Bahorski, City Manager FROM: June Yotsuya, Assistant City Manager SUBJECT: RENEWAL OF ONE -YEAR PARKING AGREEMENT BETWEEN GRACE COMMUNITY CHURCH AND CITY OF SEAL BEACH SUMMARY OF REQUEST: This Letter of Agreement is a one -year renewal of the contract between Grace Community Church, 138 Eighth Street, and the City of Seal Beach for use of the Eighth Street City Hall permit parking lot by members of the church. DISCUSSION: Since 1995, Grace Community Church and the City of Seal Beach have signed a sl ries of parking renewal agreements that have allowed the church to use the Eighth Street City Hall permit parking lot on Sundays only from 8:00 a.m. to 1:00 p.m. From 1995 to 6/30/2003, the church paid $40 each for 37 parking permits for the lot. However, City parking fees increased over the years but the church parking agreement remained flat. Because of this situation, staff changed the agreement last year to include an annual rate adjustment based on the CPI. In 2003, the City used a calculated rate adjustment based on the current CPI ratio of 3.9% that reflected in a rate increase from $40 per space to $41.56 per space. Using the current CPI ratio of 2.1%, the new agreement will be $42.43 per space for 2004 -2005. In addition to providing use of the City permit lot, previous agreements also provided ten (10) guest permits at no cost for occasional use by church - designated visitors on a Monday through Sunday basis. The current value of the guest permits is $14 each. Church visitors are not allowed to park in the Eighth Street municipal lot during the week unless the car displays one of the guest permits allotted to the church. In reviewing the renewal with the church representative, staff discussed including the costs for the guest permits into the new agreement; however, the church representative did not agree to the addition. The tern of the renewal agreement is for one year commencing on July 1, 2004 and terminating on June 30, 2005. Parking privileges under this agreement does not absolve the church's responsibility to meet any current or future parking requirements required under the City's Municipal Code or General Plan provisions. FISCAL IMPACT: The City will receive $1,569.91 from the church for use of the parking lot during this one -year term as described in the Letter of Agreement. RECOMMENDATION: Staff recommends the City Council approve the Letter of Agreement between Grace Community Church and the City of Seal Beach for use of the Eighth Street City Hall parking lot for a one - year period from July 1, 2004 to June 30, 2005 and direct the City Manager to execute the contract.
