SUBJECT: RECEIVE AND FILE - GREEN CURB REMOVAL
REQUEST AT 233 SEAL BEACH BOULEVARD.
SUMMARY OF REQUEST:
Receive and file the permitting of removal of green curb.
BACKGROUND:
The property owner of 233 Seal Beach Boulevard, Edward McLaughlin has made a
written request to the Public Works Department requesting the removal of time limited
parking (green curb) in front of the property site. The owner is currently planning to
demolish an existing commercial structure and construct 3 new single - family residences.
As a part of the permitting process, the property owner obtained a Coastal Development
Permit from the California Coastal Commission. A condition of this permit is that the
existing drive approach fronting Seal Beach Boulevard and the green curb at the property
site be removed thereby creating 2 new permanent parking spots.
The property owner has produced a written petition from surrounding property owners
supporting the removal of the green curb. However, the property owner has indicated
that the adjacent property south of 233 Seal Beach Boulevard (Sandpiper Bike Shop)
does not support the removal of the green curb.
Staff has reviewed the request and petition and visited the site. Based on the change of
property use from commercial to residential, Coastal Commission request, and the
majority of support from property owners on that street, the Public Works Department
will issue the property owner a Public Works permit to remove the existing driveway and
33 -feet of green curb. Approximately 29 -feet of green curb will remain in front of the
Sandpiper Bike Shop.
FISCAL IMPACT:
There is no fiscal impact. Costs associated with the removal of the driveway and green
curb will be paid for by the property owner.

Notice of Receipt and Acknowledgment. The permit is not valid and
development shall not commence until a copy of the permit, signed by the
permittee or authorized agent, acknowledging receipt of the permit and acceptance
the terms and conditions. is returned to the Commission office.
Expiration. If development has not commenced, the permit will expire two years
from the date on which the Commission voted on the application. Development
-,ha11 be pursued in a diligent manner and completed in a reasonable period of tame.
Application for extension of the permit must be made prior to the expiration date.
Interpretation Any questions of intent or interpretation of any condition will be

5 Terms and Concjitions Run with the Land. These terms and conditions shall be
perpetual, and it is the intention of the Commission and the permittee to bind all
future owners and possessors of the subject property to the terms and conditions.
SPECIAL CONDITIONS:
1. Storaste of Construction Materials, Mechanized Equipment and Removal of
Construction Depris
The permittees shall comply with the following construction- related requirements:
A. No construction materials, debris, or waste shall be placed or stored where it
may enter a storm drain leading to the ocean;
B. Any and all debris resulting from construction activities shall be removed
from the project site within 24 hours of completion of construction;
C. Erosion control /sedimentation Best Management Practices (BMP's) shall be
used to control sedimentation impacts to coastal waters during construction.
BMPs shall include, but are not limited to: placement of sand bags around
drainage inlets to prevent runoff /sediment transport into the storm drain
system and a pre - construction meeting to review procedural and BMP
guidelines;
D. Construction debris and sediment shall be removed from construction areas
each day that construction occurs to prevent the accumulation of sediment
and other debris which may be discharged into coastal waters. Debris shall
be disposed at a debris disposal site outside the coastal zone, pursuant to
Special Condition No. 2.
2. Location of Debris Disposal Site
The applicants shall dispose of all demolition and construction debris resulting from
the proposed project at an appropriate location outside the coastal zone. If the
disposal site is located within the coastal zone, a coastal development permit or an
amendment to this permit shall be required before disposal can take place.

3. Drainage and Pglluted Runoff Control Plan
The applicants shall conform with the drainage and run -off control plans received
on October 14, 2003 showing roof drainage and runoff from all impervious areas
directed to dry wells or vegetated /landscaped areas. Vegetated landscaped areas
shall only consist of native plants or non- native drought tolerant plants, which are
non - Invasive. Any proposed changes to the approved plan shall be reported to the
Executive Director. No changes to the approved plan shall occur without a
Commission amendment to this coastal development permit unless the Executive
Director determines that no amendment is required.
4. Revised Proiect Flans
A. PRIOR TO THE ISSUANCE OF THE COASTAL DEVELOPMENT PERMIT,
the applicants shall submit. for the Executive Director's review and approval,
two (2) full size sets of revised project plans showing that that the existing
\ i/ curb cut and parking time limit (green zone) that currently exists along Seal
Beach Boulevard in front of the project site are removed and the curb is
made available to the eneral public for parking u

B. The permittees shall undertake development in accordance with the
approved final plans. Any proposed changes to the approved final plans
shall be reported to the Executive Director. No changes to the approved
final plans shall occur without a Commission amendment to this coastal
development permit unless the Executive Director determines that no
amendment is required.
5. Legal Interest
PRIOR TO THE ISSUANCE OF THE COASTAL DEVELOPMENT PERMIT, the
applicants shall submit, for the review and approval of the Executive Director,
written documentation demonstrating that it has the legal ability to carry out the
proposed project and all conditions of approval of this permit.
