
storm event and reduce flooding risks to existing development. The project will add two
electric pumps directly adjacent to the existing pump facilities on the east side. Inlet to the
new pump facility is provided through a 10 -foot wide and 5 -foot high box culvert from the
wet well area of the existing pump station. A 208 square -foot building will house the new
pumps above an added wet well. A single 48 -inch diameter discharge pipe will be added
to convey flows to the San Gabriel River. In addition, a low flow diversion system will be
constructed to convey dry weather flows to the existing sewer system.
Findings of Exemption (attach as necessary):
The project will not have a substantial adverse effect on any species identified by
California Dept. of Fish and Game and U.S. Fish and Wildlife Services as a species for
concern. The project proposes to upgrade an existing pump station. There are no known
species identified as species for concern existing on the site. No wetlands and no riparian
habitat or community exist on the site.
The project proposes to reconstruct an existing pump station to improve stormwater
conveyance to the San Gabriel River. The overall quantity of water discharged into the
San Gabriel River will remain the same as current conditions. In addition, the stormwater
quality will improve as the City continues implementation of City -wide water quality
strategies identified in the established Storm Water Quality Management Plan dated July
2001. Further, the project will divert dry weather flows to the sewer system for treatment

and disposal, as well as provide trash racks to remove debris and improve water quality.
No impacts to biological resources have been identified.
The project will not substantially interfere with the movement of any native resident or
migratory fish or wildlife, as none have identified as being impacted by the proposed
project.
Approval of this project involves no potential for adverse effects, either individually or
cumulatively, on wildlife resources and will not have an adverse impact on fish and
wildlife. The project consists of the renovation of an existing pump station to
accommodate the 25 -year storm event and reduce flooding risks to existing
development at an existing pump station facility location with no existing vegetation or
wildlife, and has no impact on wildlife resources, since there are no identified wildlife
resources are on or adjacent to the site.
Certification:
I hereby certify that the public agency has made the above findings and that the project will not
individually or cumulatively have an adverse effect on wildlife resources, as defined in Section
711.2 of the Fish and Game Code.

measures from the Final Initial Study /Mitigated Negative Declaration addressing the West
End Pump Station Reconstruction Project. The matrix also identifies the required timing
and responsible parties for implementation and monitoring. The mitigation measures have
been sorted by topical area in the order presented in the IS /MND.

operations shall require filtration mechanisms;
(b) concrete rinsates shall be collected and
shall not be allowed into storm drains; (c)
good construction housekeeping shall be
required (e.g., clean up all leaks, drips, and
other spills immediately; refuel vehicles and
heavy equipment off -site; keep materials
covered and out of the rain (including
covering exposed piles of soil and wastes);
dispose of all wastes properly, place trash
receptacles on site for that purpose, and
cover open trash receptacles during wet
weather); and (d) all erosion and sediment
controls shall be in place prior to
commencement of grading and /or
construction as well as at the end of each
day.

Section 1. Introduction
This document has been prepared to respond to public comments received on the
Mitigated Negative Declaration for the proposed West End Pump Station Reconstruction
project. The Mitigated Negative Declaration was subject to a 30 -day public review period
from March 12, 2004 to April 12, 2004. The California Environmental Quality Act
(CEQA) Guidelines Section 15073(a) states that the Lead shall provide a public review
period of not less than 30 days for a proposed Mitigated Negative Declaration when
review by state agencies is required.
Distribution of the Initial Study/Mitigated Negative Declaration and Notice of Intent to
Adopt a Mitigated Negative Declaration for review and comment included the following

the project site on March 10, 2004 and published in the local newspaper, The Sun, on
March 18, 2004. Copies of the Mitigated Negative Declaration were also made available
for public review at the Development Services public counter. In addition, the document
was available on the City's website for viewing and downloading.

Responses to Comments
The City of Seal Beach received nine comment letters on the Mitigated Negative
Declaration from public agencies, organizations and individuals. CEQA section
21091(d)(1) requires that the City, as Lead Agency, must consider any comments on the
proposed Mitigated Negative Declaration that are received within the public review
period. Pursuant to CEQA, the Lead Agency is only obligated to respond to comments on
an Environmental Impact Report, not for a proposed Mitigated Negative Declaration.
However, the City does so voluntarily in order to acknowledge public input and fully
address any issues raised.
CEQA Guidelines Section 15204(b) provides that in reviewing negative declarations,
persons and public agencies should focus on the proposed finding that the project will not
have a significant effect on the environment. If persons and public agencies believe that
the project may have a significant effect, they should 1) identify the specific effect; 2)
explain why they believe the effect would occur, and 3) explain why they believe the
effect would be significant.
CEQA Section 15204(c) further advises: "Reviewers should explain the basis for their
comments, and should, submit data or references offering facts, reasonable assumptions
based on facts, or expert opinion supported by facts in support of the comments. Pursuant
to Section 15604, an effect shall not be considered significant in the absence of
substantial evidence. Section 15204(d) also states, "each responsible agency and trustee
agency shall focus its comments on environmental information germane to that agency's
statutory responsibility." Section 15024(e) states, "this section shall not be used to restrict
the ability of reviewers to comment on the general adequacy of a document or the lead
agency to reject comments not focused as recommended by this section."
Each comment letter received during the public review period is included in its entirety in
this document. Each letter is followed by responses corresponding to comments
submitted in the letter. Comments raised generally include requests for clarification on
the project description, water quality, aesthetics, and noise. Responses are provided for
all comments submitted. No new significant environmental impacts are raised by the
submitted comment letters.

1. Is there a need to contact the Vector Control district since we will have standing water in the sump or
discuss mitigation of the biological hazard caused by the possibility of West Nile bearing mosquitoes. 1-1
Now it may be that the new low level pump may keep the sump drier than it is now in .which case that
would be an improvement.

every 1 to 2 weeks and periodic spraying conducted by the Orange County Vector
Control District. Provision of more reliable and effective pumps will improve
drainage of any standing water.

minor storm events. The combination of the existing and new pump stations will
provide an area with protection from the 10 -year storm as summarized below.

plant materials. Mitigation Measure A -1 is hereby augmented as follows:
A -1 Prior to approval of construction documents, project plans including
building elevations, wall details and landscaping shall be submitted for
review and approval by the Director of Development Services to ensure
the proposed design is compatible with adjacent development. Such plans
shall provide for decorative plant materials along the westerly fence to
buffer public views from the bike trail along the San Gabriel River.

1 -6 Well points will be required for construction dewatering. The pumps are a
submersible type and generate very little noise as they are located below ground
in the well casing. They will be operated on a 24 -hour basis during construction
of the sump. However, the City's experience with similar projects is that the
operation does not create significant noise and generate noise complaints.

River and the First Street, northerly of Welcome Lane, in the city of Seal Beach. The nearest
State Route to the project is Pacific Coast Highway (PCH).
Caltrans District 12 status is a reviewing agency on this project and has no comments at this
time. However in the event.dtany activity ,in Caltrans ' ; : right -of- -way, an encroachment permit will
be required. Applicant;; are required to plan for sufficient permit processing time, which may
include engineering studies and envitonmental documentation.

4 -1 The project hydrologic analyses used methodologies contained in the Orange
County Local Drainage Manual. However, the project has been and is being
coordinated with both the County of Los Angeles and U.S. Army Corps of
Engineers. Both agencies were consulted during the preparation of the West End
Pump Station Preliminary Design Report (including hydrologic studies) and also
included for the distribution of the Mitigated Negative Declaration.
4 -2 The comment advises that an encroachment permit is required for any work
within Los Angeles County right -of -way. It is acknowledged that the project is
required to comply with this existing regulation. No environmental issues are
raised by this comment.

WEST END PUMP STATION RECONSTRUCTION PROJECT
CITY OF SEAL BEACH
Thank you for the opportunity to provide comments on the subject document which we
received on March 16. 2004. The project proposes to renovate an existing pump station
to accommodate the 25 -year storm event and reduce flooding risks to existing
development. The project will add two electric pumps directly adjacent to the existing
pump facilities on the east side. Inlet to the new pump facility is provided
through a 10- foot -wide and 5- foot -high box culvert from the wet well area of the existing
pump station. A 20E square -foot building will house the new pumps above an
added wet well. A single 48 -inch diameter discharge pipe will be added to
convey flows to the San Gabriel River. In addition, a low flow diversion system wili be
constructed to convey dry- weather flows to the existing sewer system. The project is
located between the south levee of the San Gabriel River and First Street, northerly of
Welcome Lane, in the City of Seal Beach. We have reviewed the submittal and offer
the following comments.
Environmental Programs
As projected in the Los Angeles County Countywide Siting Element, which was
approved in late 1997 by a majority of the cities in the County of Los Angeles with a 5 -1
majority of the population and by the County Board of Supervisors in January 1998, a
shortfall in permitted daily landfill capacity may he experienced in the County within the

next few years. The construction, demolition activities associated with the proposed
project and the postdevelopment operation over the life of the proposed project will 5.1
increase the generation of solid waste and may negatively impact the solid waste
management infrastructure in the County. Therefore, the proposed environmental
document must identify what measures the project proponent plans to implement to
mitigate the impact. Dtherwise, the cumulative impact of solid waste generation from
individual projects will negatively impact the solid waste management infrastructure in
the County. Mitigation measures may Include, but are not limited to, implementation of
waste reduction and recycling programs to divert the solid waste, including construction
and demolition waste and excavated material, from the landfills.
The existing hazardous waste management infrastructure in this County is inadequate
to handle the hazardous waste currently being generated. The proposed project may
generate hazardous waste and /or household hazardous waste, which could adversely 5 -2
impact existing hazardous waste management infrastructure. This issue should be
addressed and mitigation measures provided. If any excavated soil is contaminated by
or classified as hazardous waste by an appropriate agency, the soil must be
appropriately managed and disposed.

Land Development
Hydrology and Standard Urban Storm Water Mitigation Plan (SUSMP) Review
This environmental document has been reviewed only for drainage and SUSMP 5 -3
impacts to Los Angeles County areas and facilities. The proposed project is located
within, the City of Seal Beach and •the City of Long Beach and does not affect the County
drainage system. We have no comments at this time.

Watershed Management
The proposed project should include investigation of watershed management
opportunities to maximize capture of local rainfall on the project site, eliminate 5 -4
incremental increase h flows to the storm drain system, and provide filtering of flows to
capture contaminants arigi nating from the project site.
Water Quality
The proposed project should fully assess and incorporate all appropriate Best
Management Practices to enhance quality of urban runoff and stormwater. The project 5.5
shall comply with all the requirements of the National Pollutant Discharge Elimination
System (NPDES) Municipal Storm Water Permit issued by your local Water Quality
Control Board. For the County of Los Angeles, the Los Angeles Water Quality Control
Board issued a NPDES Permit to the County of Los Angeles and local Agencies. Parts
IV.D. and IV.E, are rigarding Development Planning and Development Construction
issues.

5 -1 The project proposes to reconstruct an existing stormwater pump station. Due to
the small scale of the project, significant construction waste is not anticipated.
Based upon information provided by AKM Consulting Engineers, the project
includes approximately 2,000 cubic yards of excavation earthwork, of which
approximately 1,000 cubic yards will be returned to the site for recompaction.
Although a site as not yet been identified for the placement of the excess soil, the
excess 1,000 cubic yards of soil will need to be disposed of off -site. An off -site
location for disposal has not yet been identified, but typically the soil can be used
at another development site. However, to ensure that the excess soil is not
directed to local landfills, the following mitigation measure is added:
G -3 Prior to commencement of construction activities, an appropriate site
shall be provided for placement of excavated soils not needed for
recompaction at the project site. The identified site shall meet the
approval of the Director of Development Services. The excess soils shall
not be directed to a landfill.
The pump station facility presently provides for and also proposes trash racks that
separate out solid waste before stormwater reaches the San Gabriel River and
Pacific Ocean. As the reconstructed pump station will serve the same drainage
area and overall water volume as the existing pump station, no substantial change
in the amount of solid waste generated by the project is anticipated. Solid waste
disposal from the site is not serviced by County of Los Angeles landfills, but by
Orange County landfill facilities. Consolidated Disposal Services is the local
refuse service provider and no significant solid waste impacts have been
identified.
Further, efforts are being conducted on a city -wide basis to implement waste
reduction and recycling programs, particularly with regard to compliance with
Assembly Bill 939 requirements. Although the City has not adopted a
construction and demolition recycling ordinance, there are available programs for
reduction of construction waste such as concrete recycling. As clean loads of
concrete are removed from construction sites, the concrete is taken to rock
crushers. The rock is then reused as aggregate for road base, erosion control or
new concrete. The concrete is typically taken to Cobb Crushing or Blue Diamond.
The tonnage generated in Seal Beach for 2001 was 140 tons and for 2002 was
58.97 tons. The project will comply with all current City requirements regarding
recycling and solid waste disposal.
5 -2 The pump station reconstruction project is not anticipated to generate significant
amounts of hazardous waste. Small amounts of lubricants, oil or cleaners may be
kept on site to clean or maintain the proposed electric pumps. Any hazardous
materials storage or waste associated with the project is required to adhere to

existing storage, handling, and disposal requirements of the Orange County Fire
Authority.
5 -3 This comment raises no environmental issue. Therefore, no response is required.
5 -4 The purpose of the proposed project is to upgrade an existing pump station to
increase conveyance of stormwater for the safety of local residents. Due to the
nature of the use and size of the project site, maximizing capture of rainfall on the
project site is not an appropriate goal. However, the project does provide trash
racks to remove stonuwater debris and a low flow diversion for reducing
contaminants. On a city -wide basis, Seal Beach is pursuing opportunities for
decreasing peak stormwater flows and enhancing stormwater filtration and
retention. For example, a City program provides for a number of publicly owned
concrete parkways (areas between the street curb and sidewalk) being removed
and replaced with landscape area to provide for increased pervious surfaces. This
program is implemented on an ongoing basis and varies depends on the annual
funding level available. Similarly for development projects that add more than
400 square feet of new building area, the unneeded parkway area is required to be
removed and replaced with landscaping. Collectively, this program reduces
pervious area, increases filtration and reduces peak stormwater flows.
5 -5 As evaluated and discussed in the Mitigated Negative Declaration under the
Hydrology and Water Quality section, the project will comply with all NPDES
requirements. In addition, Mitigation Measure H -3 requires that Best
Management Practices be incorporated into the project's Water Quality
Management Plan. Mitigation Measure G -2 provides for erosion and sediment
control. Further, the project will enhance water quality over existing conditions
through the provision of a system for diversion of dry weather flows into the
sewer system for treatment. With implementation of the proposed mitigation
measures and low -flow diversion, no significant impacts will result.

Dear Mr. Whittenberg,
Thank you for the opportunity to review the Initial Study. /Mitigated Negative Declaration for the West
End Pump Station project, According to the initial Study /Mitigated Negative Declaration, the
proposed project is the rEnovation of an existing purnp station to accommodate the 25 -year storm
event and reduce flooding risks to existing development. In addition, construction of a low flow
diversion system to convey dry weather flows to the existing sewer system will take place. .
The following comments address the issue of the proposed project's with the Chapter 3
policies of the California Coastal Act of.1976. - The comments contained herein are preliminary and
those of Coastal Commission staff only and should.not be construed as representing the opinion of
the Coastal Commission itself.

Below are the comments by Commission staff on the Initial Study /Mitigated Negative Declaration.
1. CoasI Development Permit. The•lnitial Study /Mitigated Negative Declaration states that
the project Is not anticipated to require a.coastal development permit. The study claims that 8-1
the proposed project is consistent with Section 30610 of the Coastal Act and also with the •
Repair, Maintenance and Utility Mook- Up.Exclusions. After analyzing the proposed protect, it
has been determined thata coastal development permit would be required for the proposed
project. The proposed project consists of: 1) the addition of two new -electric purnps; 2) a
new 208 square 'oat building to house these pumps: 3) a new single 48 -inch diameter
discharge pipe to convey flows to the San Gabriel River; and 4) a new low flow diversion
system. The cor struction of these Items does not negate the need for a coastal
development permit since the proposed project does not the criteria of Section 30610
of the Coastal Act and the Repair.,, Mairiter +nce end Utility Hook -Up Exclusions. In
conclusion, a coastal development permit would be necessary for the proposed project.
2. City of Seal Beach $. Long Beath. As stated above, the proposed development will require a
coastal development permit. The proposed development within the City of Seal Beach City 8-2
limits will require a coastal development permit from the California Coastal Commission
since the City of Seal Beach does not have 2 Local Coastal Plan. However, a portion of the
project Is also located outside of the City of Seal, Beach. The permit jurisdiction of this
portion of the project is unclear at this tirrfe. It is either within the certified area of City of
Long Beach, which has a Local Coastal Plan and would issue the coastal development
permit for any portion of the project within the certified area over which they have jurisdiction,
or within the area of the Commission's original jurisdiction, which would require a coastal
development permit from ttie California Coastal Commission. The City will need to
coordinate with Commission staff and the City of Long Beach to clarify the areas of

jurisdiction, One tool that would help in the matter would be a site plan depicting all of the
project elements lr relationship to the corporate boundaries of the two cities, the location of 8�2
property boundaries, the location of the mean high tide line, and the location of known
tidelands, submerged lands, or pubjlp trust lands, whether filled or unfilled within the project
area. Once this plan is, prepareyd,. recommend that you forward it to both Commission
staff and the City lIf Long Beacht;for review and comment on the jurisdictional issue.

3. Coastal Access. !Section 30211 of the. Coastal Act stales that development shall not interfere
with the public's access to the sea. During construction of the proposed project, adverse
Impacts to public access may occur. For example, construction may cause adverse impacts 8 -3
to the upper portion of the San Gabriel River levee, which serves as an accessway to the
beach. Also, traffic along 1 Street which is the closest major street to the .project site, may
be adversely impacted by the cohstrisetiora _Therefore, a construction staging plan and
access detour plan should be de'velope r to sure that no adverse Impacts to public
access occurs during construction of the proposed•project.
4. Discharge Pipe. A new single 48 - inch diameter discharge pipe that will convey flows to the
San Gabriel River is part of the proposed project, Will construction of this pipe result In any 8 -4
adverse impacts 'to the water way (San Gabriel River). For example, will the existing rip rap
need to be alterei ?, or new protective device(s) be required ?, wilt the water way need to be
altered /filled ?, eto. Please provide more thorough description and analysis of Impacts of
this aspect of the project.

5. Low Flow Diversion. Construction of a Low Flow Diversion System is one aspect of the
proposed project. Additional information regarding this part of the project is necessary (i.e. 8.5
how does this operate ?;.what triggers it to.work ?: etc). Please provide a more thorough
description of thin aspect of the project.

8 -1 Compliance with the California Coastal Act is evaluated in the Land Use and
Planning section of the IS /MND (pages 28 to 31). In addition, an analysis of
project consistency with Chapter 3 Coastal Resources Planning and Management
Policies is provided in Appendix B of the IS/MND. Physical improvements are
proposed to convey more quickly existing stormwater flows and provide greater
flood control protection to the existing residents and facilities in this area of the
City.
The proposed project is the reconstruction of an existing pump station originally
constructed in 1959. No increase in drainage area served by the project is
proposed. In addition, the project will serve existing development within that area
and is not proposed to facilitate new or expanded development. The project is
urgently needed to provide adequate storm water conveyance to the San Gabriel
River to reduce flooding risks to existing residences and structures and provide
capacity to address the 25 -year storm event. The project will serve the same
watershed area before and after project implementation. The overall amount of
storm water conveyed by the project will not be increased by 10 percent or more.
As provided in the MND, there may be support for not requiring a Coastal
Development Permit. However, further discussions with Coastal Commission
staff will help determine the need and scope of a Coastal Development Permit for
the proposed project. This comment does not raise any significant environmental
impacts.
8 -2 The project engineering firm, AKM Consulting Engineers, has prepared an
exhibit showing the City of Seal Beach and Long Beach boundaries overlaying
the project plan. This exhibit is included as part of this Responses to Comments
document on page 29. As the San Gabriel River is a riprap lined channel, no
known tidelands, submerged lands or public trust lands are located on the project
site or in the immediate vicinity.
8 -3 Construction activities are not proposed to obstruct the existing bike and
pedestrian trail along the adjacent San Gabriel River levee. In addition, due to the
scale of the project, significant construction traffic will not be generated that will
adversely affect 1 Street. However, to further ensure construction activities will
not adversely affect public access to the sea, the following mitigation measure
requiring a construction staging and access plan is hereby included in the final
Mitigated Negative Declaration.
T -2 Prior to the commencement of construction, the project contractor shall
prepare a construction staging plan and access detour plan to ensure that

no adverse impacts to public access occur during construction of the
proposed project. Such plan shall be submitted to and meet with the
approval of the City of Seal Beach City Engineer.
8 -4 The discharge pipe will be similar to the existing discharge pipes located adjacent
to the pump station. Final design of the outlet structure will require the approval
of the Army Corps of Engineers. The new pipe will not result in any adverse
impacts to the San Gabriel River.
8 -5 The low flow diversion system operates based on the amount of urban runoff that
is conveyed by the storm drain. As urban runoff is conveyed through the storm
drains to the existing wet well, the small 3- horsepower pump will pump up to 120
gallons per minute to the sewer system, thereby eliminating the urban runoff
flows to the San Gabriel River. The low flow conveyance from the existing wet
well will be through pipes placed in the existing drainage culvert.

35 Mr. Cummins stated that this CEQA document is a Mitigated Negative Declaration
36 (MND), which is slightly different than the Environmental Impact Report (EIR) for the
37 Boeing Project previously reviewed by the Board. He indicated that the MND has a
38 different standard of review and the Board's input will be slightly different. He explained
39 that the California Environmental Quality Act (CEQA) process as mandated by the State
40 of California requires a certain level of environmental review depending upon the scope
41 and nature of the project. He said that an initial study Is prepared by a contracted agent
42 that goes through a checklist of items to determine affects to be either Significant,
43 Potentially Significant, or to incorporate some type of mitigation to make them Less
44 Than Significant. He :3tated that the MND would be forwarded to City Council (CC) after
45 review and input by the EQCB. He noted that unlike the Boeing EIR, the Board would
46 not be reviewing this MND after this evening. He stated that the process for an MND is

1 to have the EQCB provide input during the 30 -day comment period, which, for this

5 Board regarding the adequacy of the MND under CEQA. Vice - Chairperson Hurley

8 CC? Mr. Cummins stated that all comments received would be addressed in the
9 Response to Comments, which would then be mailed to anyone who commented on the
10 document. He indicated that Board comments would be presented in a separate portion
11 of the City Staff Report. Vice - Chairperson Hurley asked if the general public would
12 receive the Response to Comments before CC receives it, Mr. Cummins stated that
13 members of the public could request a copy of the Staff Report the Thursday or Friday
14 prior to the actual Morday CC meeting. He noted that a copy of the MND is currently
15 available in the Department of Development Services for review by the general public.

17 Mr. Cummins then provided some background on this project. He stated that the West
18 End Pump Station (WEPS) is located directly between the Seal Beach Trailer Park
19 (SBTP) along First Street and the San Gabriel River. He noted that the WEPS is
20 located on a small piece of land that measures approximately 80 feet wide by 110 feet
21 deep, with the Oakwood Apartments and the Seal Beach Trailer Park (SBTP)
22 immediately surrounding the property and the San Gabriel River to the north. He stated
23 that the main access to the WEPS is located through the SBTP east of Riversea Road.
24 He indicated that a potion of the project area is actually located within the City of Long
25 Beach. He said that e copy of the Negative Declaration (ND) was mailed to the City of
26 Long Beach, but they have not yet submitted their comments regarding the proposed
27 work. Mr. Cummins then explained that the original pump station was constructed in
28 1959 and the current capacity is not great enough to handle a 25 -year flood scenario.
29 He noted that because the City does now experience flooding during a heavy rain
30 season, funding has become available to construct a new pump facility with a greater
31 capacity for handling flooding. He stated that the CEQA document acknowledges that
32 the existing pump station does not meet the required capacity and analyzes the
33 incremental impact of a new pump facility. He indicated that the Deputy City Engineer,
34 Mark Vukojevic was <ilso present tonight to respond to questions on this project. He
35 also noted that the project consultant, Diane Bathgate of Culbertson Adams Associates
36 (CAA), would be addressing the Board tonight.

38 Ms. Diane Bathgate slated that the City has retained CAA to evaluate the reconstruction
39 project for the WEPS from a CEQA perspective. She noted that pursuant to CEQA
40 Guideline Section 15063, CAA has prepared an initial study following the City's
41 environmental checklist tailored specifically to the City's needs. She indicated that the
42 analysis was completed under the direction of the Department of Development Services
43 and the Public Works Department. She said that 15 topical areas were reviewed and
44 are provided in the IV ND. Ms. Bathgate stated that the analysis was based upon the
45 project description and the preliminary design contained in the design report prepared
46 by Public Works Staff and their consulting engineer, AKM Engineers. She said that

1 much of the data reviewed and used in the proposed MND was based upon the
2 engineering analysis in the preliminary design report. She noted that the project was
3 also reviewed in the Gontext of some City documents such as the Master Plan of
4 Drainage, Sources to Master Plan, the Stormwater Quality Management Plan, and the
5 General Plan. She indicated that as a result of the analysis CAA is recommending 9
6 mitigation measures and pursuant to CEQA Guidelines, the environmental analysis
7 supports the issuance of a MND. Ms. Bathgate then explained that only one method of
8 notice is required under CEQA, but the MND has been posted to the City Website,
9 notice published in the Sun Newspaper, and notices mailed out to surrounding
10 residents. She said that the complete document was distributed to 27 public agencies
11 and organizations. She stated that once the public review period ends on April 12,
12 2004, CAA would assist in preparing the response to the comments received. She said
13 she would be happy to respond to questions from the Board.

31 descriptions of the actual directional views from the pump station. He then referred to 9�1
32 Page 9, Section A -1 and inquired whether City Council (CC) or the Planning
33 Commission (PC) would be reviewing these plans. Mr. Cummins stated that typically
34 Staff handles this type of review. He explained that when elevation and construction
35 plans are submitted, Staff would review them to ensure they are compatible subject to
36 the standards as outlined in the MND. Mr. Vukojevic interjected that when the project
37 comes before CC for authorization to proceed, the plans and specs do actually go to the
38 Council. Member Voce then noted that the fence with the "No Parking" sign pictured in
39 the photo on Page 10 should be replaced.

41 Member Barton commented that the only access to the WEPS is via the main road
42 through the SBTP. She suggested that having an access road from the Oakwood 9.2
43 Apartments during the reconstruction phase would alleviate some of the congestion and
44 mess along the trailer park road. She asked if the new building for the WEPS would be
45 more aesthetically designed and would it be the same height and size as the existing
46 building? Mr. Cummins stated that the final design plan has not yet been submitted.

2 correct phone number should appear on the building and expressed her concern about 9 -3
3 the amount of noise or mess there might be for the neighboring residents. Member
4 Barton then noted that in visiting the site she observed a l'ot of standing water along the
5 entry road.

7 Member O'Malley noted that in visiting the site he had also observed a lot of standing
8 water. He referred to Page 6, bullet item two, at the top of the page, and asked if there
9 are one or two engines that run the pumps. Mr. Vukojevic reported that currently there 9 -4
10 are two natural gas engines that run one pump each. Member O'Malley asked if this
11 was the same engine hat burned up during the October 2000 flooding. Mr. Vukojevic
12 responded that one of the engines had burned up. Member O'Malley asked if this
13 engine were to be replaced. Mr. Vukojevic stated that it had already been replaced.
14 Member O'Malley then asked if the remaining older pump is to be replaced. Mr.
15 Vukojevic confirmed that it is to be replaced. Member O'Malley then asked if there
16 would be two reconditioned pump engines and two new electric engines. Mr. Vukojevic
17 confirmed that this was correct. Member O'Malley then noted that in the drawing of the
18 proposed site on Pages 7 & 8, he did not see the small pump and the exit into the sewer
19 system. He asked where this was to be placed. Mr. Vukojevic stated that Member
20 O'Malley was correct, and stated that this small pump is actually a bolt on pump to the
21 existing well at the existing station. Member O'Malley asked where it would dump into
22 the existing sewer line. Mr. Vukojevic stated that this would be on First Street. Member
23 O'Malley indicated that this would mean the water would be going in the opposite
24 direction as the confluence into the river is going. He asked if the project work would
25 entail digging up parking lots or the streets in the trailer park. Mr. Vukojevic stated that
26 the pump and pipe are quite small and will be mounted inside of the existing storm drain
27 box that runs under the trailer park. He noted that the project would not be disruptive to
28 the residents.

30 Member Barton inquired about the noise level of the engine at the new station. Mr..
31 Vukojevic stated that the noise level would be substantially lower as it will be an electric
32 motor as opposed to natural gas engine.

34 Vice - Chairperson Hurley asked if after the work on the pump station is completed would
35 most of the noise come from the engines or the pumps. Mr. Vukojevic stated that the 9 -rj
36 new station would have electric motors, which would be relatively quiet. Vice -
37 Chairperson referred 1:o Page 32 and 33 of the MND and stated that he did not find the
38 explanations of the findings on noise to be adequate. He read from Page 32, Section
39 b), Lines 5 -7 and indicated that this statement requires extensive expansion to show
40 why it is true. He noted that the layperson should not be expected to know City
41 regulations, the potential impacts should be spelled out, and the phrase "noise
42 restrictions" is misleading because for construction work there are no restrictions on the
43 amount of noise. He then referred to Page 33, Section d), and stated that this section
44 reflects one of the criteria in CEQA Guidelines, Appendix G, for requiring an EIR. He
45 also noted that no evidence is provided to support the last sentence. He stated that
46 this section should be redone to provide a detailed description of construction noise

1 impacts and explain hcw they can be mitigated to less than significant levels. He said
2 that the City needs and EIR and needs to use the Statement of Overriding 9 -5

5 Vice - Chairperson Hurley then referred to Page 1, Section II, Line 1 and stated that the
6 description "the east levee of the San Gabriel River" should state "southeast levee," as 9 -s
7 the river runs northea.t and southwest in its direction toward the sea. He also noted
8 that in the second line "northerly" should state "north easterly." He commented that the
9 primal directions should be stated more precisely. He continued by referring to Page
10 14, Section d), and stated that more discussion on the specific impacts and how the
11 standard measures will adequately reduce them should be included. He noted that the
12 influence of the ocean onshore winds at this location should also be considered. Vice -
13 Chairperson then referred to Page 23, 2nd paragraph under Hydrologic Studies, and
14 stated that this section requires clarification of how the peak flow from a 25 -year storm
15 equals the peak discharge of a 100 -year storm. Mr. Cummins assured Vice -
16 Chairperson Hurley that all of these comments would be addressed in the Response To
17 Comments. Vice - Chairperson Hurley then referred to Page 24, Section b), Line 6, and
18 stated that it should read:

23 He then referred to Prige 35, Section a), 3 Paragraph, and stated that the return trips
24 for the 200 deportation trips must also be included in this analysis.

27 To Comments before it is presented to CC; however, the EQCB would not review this
28 MND in its entirety again. He stated that Board members are welcome to be present at
29 the CC hearing if they wish to do so. He noted that the MND is tentatively scheduled to
30 appear on the May 10, 2004 CC Agenda. Vice - Chairperson Hurley asked if EQCB
31 members would receive a copy of responses to all comments. Mr. Cummins stated that
32 responses to only the Board comments would be provided to the EQCB.

12 Mr. Cummins stated that Staff recently received a Notice of Intent to Prepare an
13 Environmental Impact Report (ElR) from the City of Long Beach for construction of an
14 approximate 22,000 square foot commercial project, including a new Home Depot to be
15 located on Studebaker Road just north of Westminster Avenue. He said that his project
16 could potentially impact the City of Seal Beach, particularly with regard to traffic
17 impacts. He indicateo that the comment period would end before the next scheduled
18 EQCB meeting, so Staff is recommending that the Board adjourn to a meeting on April
19 14, 2004, so that a formal comment letter can be prepared to forward to the City of Long
20 Beach. He stated that he would provide copies of the notice to the Board members at
21 the end of tonight's meeting.

23 Mr. Cummins then reported that at its next scheduled meeting the Board would probably
24 review the Mitigated Negative Declaration (MND) for the Rossmoor Center demolition
25 and reconstruction, as well as the San Gabriel River Corridor Master Plan document.

9 -1 As noted at the meeting by Mr. Cummins, the project plans and specifications will
be presented to the City Council for review and approval prior to project
construction. City staff reviews the plans to ensure compliance with adopted
mitigation measures and City regulations and standards. Although the need for
replacement of the "No Parking" sign does not trigger an environmental impact,
the City will include the sign replacement as part of the project specifications or it
may be a separate Public Works Department task.
Board Member Voce also requested that the IS/MND photographs depicting
existing conditions for the project site and surrounding area (Exhibits 6, 7 and 8)
be more specifically labeled. Photograph descriptions have been added, and the
revised exhibits are provided on pages 42, 43 and 44 of this Responses to
Comments document.
9 -2 Construction access is proposed to be taken through the Oakwood Apartments
parking lot as the majority of the proposed activity will take place in this vicinity,
not through the Seal Beach Trailer Park. This access will require negotiations
with the Oakwood Apartments property owner.
The visual appearance of the new 208 square -foot building to house the new
pump facilities will be similar in scale to the existing building on the site. As no
building design has yet been developed, proposed building plans will be part of
the project plans and specifications subject to City Council review and approval.
As required in Mitigation Measure A -1, prior to approval of construction
documents, building elevations, wall details and landscaping plans are required to
be submitted for review and approval by the Director of Development Services to
ensure the proposed design is compatible with adjacent development.
9 -3 Fencing along the northern boundary of the project site will be replaced with new
fencing with design specifications to be prepared as part of the construction plan
documents. Mitigation Measure A -1 requires review and approval of the
Development Services Director to ensure compatible design with the surrounding
uses. In addition, Mitigation Measure A -1 requires additional landscaping along
the fencing adjacent to the San Gabriel River levy to minimize views into the site.
No significant impacts will result.
Although not an environmental impact reviewable under CEQA, the contact
phone number on the existing building needs to be updated for accurate contacts
in the event of an emergency. The Public Works Department is aware of this need
and will be providing an updated sign and contact telephone number.

Responses to Comments
Project construction will be limited to the hours allowed by City's Noise
Ordinance and all construction activities will need to meet NPDES requirements
to minimize associated sediment and erosion impacts. As part of the project
construction specifications, the City will ensure that provisions require the
construction site to be kept in a clean and orderly condition. Any existing standing
water along the roadway into the Seal Beach Trailer Park is not related to the
proposed project as this is an existing drainage condition of a private access road.
However, the proposed project will enhance stormwater pumping ability of the
existing pump station and will reduce potential flooding risks for the surrounding
area.
The meeting discussion provided clarification regarding the existing and proposed
project conditions, as well as explanation as to how the proposed low -flow
diversion system would work. Questions were raised by Board Member O'Malley
regarding the number of existing and proposed engines and pumps. Previously,
one of the pump station engines burned up during flooding in October 2000. This
engine has already been replaced by a reconditioned unit. Ultimately, the existing
facilities will be upgraded to provide for two reconditioned pump engines and two
new electric engines. It was also noted that the new facilities would be quieter
than the existing facilities due to using electric motors as opposed to natural gas
engines. Concerns raised regarding standing water along the roadway within Seal
Beach Trailer Park are addressed above under response to comment 9 -4.
The proposed stormwater low flow diversion system will consist of a small pump
bolted on to existing facilities with a pipe conveying the flows into the existing
sewer system. The proposed pump and pipe would be located within the existing
storm drain box and would not require any digging or new containment
infrastructure.
9 -5 As discussed at the meeting, the proposed electric motors will be quieter than the
existing pump station equipment that use natural gas engines. Detailed equipment
specifications are not yet available, but will be provided as part of the project final
design and specifications to be presented for City Council review and approval.
However, project operations are required to meet the City's Noise Ordinance
standards that provide the exterior noise standards below. The following three
zones correspond to residential, commercial and industrial areas, respectively.

In addition, the City has considered construction activities in the development of
the Noise Control Ordinance and provided restrictions on the hours that

construction can take place. This approach acknowledges that noise impacts are
time sensitive and that construction activities are temporary in nature. For
instance, the same level of noise produced at night as people are trying to sleep is
perceived as a greater impact. The project is required to comply with the City's
Noise Ordinance that limits construction activities to between the hours of
7:00 a.m. and 8:00 p.m. on weekdays and between 8:00 a.m. and 8:00 p.m. on
Saturday. Construction activities are not allowed at any time Sunday or local,
State or Federal Holidays. The Noise Ordinance anticipated a range of
development projects. Due to the size and scale of the proposed the pump station
reconstruction project, no significant impacts are anticipated.
9 -6 The directions contained on page 1, 2 paragraph, are clarified as follows:
The existing West End Pump Station (WEPS) site is located between the
southeast levee of the San Gabriel River and First Street, northerly
northeasterly of Welcome Lane in the City of Seal Beach.
The proposed project will affect an area approximately 1,600 feet in size. Due to
the size and scale of the project, significant air quality impacts will not result from
project implementation. However, as described on page 14, standard short-term
construction- related air quality management measures will be implemented
pursuant to SCAQMD guidelines and requirements. Such measures are identified
in Tables 1 and 2 of SCAQMD Rule 403 and will include at a minimum the
following relevant measures for the proposed project:
• Site watering for dust control
• Use of low emissions mobile construction equipment
• Maintain construction equipment engines by keeping them tuned
• Use low sulfur fuel for stationary construction equipment. This is required by
SCAQMD Rules 431.1 and 431.2
• Stabilize stockpiled materials
• Cover haul trucks
• Utilize existing power sources (i.e., temporary power poles or existing outlets)
to minimize the use of higher polluting gas or diesel generators
Due to the nature of the project, a reconstruction of an existing pump station to
convey stormwater, onshore winds are not anticipated to affect the operation of
the pump station or trigger significant environmental effects.
To clarify the language provided on page 23 regarding protection from the 25-
year storm in relationship to the peak discharge of the 100 -year storm expected
flood value, the following deletion is provided:
Because portions of the tributary area are below the San Gabriel River
levees, the recommended minimum level of protection is the peak flow
