Dancs, P.E., Director of Public Works /City Engineer SUBJECT: AWARD BID FOR ANNUAL CONCRETE REHABILITATION PROGRAM FY 2003/2004, PROJECT No. 50178 SUMMARY OF REQUEST: If the Council adopts staff's recommendation, such City Council action will: .1. Reject the lowest bid on the ground that it is non - responsive; . 2. Award a construction contract for the Annual Concrete Rehabilitation Program, FY , 2003 /2004, Project No. 50178, to the lowest responsive bidder, FS Construction in the amount of $49,700.00; and 3. Authorize the City Manager to execute the agreement. BACKGROUND: The awarded project will rehabilitate approximately 1500 linear feet of curb and gutter in the 200 and 300 block of Main Street. This program replaces portions of deteriorated concrete along the roadway, improving the drainage and standing water along the curb line. It will also update curb access ramps in an effort to reduce the backlog of concrete repairs. The Department's Tree Preservation Prog will continue to replace damaged sidewalks with pavers adjacent to mature trees. The Department chose this area because of its high pedestrian traffic, which will reduce potential situations for pedestrians. In addition to the high pedestrian traffic areas being corrected, the maintenance division will make repairs to other areas in the City on an ongoing basis. Currently there is a several million - dollar backlog of concrete repairs in the City as adopted in the Council five -year Capital Improvement Program. In an effort to preserve the Ficus trees on Main St., the Department has initiated an "in- house" Tree Preservation Program with the use of brick pavers. Crews remove the uplifted sidewalk adjacent to the tree, prune the roots and replace the section with brick pavers. The Public Works Department has nearly met its goal to have brick pavers around all existing trees along Main Street. This project also will prune roots along the gutters and will nearly complete all the concrete repairs along Main Street. This new curb and gutter will set the stage for future street rehabilitation maintenance and work such as slurry seal and overlays. Additionally, this will V Agenda Item . eliminate ponding water, which causes potholes and potential pedestrian access problems along the curb. Seven bids were received and opened by the City Clerk on Thursday, April 15, 2004 as listed below: 1. Inspection Engineering Construction, Inc. $40,194.00 2. FS Construction $49,700.00 3. International Pavement Solutions $55,950.00 4. West Coast Concrete Cutting $59,550.00 • 5. Damon Construction Co. $71,500.00 6. LH Engineering Co. $77,660.00 7. EBS, Inc. $86,990.00 8. Nobest, Inc. $88,000.00 The bid received by Inspection Engineering Construction, Inc. is non - responsive. The bidder's submitted bid documents do not contain the required information for its sub - contractors, references, sureties, and superintendents. FS Construction is properly licensed to do the work, has appropriate work experience and favorable references and would be the lowest responsible bidder for the project. If City Council requests that the project be re-bid in an attempt to attract additional bidders, the project's construction timeline will be placed into the busy summer months and may affect the Main Street Merchants. Upon the successful execution of the contract, the project should be completed around the end of the fiscal year in June. During construction, half -block sections of parking will be closed for up to 5 days for construction. • FISCAL IMPACT: The City originally budgeted $50,000 for fiscal year 2003/04 for the Annual Concrete Rehabilitation Program, Project No. 50178 from State Gas Tax. An increase in $45,000 expenditures was approved by City Council on February 23, 2004 from the 1996 Countywide Revenue Bond proceeds that were identified for and used for the Main Street Specific Plan Project. With the remaining funds staff will obtain a change order to complete additional sidewalk repair in the Main Street area. Any remaining funds would be reprogrammed for next year's street program as approved by City Council. RECOMMENDATION: It is recommended that the City Council: 1. Reject the lowest bid on the ground that it is non - responsive; 2. Award a construction contract for the Annual Concrete Rehabilitation Program, FY 2003 /2004, Project No. 50178, to the lowest responsive bidder, FS Construction in the amount of $49,700.00; and 3.
