A RESOLUTION OF THE SEAL BEACH CITY COUNCIL
ADOPTING AN ADDENDUM TO THE INITIAL
STUDY /MITIGATED NEGATIVE DECLARATION FOR THE
INTERSTATE 405 /SEAL BEACH BOULEVARD IMPROVEMENT
PROJECT AND INSTRUCTING STAFF TO FILE APPROPRIATE
DOCUMENTATION WITH THE COUNTY OF ORANGE
THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES HEREBY
RESOLVE, FIND, DECLARE, DETERMINE AND ORDER AS FOLLOWS:
Section 1 . On October 25, 1999, the City Council adopted an Initial
Study /Mitigated Negative Declaration for improvements to the Interstate 405 /Seal
Beach Boulevard Improvement Project. The 1999 IS /MND addressed the full -width
widening of the Seal Beach Boulevard overcrossing of 1 -405 and roadway
approaches from North Gate Road (formerly Beverly Manor Drive) at the 1 -405
southbound ramps, to Old Ranch Parkway at the 1 -405 northbound ramps.
Section 2 . Under the California Environmental Quality Act (CEQA), an
Addendum to an adopted Negative Declaration or Mitigated Negative Declaration is
needed if minor technical changes or modifications to the proposed project occur
(CEQA Guidelines §15164). An Addendum is appropriate only if these minor
technical changes or modifications do not result in any new significant impacts or
a substantial increase in the severity of previously identified significant impacts.
Further, pursuant to CEQA Guidelines Section 15164(c ) an Addendum need not
be circulated for public review.
Section 3 . The Addendum IS /MND for the 1- 405 /Seal Beach Boulevard
Improvement Project addresses a substantial reduction in the scope of the
proposed project. Previously, the proposed project addressed a range of
improvements from North Gate Road at the 1 -405 southbound ramps to Old
Ranch Parkway at the 1 -405 northbound ramps in order to widen the Seal Beach
Boulevard overcrossing. The project has been revised to only include a limited
range of improvements (as described in the Addendum), none of which would
result in any new significant impacts or a substantial increase in the severity of
previously identified impacts.
Section 4 . The City has determined based on substantial evidence in the
record, including without limitation, the Addendum to the IS /MND dated December
2010, staff reports and testimony, that an Addendum is the appropriate
environmental document, and that none of the project revisions described in
Section 3 of the Addendum result in significant modifications to the original Project.
Further, that none of the conditions described in CEQA Guidelines Section 15162
(Subsequent Negative Declaration) exist.
The documents that comprise the record of the proceedings are on file with
the Department of Development Services, 211 Eighth Street, Seal Beach. The
custodian of said records is the Director of Development Services.
Section 5 . The City Council hereby adopts the Addendum to the
Mitigated Negative Declaration, and approves the Project.
Section 6 . The City Council hereby adopts the Mitigation Monitoring and
Reporting Program by reference, and imposes each mitigation measure as a
condition of the Project's approval. City staff shall be responsible for
implementation and monitoring the mitigation measures described in the 1999
MMRP and the in Addendum.

Section 7 . The Council hereby instructs the Director of Development
Services to file a notice of determination with the County of Orange and
authorizes staff to proceed with all steps necessary to implement the Project.

regular meeting held on the 14th day of February , 2011 by the following vote:
